my company will soon be filing for a Green Card for me (marriage based). one of the documents they requested was my birth certificate. now the problem is that the year on my birth certificate from pakistan is off by 1 yr then what is on my passport and all my school records from pak.
for now i have provided the law firm my school records [with my DOB] and my national id card for overseas pakistanis [the DOB on them matches the DOB on my passport]. they haven’t come back with if it would suffice or not.
anybody who has been through this process know how important it is to have a birth certificate from pak ?? also, i wonder hoi am a bit hesitant in bringing this up with the law firm but i think i should explain the situation…

A quick question. I am confused. So the national ID card has the same DOB as your school record etc. and it is off by 1 year in Birth certificate that you have?
If that so, the only thing I can think of is that in Pakistan you can get a Notarized Stamped Birth Cirtificate which mentions "NO ENTRY NO RECORD" ... That's what I had because we had "bay" form and not actual birth certificate and it was issued on the basis of "bay" form. I am not sure if the procedure is still same.
Assuming that DOB on ID card is what you are using everywhere, you should be able to get a FIR copy of lost birth certificate and get one generated on the basis of your NICOP or POC.
May be someone with more knowledge can come and give us more info on the matter.

I would go with whats above and to add dont withhold any information whatsoever from the law firm.

yes that is correct. i haven't looked at the birth certificate myself but my parents who have it told me the DOB on it. don't ask how it happened or why it happened !!!! :--)
thx for the suggestion. my birth certificate was from lahore (thats where i was born) but we have been living in isl for a while so i hope it will be possible to get a copy generated from pindi/isl.
what concerns me is whether the US immigration has the actual records of our DOB or atleast access to them or how much they look into this.
this seems like a small blunder from our side but....................

heart beat...
it was back in 95 when I was going through my documentation, and all I had was my N.ID and "Bay" Form. Nothing else. And I got my NO ENTRY NO RECORD certificate. I doubt if they would have your record but letting your law firm know the whole situation might help.

You'll probably have to go with AQ's suggested route and get a "No Entry No Record" certificate in lieu of birth certificate. Check from your lawyers, though.

hmm.. might be worth a shot trying to get a birth certificate made out and attested.. but yeah, definitely just talk to your lawyers. they're there to help you out of these things, no need to sharmaa-ify in front of them.

I would have thought having school record birth dates not match birth certificate dates would be more widespread. or do they now change the year of birth in the birth certificate itself?

With no entry no record form you need affidavits from family members about your date of birth to substantiate no entry no record. Discuss this with your law firm too. I had to do that. Since both of my parents are deceased I got affidavits from two of my elder brothers for my birth date.
Why can't you get a corrected birth certificate ? If you can get no entry no record form , you can get your birth certificate corrected too with the help of you NID and other documents.

well in my case, the DOB on my birth certificate is correct but my parents (for reasons best known to them) had put me down a yr younger when i was admitted to school. i knew i was a yr older then whats on the record but i didn't know that my birth certificate had the correct DOB. i wonder if this is a common practice.....

its a trend there.
my parents didn't do this with me...but i had this argument with them that why just a year...why not 6-7 yrz?

it basically means the company is going to pay for all the expenses and the immigration law firm representing the company will do all the paper work, filing for me etc…i could have filed it myself but then i would had to pay the expenses out of my pocket also. :—P and i would rather have the law firm do all the paper work.
this normally depends on the company policy. not all companies do that.

You can always tell that you dont have and instead submit an affidavit. I think, this is what I did
After reading Mirch's post, I confirm that you need an affidavit to go along. In my case, I have my father's affidative on a stamp paper.
Just affadavit is not enough , you have to submit a certificate of no record from you , city , gown , pind , goth, tahseel, chuk whatever.
I had to submit certificate of no record from city of Lahore and affdavits of relatives.

:D well, when i talked to my ami about this she told me that my abu wanted me to put me down as 2 yrs younger but my ami said thats tooo much so they put down 1 yr younger.... :------)
i really don't blame them since i think they were trying to do what they think would be better for me..and probably it was or is still a trend in pak.
