The Chief Justice wasnt against this project per say... Projects in Karachi have been stalled by the likes of Sindhs Chief Minister, and local people who oppose realize that such things will only benfit the rich and deny they access to the coast. The Bundal island project for example was made without any consideration for the fishermen who have lived and worked their for years...
Other projects like the New Murri project werent stalled by the Chief justice either, but by people who realized that it would be devastating to the environment and the money would be better spent on improving the existing town.
The only project that was stopped directly by the Chief Justice was the Steel Mills because it was an underhanded, and non transparent deal which should never have been made. For this we should thank the Chief Justice, since otherwise, it would have been business as usuall and the corrupt would have won.
This project should like all other project meet certain criteria before it can go on. The role of the govt and that includes the courts, is to make sure that ALL developers meet those standards..

People who are so desperate for investment, fail to realize that investment without oversight of some kind means that any scrupulous investor can do whatewver he want in violation of all norms and practices. This is why you have fly overs that come crashing down, or buildings that cant stand up to earthquakes because they werent made in accordance with the law.
If Emaar doesnt respect the law of the land, then we dont need their investment.. We should hope their are MORE people

actually steel mills deecision was completely non-sensical from financial and economic viewpoint. what made the decison more scary was that x-cj was clueless about economic issues and yet he was acting as the ultimate arbiter of economic policy which is responsibilty of govt and not the supreme court. obviously judges everywhere are not economic experts so they rely on testimony of independen experts such as accounting firms etc. x-cj otoh did not care about economic well being of pak and instead was taking decisions to gain cheap political support. privatisation is opposed by vocal and powerful vested interests and x-cj though he could increase his support base by ruling against privatisation. ultimately because of the x-cj, all large scale investments were under threat because investors were afraid that their investments would be stopped as a result of political vandetta by the supreme court. with that threat removed, investment environment has become much more condusive.

Thief justice was ignoramus for sure. However he is just another show-shaw-list (socialist) activists among many in Pakistan. ZAB and Dr. Mahboobulhaq were the granddaddies of them all show-shaw-lists.

These show-shaw-lists loath economic revival at the grave cost to the country's future.

Their pitiful minds have kept Pakistan chained to 200 years old obsolete economic policies that have brought so much misery to the common folks. Even in Steel Mills case, our government is spending hard earned tax payers money to keep 1000s employed in a highly inefficient and old mill. This obsolete mill on the other hand is begging for upgrades.

Tell you an example that you may be understand more easily. This thief justice forced us to continue using a 1980s Apple II while the rest of the world has moved on using Macs with the latest OS.

Faisal jee, first of all, its not the ex CJ, its the current chief justice... Im sorry if I dont accept the illegal ruling of a corrupt dictator as law..

Secondaly, the Steel Mills sale were halted because the process was intransparent and had all the hallmarks of a underhanded deal... The courts had to step in to prevent the corrupt officials of the Musharaf govt from selling of a national asset at throw away rates and without any oversight.

The CJ in this case didnt need to know anything about economics because this was a case of corruption which does fall under the jurisdiction of the courts.

Investors are afdraid because now they know they have to play by the rules, and not get away with highway robbery... The govt would sell their grandmother for a buck, and its up to the courts to pervent it... Simple as that. Investors who want to follow legal standards have no fear... Investors that are only here to fill their pockets with regard for rule of law, they will have to contend with the courts.

And, as far as deciding what the roles of different institutions are... Thats laughable..
First of all, when was it the military's job to be selling state units? Pakistani govt is so lop sided and deformed, its a ridiculous notion for anyone to say who can or cant have the authority to say to do what...

And if there is a vandetta between the Supreme court and the govt its up to the National Assembly to contend with it... That why they are there. In Pakistan, the two bit dictator rely's on power of his office as a dictator to literally dictate terms.. In a democracy, the third arms of govt would step in and set some limits. In Pakistan, if the dictator Musharaf see's a challenge from the Supreme court, that mean its time to take full control...
What more can you expect from his highness...

It will NEVER EVER look like this, nor will it provide the environment it is promising. There will be no water half the day, and electricity will be out 4 days out a week. Outside, it will be just taxis, rickshaws, teendabbywalay and beggers.

firstly about emaars project, they had nothing to do with the chief ministers, it went to the court and from there it was sent to the supreme court which stayed its construction.
secondly there bundle island project was stoped giving the excuse by thief justice that it will destroy mangroves and had nothing to do with fisherman.

and please get the typical pakistan mentality out your head that it will only be for the rich, the thousands of jobs made by it will not benefit the rich but the poor, then look at the enourmous economy benefits it will bring,

next, if you come on ssc forums you will notice a whole load of projects were stoped in the last year, go to shiek zayed center on ferozpur road, one of its directors is on ssc, he says himself court had stoped it, despite LDA approving it many times.

again it was the thief justice who put a construction ban on all buildings 3+ storeys in lahore, LOL what a joke.

there are tens a thousands of projects halted thanks to thief justice and most were restarted after he went, what does that show?

and steel mills, do you even know a thing about it, or do you just listen to what the thief says.
please go and do some research, steel mills is operating with outdated machinery and with heavy loans on its head, the decision to sell it was done seeing what the future holds for it.
the market for it is getting extremly competitive with state of the art factorys being setup hence due to there outdated factory this mill will go bankrupt once again in the next 5 years. MARK MY WORDS.

the mill needs to be sold off now otherwise its gone and the gov. wont be able to pay back its loans and then the idiots we are will finaly relise what shukat aziz was trying to do.

shukat aziz is a sane business man and his move to sell pak steel was actully a brilliant move, but great people like him get kicks in country like pakistan

Ok your confused... Typical of the supporters of dictators and those who lack the understanding of democracy and rule of law...

I mentioned the Chief minsiter because the Chief Justice is not the only one stopping these projects... The Chief Minister of Sindh himself, has thrown his considerable weight around... There are others in Pakistan that are against these so called infrastructure projects.
So obviously you completely missed the point on that one.

Secondly, im NOT against investment... The people who get directly affected by these projects are the ones who complain. Unlike in more developed countries where even the poor have a voice and rights, in Pakistan, people like you, desperate for any investment are willing to roll over any opposition no matter how justified.
In the case of Bundal island, the Chief Justice ("Thief" Justice, how clever!) stepped in to protect not only the environment but the poor fishermen of the island... Thats one of the reasons why people respect him, because unlike the dictator whos only role is only self perpetuation, the Chief Justice strived to defend the poor.
As for the Steel Mills, you are completely uninitiated... WE ALL KNOW IT NEEDS TO BE UPDATED WITH NEW INVESTMENT... The issue here was that the govt was selling it at throw away prices without any oversight... You obviously havent read anything on this.. Your to enamored of your dictator to understand that there are other sources outside of your dictators tv channel.

If you had any understanding of how a democratic and transparent govt functions, you would see what was wrong with the Steel mills deal..
The Courts in Lahore put the on building over 3 storeys... Again, you obviously have NO idea what is happening.. In Pakistan, there are people that COMPLETELY FLOUT construction protocals and rules... The Courts in Lahore flexed their muscle so that geniuses like you, who think a free for all in investment and construction is what we need, dont get crushed under these badly constructed buildings when god forbid there is an earthquake etc al la the margla towers..

The tens of thousands of projects are a complete exageration ofcourse... None of theme have been blocked completely as they are still on the ground... But they WILL have to follow the rules and safe practices before the can get the green signal to proceed..

chief minister problems were with bundle island project to do with ownership, this is creasant bay which only the court had a problem with, and even if cm had a problem with bundle island, it wasnt called of because of him it was called off because of supreme court,

firstly dnt compare pakistan to developed countrys, pakistan is a developing country and it has a world of difference compared to a developed country.
what would happen if there were some poultry farmers in the heart of london or in manhattan?
if you had some senses you would know they would be moved and relocated out as that is the main business area and most expensive land of the city which generate enourmous economic activity.
same thing was happening to bundle island, it has pottenial to generate enourmous economic activity, so fishermen were being located and land to be used for better uses.

The court has EVERY right to take this action as it is an indepenadant arm of the govt which is tasked to oversee the other branches...

The Buildings you are talking about HAD to be stopped to prevent them from flouting construction laws because they were probably ALL flouting these laws... Not to stop them would make it impossible to control the problem. Its like your in a room full of appliances that are going crazy.. The best way to stop them is to turn the electricity out on all appliances.. Its really common sense, but doesnt seem that common in your case. Ultimately, the engineers and investors, if Pakistan were a functional country, would be able to take the case to the courts themselves... This is how things normaly work.. Ultimately, the case would have gone to the Supreme court to decide... If the investors and engineers are in the right, then well and good, but if not, they would be told to offer guarantees that their work is up to par and they would be allowed to continue..

Now you lack the understanding of democracy and rule of law... The system is slow and imperfect, but it guarantees that people like Musharaf dont come in and abuse their powers as our dictator has... The system of courts guarantees that all people have access to justice and a fair hearing...
If there is a problem with the Courts, its up to the National ASSEMBLY to debate and to fix those problems. The problem with Pakistan is that ALL power is concentrated with the executive.. There is no balance in the system, so Musharaf can call and emergency, sack all the judges, ban the media, arrest innocent people, and do whatever he feels because there is no check on his powers... That is why he is a dictator and why we need a stron judiciary to prevent dictatorship...
