Contempt of Court Act, 2012

ISLAMABAD: The National Assembly on Monday passed the contempt of Court Act, 2012 amid opposition protest, Geo News reported.

Minister for Law, Justice and Parliamentary Affairs, Farooq H. Naek moved the bill in the assembly.

Under Section 148(1) of the constitution, holders of government offices including Prime Minister, federal ministers, ministers of state, chief ministers and provincial ministers have been exempted from court proceedings under charges of contempt of court.

The court will grant bail the same day of the contempt of court charge to the accused, if he/she is happens to be the holder of one of the above offices.

Prime Minister, Raja Pervaiz Ashraf, on the occasion said the government is committed to strengthening democracy in the country.

Commenting on the recent reopening of Nato supply routes by the government, he said the US offered apology on Pakistan’s demand.

He said the government had to face enormous pressure for eight months prior to the government’s move to restore Ground Lines of Communication for Nato supply to Afaghistan.

Law Minister, Farooq H. Haek said that no action was taken against that is in clash with the provisions of the Constitution or law.

He said some good provisions taken from 1976 and 2003 bills have been included in the bill.

Later, NA proceedings were adjourned till 11:00 AM Tuesday.

APP adds: Prime Minister Raja Pervez Ashraf Monday assured National Assembly of protecting and preserving national dignity as well as respect of the parliament and other institutions.

Speaking in the House after passage of Contempt of Court Bill and discussion on resumption of NATO supplies, the Prime Minister said, “the government is fully aware of national obligations and pride and has firm resolve to protect it.”

“We have not hidden anything from the nation and will not do so in future. If there will be any MoU or agreement regarding war against terrorism, we shall place it before the nation,” he added in special reference to resumption of NATO supplies.

so now what, is this bill in accordance with the spirit of constitution??? i mean immunity to whole govt makes them unaccountable and touchable…

Govt is hell bound to create mess after mess and all this to protect corrupt and corruption...

I don't know if there is any country apart from congo mongo where such laws exists.... political elite showing their true colors...

tumaharay pir murshid ne to CJ ki band aor SC ki eent se eent bajha di thi. Perhaps you liked that ganwar tariqa. CJ being partial in decisions, this was the only decent solution under the constitution. PML(N) ki tara band nahin bajhaiee.

I have said many time earlier
Raja is from Pindi and Malik Riaz have 12 on his official payroll .
They are not from South Punjab or rest of Pakistan .
And PPP can not attack on Sc because they are not from Lahore .
They opted the legal way .
Not good but was there any other option left
After that all which has been done with Gailani and Makhdoom Shahabuddin .

PPP continues its tradition of destroying Pakistan, a tradition started by Bhutto.

However, friends, all is not lost. This act will be challenged in the supreme court and the court will inshAllah kick down this stupid amendment.

They legalized an illegal act , but using right means . . . next government can change this law if they'll want to . Electing thieves and expecting good from them is just being dumb .

Parliament is the supreme law-making body and it has full rights for making and amending laws. Agreed. But can it make it a law that no general elections should take place in the country in the next 50 years? Can it also make a law that a person could be declared prime minister of the country posthumously? Why cannot it declare London as the capital of the country? If the Parliament is the unchallenged authority that can make a law, interpret it by itself and implement it without any review from any other authority, why it cannot prolong its tenure by 50 years?

Why the parliament cannot abolish the supreme court, turn the high courts and provincial supreme courts, albeit without any jurisdiction over provincial and federal government machinery and functions? If it is against the spirit of the constitution, isn't it also against the spirit of the contitution that you dish out licences to a selective few to humiliate the judicarry at their will?

Remember, corruption is the right of PPP members under konstitooshun. They have successfully resolved all issues facing Pakistan and contempt of court law was the only thing remaining.

This **Expunged Material **clause means that no matter how brazenly you humilitate the judiciary, if your remarks are expunged by the speaker, it cannot be presented in a court as an evidence of contempt of court.

So you have full liberty to demean the judiciary inside assemblies, all you need to do is to get it expunged by the speaker before leaving the House. :smokin2:
