Asfandyar warns against SC-govt tug-of-war

CJ should stay out of governance of the country, and the economic policies. The govt has right to impose taxes or cut it whenever or wherever its sees necessary to generate revenue, and courts should not be allowed to meddle in matters of executive and parliamentary affairs. This guy is asking for trouble again…which we can’t afford at this time.

Wants Fata to be integrated with NWFP

By Tauseef-ur-Rahman

PESHAWAR: Recalling the tussle between the then prime minister Nawaz Sharif and former Supreme Court chief justice Sajjad Ali Shah, Awami National Party (ANP) President Asfandyar Wali Khan said here on Thursday that the present government and judiciary should avoid repeating the mistake as the country would ultimately suffer in such a case.

He reminded that powers of every organ of the state had clearly been mentioned in the Constitution and each one should work within its ambit because Pakistan could not afford any inter-institution wrangling.

“Misunderstanding or conflict among state institutions must be avoided as it will not augur well for the stability of the country,” he said, while briefing media persons after a meeting of party’s Central Working Committee (CWC) held at Chief Minister’s House in Peshawar.

He said that the CWC meeting unanimously endorsed the party policies vis-i-vis its stance on extremism and terrorism. He said the society could not progress in the presence of extremist forces.

He said that the militants were not interested in Islam and they had their own agenda and the ANP had decided to face any challenge that came in its fight against terrorism. He appealed to people of other provinces to support the NWFP government in its fight against terrorism.

Asfandyar said that his party had asked the provincial government that fool-proof arrangement should be made for the rehabilitation of internally displaced persons (IDPs) of Malakand division as well as for its reconstruction.

He said that the meeting also asked the provincial government to make an effective administrative system for the Malakand division. He said that CWC also urged upon the federal government to establish its writ in tribal areas as the situation there was affecting the province.

Asfandyar Wali said that the party had also urged upon federal government to integrate the Federally Administered Tribal Areas (Fata) with the province and if not, then at least they should be given representation in provincial assembly. He said that 17th Amendment must be repealed, but he hastened to add that only repealing the 17th Amendment was not solution to the problem.

“Will the problem of Balochistan be solved by repealing the 17th Amendment?” he posed a question. Asfandyar said giving financial autonomy to the provinces was the only solution to remove the sense of deprivation among the small provinces.

Talking about the division of Punjab into two provinces, Asfandyar said 10 years back the ANP had separated the party organisation in the Punjab and the Seraiki belt was given proper representation in the CWC of the party. He said the ANP considered the Seraiki area as a separate province.

To a question, Asfandyar said ANP was against the US drone attacks and had strongly condemned it at every forum. “We have been arguing that such attacks are counter-productive,” he said.

Re: Asfandyar warns against SC-govt tug-of-war

so what do you suggest public do when govt itself breaks laws? Where should public go for justice? USA? Saudi Arabia?

The voting booth.

The voting booth will open 4-5 years later, and that is for wrong-handling of situations, but for ‘illegal’ activities SC is there :k:

Re: Asfandyar warns against SC-govt tug-of-war

^^^Tell me what exactly the CJ knows about the economy? Also, the fact is people in Pakistan don't pay tx, but they want everything free. Where do you think the money will come from? I think govt should move to cut the courts power, and more importantly take away suo moto power of the CJ. The Parliament can do that.

BTW, suo moto is more based on precedent than the law. * *

Are you really reading what you are posting? There will be people who break law, it is government's responsibility to enforce law, if govt starts breaking the law then why would people care?

Its government's responsbility to collect taxes, people will try to avoid paying taxes (that happens all around the world). Government needs to improve its revenue collection on its current taxed items towards 70-80% before punishing people with more taxes.

I didn’t talk about chopping his head off and hang in front of supreme court… :chai: ..

CJ now get a new concept of Social Justice - which is not even implemented in any of so called western developed democracies except Scandinavian countries let alone third world, but i think most of the people have no idea that this is also written in Constitution that Pakistan will be a socialist state - so yeh .. get your priorities corrected !

their are few ways to take care:

  1. Emergency Order by President on the advise of PM - take back the powers of CJ

  2. A bill in Parliament, curb the SC powers - any one have any problem talk in the parliament.

  3. Last but not least a bullet - as Asfandyar said SC-Govt tug is not feasible in today’s security situation - war against terrorism (petro-tax is for funding war) is more important for me - if we didn’t win then say good bye to Pakistan and then talk about so called justice.

  4. Their are some real cases why CJ have no balls to touch them for ex. Missing Person, NRO, Musharraf, Swat girl flogging case, Baluchistan and else.

Musharraf wasn’t a politician, so lets be fair here: Politicans should be as respected as any of so-called judge !

:rotfl:

Budget was strangled because of War on terror in NWFP & Southern Punjab its common information, Petro-Tax was introduced for budget support - i don’t know which part you didn’t get it.

More then 250billion rupees subsidy is given by gov every year this also have to be withdrawn - and also cut some SC & lawyers bars fund too .. .. !

Whats the difference, you kill by bullet because you can afford it they kill by chopping head… either way, you are advocating violence, should we kill all our political oponents… tell me you are not mureed of that kala peer of karachi…

[/quote]

I agree politicians should be respected, but no one can force people to respect anyone, CJ got his respect by giving the people their part of respect.. politician on the other hand think themselves as GOD, hence consider a common man as slave or a person born to serve them ( don’t believe me, see the PM he is makhdoom, means he have to served). no body in right mind will respect them

Either it is east of west, the politicians are respected on the basis of the development and projects they have executed, Bush is an example of western politician who has been hated the most, if the politician of Pakistan will start paying their respect to the common man ( even if they just consider them human will do) the Pakistanies will move 10 steps ahead and will respect the politician, otherwise, it is recommended that only you respect the politicians like Zardari and kala peer…

What CJ did was right, if govt have problem they can argue in the court…

but shooting someone is same like cutting their throat, if you cannot take something against your comment then again you are kinf taliban…

Are you also obsessed with Cartoon? Damn, his following of haters is on the rise .. anyway it’s your and his matter.

I don’t know who the heck is Zardari , its the seat of President which i respect not a face like you are doing.

Did President ordinance on the advise of PM is unconstitutional ?

??? :konfused:

Re: Asfandyar warns against SC-govt tug-of-war

it is something the lawmakers have to discuss, i guess the president cannot impose taxes through an ordinance... now it is up to you that whom you would like to recommend to get shot...

so you are guessing - well then let me give you info - with Presidential ordinance you can do it !

and you can't even challenge it, court has no authority over it - now imagine the possibilities CJ grow some balls and give a verdict on NRO but it will be over ruled in 1 minute - welcome to the politics !

Re: Asfandyar warns against SC-govt tug-of-war

lets wait and see

Pakistan is getting reimbursed for the war on terror, budget shortfall is nothing new... someone needs money to feed lots of hay to the big crowd of ministers.

yeh elected by the people of Pakistan..after all the most fairest election in the history of Pak.. so learn to respect the mandate - wait for the election !

Re: Asfandyar warns against SC-govt tug-of-war

^ fairest elections, maybe in your wild dreams. Petro tax for war against terrorism LOL! Posts like these have made this forum a joke and less appealing, seriously.

It doesn't matter how these "elected people" came onto the scene, what matters is if govt of Pakistan doesn't do something defined by legal boundaries then someone needs to challenge it right there.... who do you think should challenge? Hint: Army is not the answer I am looking for.

Yes, just like how you were respecting mandates in 1999 right? SC doesnt contest election, its very existing is checks and balances and it will keep the Govt on its toes and be very afraid, the NRO issue might pop up and bhai’s top lieutenant commandoes along with the mighty Zardari might be on the list next.

The talk of SC and the NRO must be wetting alot of pants/shalwarz and pajamaz these days  Musharraf’s puppet chief justice doggar lost his pants when he heard about it:

Re: Asfandyar warns against SC-govt tug-of-war

here's a suggestion:

How about asking the ministers to lay off the Prados and Land Cruisers and drive a 4 cylinder car for official affairs, limit the supply of fuel. Do internal audits to ensure all are abiding by the rules. Those who aren't should cough up the charges..etc..etc..

Why does the public have go through the crunch everytime the Govt runs out of money, which IT chose to mismanage? :)
