Court says PM not disqualified

Re: Court says PM not disqualified

CJ is either incompetent or biased against PPP. What kind of third class decision he has given to downgrade the highest court in Pakistan. Shame on him.

PM sentencing against the law, claims Aitzaz | DAWN.COM

KARACHI: Prime Minister Yousuf Raza Gilani’s counsel in the contempt of court case, Barrister Aitzaz Ahsan, on Tuesday said that the prime minister’s sentencing was against the law, DawnNews reported.

Speaking to media representatives, Ahsan said the premier could not have been sentenced in the absence of a detailed verdict. He said short orders were not issued in criminal cases and that the prime minister’s sentencing was against the law.

Ahsan said an appeal would be filed challenging the Supreme Court’s verdict against the premier.

He further said that objections to the judgment were based on constitutional and legal grounds.

Saying “we do not accept the verdict” of April 26, the counsel reiterated that President Asif Ali Zardari enjoyed immunity from prosecution in Pakistan and abroad.

**Ahsan moreover said that the prime minister was sentenced in violation of Article 10-A of the Constitution.
**
The counsel urged that it was the duty of all Pakistani citizens to abide by the laws and the Constitution of the country.

“The prime minister has a number of options to choose from, including one of filing an appeal challenging the verdict,” Ahsan said.

Regarding the appeal, the counsel said that the judges who convicted the prime minister should not hear it.

Moreover, on the role of Speaker National Assembly in the process of a possible disqualification of the premier, Ahsan said the speaker was given the authority by the Constitution and not the Supreme Court.

He said it was up to the speaker’s discretion whether or not to send a reference in this case.

Re: Court says PM not disqualified

^CJ was not part of the panel if i am not wrong. There were 17 judges! and not a single one wrote an ikhtilafi note.

So either Aitezaz is right or 17 SC judges are.. no? of course Aitezaz's word is considered final by PPP.

p.s. I personally think contempt of court law is idiotic

Re: Court says PM not disqualified

This not about right or wrong. This is about constitution of Pakistan. The ruling is against the constitution. It does not matter whether 17 or 1700 judges gave the ruling.

Re: Court says PM not disqualified

LOL... CJ did not give that decision. LOL... :D

It is not for any haram khor politician to decide if an action is against constitution. Thanks.

Re: Court says PM not disqualified

**Article 10-A of the Constitution of Pakistan

(a) The members of Pakistan Peoples Party have a divine right and obligation to be corrupt.

(b) 'Others' are also corrupt.

(c) All legal proceedings in any court of Pakistan or any other country, specially Switzerland, where members of Pakistan Peoples Party may or may not have bank accounts violate constitution of Pakistan.

***Article 10-B*
The members of Pakistan Peoples Party, however mentally challenged or morally corrupt, have a right to decide whether any action or decision of any court in Pakistan violates constitution of Pakistan.

Aitezaz has also said that he was mentally prepared for 6 months imprisonment, since he didnt get that thats why its against law :)

Re: Court says PM not disqualified

Whatever creating pain in you, you are forgetting that PPP came in power through peoples' vote. That is the fact and digest that fact till next elections.

Re: Court says PM not disqualified

Unfortunately or fortunately he never became shaheed and continuing as PM as usual. And that is the fact.

Re: Court says PM not disqualified

The stupidity is quite intolerable. Focus on the topic and if you have to say something, say it.

Re: Court says PM not disqualified

Stupidity is,

  1. accepting a decision from High Court because it sort of favors you and rejecting one from Supreme Court because you don’t like it.
  2. calling chief justice incompetent or biased for a decision in a case he did not hear or pass judgement on.
