Court says PM not disqualified

Calling PM as convict and insulting him for no reason is absolutely not justified. When you insult elected PM like that, you are insulting yourselves. It is o.k. to criticize government for their performance but opening 10 threads daily to condemn government without any concrete issue to show Imran Khan as superman will never work in the elections. I have seen for quite sometime, some moderators/administration is working on that single agenda only. People are sick and tired of these lies and prejudice behavior.

Court says PM not disqualified | DAWN.COM

ISLAMABAD, May 11: The Islamabad High Court on Friday observed that the Supreme Court had not disqualified Prime Minister Yousuf Raza Gilani in the contempt case, rather referred the matter to other constitutional forums.

Justice Shaukat Aziz Siddiqui passed the remarks while hearing a petition filed by G.M. Chaudhry Advocate to stop Mr Gilani from working as the prime minister after his conviction by the Supreme Court.

The judge said restraining the prime minister from performing his duties would have an impact on the entire country and the court would not proceed with the matter unless the petitioner proved that the Supreme Court had disqualified him for the post.

He asked the petitioner how he would declare the prime minister disqualified and not competent to hold office when there was not a single sentence in the Supreme Court judgment that can establish his disqualification.

The Supreme Court could disqualify the prime minister or even restrain him from exercising his powers but it didn’t.

Instead, the apex court wanted the constitutional bodies to apply their wisdom as the disqualification of a parliamentarian was clearly defined in the constitution under which the speaker National Assembly can send the matter to the Election Commission of Pakistan.

Courts decide cases according to the constitution, not what morality, politics, democracy and history say, said Justice Siddiqui. The petitioner told the court that it should not wait for the prime minister’s appeal as a larger bench could not be
constituted for hearing of the appeal due to the shortage of judges in the Supreme Court.

After the court put a number of questions to Advocate Chaudhry, he withdrew the petition.—A Reporter

Re: Court says PM not disqualified

So, IHC is a constitutional court but isn't it under SC, so who is it to interpret what SC thinks?

Re: Court says PM not disqualified

Bhai 'convicted of a crime' and 'disqualified as a member of parliament or disqualified as a prime minister' are two different things.

For the record, he is still remains convicted.

We don't insult him for 'no reason'. There are a million reasons, we choose only a few. Thanks.

Re: Court says PM not disqualified

He is convicted but not disqualified, what kind of logic is that?

Re: Court says PM not disqualified

^ you can be convicted of a crime by a court, but the speaker of national assembly has to notify disqualification of a member of parliament after he/she has been convicted. The PM has a right of appeal and the court/election commission/speaker are probably waiting for the result of the appeal or end of time limit for that appeal. As of now, he is convicted of 'contempt of court'. That's about it.

Disqualification is not automatic after conviction.

BTW, this logic is more sensible than 'if they want to leave the country, why don't they leave'. Thanks.

Re: Court says PM not disqualified

He is a convict but he is not yet disqualified. Why can't we call him a convict then? or may be ex con?

Re: Court says PM not disqualified

Ye sara drama hi isse disqualify karene ke liye tha. Whatever he is still in office na jaye rafandan na pae rafandan ヾ(@⌒ー⌒@)ノ

Re: Court says PM not disqualified

He did not commit any crime. If following constitution is crime then every paki including CJ is criminal.

Re: Court says PM not disqualified

slongans, naaray, jazbaat, that's about it.

It is the judicial system that decides if someone committed a crime or not. And as long as the courts do not decide on his appeal, he is a convicted criminal.

This crime is, however, very insignificant compared to what these guys have been doing over the last 4 years.

P.S. BTW, if SC says he committed a crime, then he has not. If IHC says he is not disqualified, he is an angel. what's up?

Re: Court says PM not disqualified

It appears that the Supreme Court would be vetoed by the Speaker. So all cases should be presented before the Honourable Speaker henceforth?

Re: Court says PM not disqualified

This is democratic government. If it works under constitution, no institution including SC has right to impose any decision which is against the constitution.

Re: Court says PM not disqualified

Who is the final authority to interpret the constitution?

Re: Court says PM not disqualified

Supreme court has the authority to interpret constitution. It is not for any haram-khor politician to decide how to read constitution.

The Pakistani legal system is not applicable in Switzerland. No criminal proceedings are directed by the supreme court to be instituted in Pakistan.

But I supposed, corruption is the right of PPP under Pakistan constitution as the party interprets it and therefore is not a crime.

Interperating and working against the constituion are two different things. But you will not understand that because of your limited capabilities.
