WANA: Orders issued by South Waziristan’s political agent regarding arresting members of the Mehsud tribe from across Pakistan have been challenged in the Peshawar High Court, official sources told DawnNews. The political agent had asked the authorities to arrest people from the Mehsud tribe and confiscate their property anywhere in the country.
A resident of the agency challenged the political agent’s orders saying that arresting Mehsuds outside the South Waziristan agency does not come in the political agent’s jurisdiction.
The petitioner also said that arresting anyone from the Mehsud tribe from any place in Pakistan without a reason is not justified.
The Peshawar High Court has now asked the government to produce a record of prisoners belonging to the Mehsud tribe arrested under the said orders and put in different jails.
The political agent’s orders also say that Mehsud elders have failed to stop terrorist activities against the government and are unfriendly towards the state therefore the arrest orders had been issued.
The political agent had also ordered the confiscation of moveable and immoveable property of people from the Mehsud tribe and said they should be taken into custody wherever they are found.
The political agent’s orders have also been circulated among the District Police Officers of various districts and the Additional Chief Secretary Fata and Secretary NWFP Home department, among others.

This is just barbaric, idiotic, and $tupid decision by PA.

However! Sadly! the current system of FCR gives him powers to do so.

It is time that we end this draconian 100s of years old FCR system and give the same rights to the tribals that other citizens in Pak have.

It is time to Make Wazirastan (North and south) and the rest of the FATA as a separate province with proper assembly, court system, police, and elected Chief minister.

Let's kick the PA and the FCR out.

However it cannot happen, until the tribals themselves quit being tribal and become civilized and ask for the change. No one can "impose" change on the FATA people. It has to come from within.

A question... Why do tribal HAVE to stop being tribal?

You can make a case for people stop being extremists, but there are so many things in a tribal system which are killed by today's capitalistic cities.

I thought so too. But if you do some research, Zardari made the statement before it was fully realized.

In reality the FATA leadership brought in few token changes like access to courts, but overall the draconian FCR is still “alive and well”.

The reason is that ANP and many big wig Pashtuns from FATA DO NOT want the FCR to end. Because Rs. millions/billions of the Federal funds are going in their pockets. If they don’t get those funds, then they threaten to join the Taliban.

And hence no SIGNIFICANT change in the abomination called FCR.

That’s why this ABSOLUTELY important that the tribals themselves start the necessary “CHANGE”.

The change cannot be imposed by the feds.

According to a news item, four of the dead attackers of GHQ included Zakirullah Mehsud, Sanaullah Mehsud, Abdur Rehman Mehsud and Abdullah Mehsud of South Waziristan's Mehsood tribe, I think is the reason for crackdown on mehsoods.

Just like kids have to quit wearing diapers after certain age,
human societies have to evolve.

Not to dwell on the theoretic side of social evolution, human societies pretty much evolve along the following lines.

  1. Tree dwelling primitives
  2. caveman
  3. Primitive family
  4. small tribes
  5. Large tribes
  6. Large tribes with Big Man the in-charge
  7. City states
  8. Nation states.

Tribals these days are pretty much stuck at #3, #4 and at most #5.

As a result they do not have modern organization like police, multi-level court system, bureaucracy, multi-level executive, and army etc.

And because they lack the modern systems, they get raped by every Tom, Dick, Harry, Abdullah, Saudi, and Libbi.

Nation states are not problem free, but they can at least make decisions to protect their citizens from

  1. Internal threats by using their police/army and multi level executive and court system
  2. external threats by aligning with the right kind of power blocks.

So for Pakistani tribes, it is time to live without diapers and grow up to become civilized and modern.

Otherwise they will make their areas like another Afghanistan, Somalia, Liberia, etc. etc. where people will live like animals being chased by one power or the other. Sadly!

I have put in bold two of your sentences.

What option do tribals have to become modern - 7 and 8 are nt applealing.

A classic example of 7 is Karachi - it has seen some of the worst violence in Pakistan even though it has the most educated people. If our most educated, most-literate, most-civilised people behave in this way (not everyone in Karachi is like that of course but then again not every tribal is like that) then what hope do have on the "less" civilised?

Pakistan is a nation state - its pretty much no8 overall on your ranking as a country yet what sort of leaders does it produce - Zia ulHaq, Benazir, ZAB, Nawaz Sharif, Musharaf, AlTaf Hussain, Maulana Fazul rehman, Zardari - as a nation state our leaders have not improved at all in the last 50 years. How can you expect tribals to be civilised when our leaders are the worst ofthe kind? Had they been power hungry dictators like Ahmedinijand (sic) Gaddafi, Saddam Hussain I would have some admiration for them as they at least STAND up to other interfering countries.

Why constantly attack tribal culture when the other options available to them are not any better?

This summer I had the opportunity to visit a refugee camp for internally displaced people (sad when people live in refugee camps in their OWN **country) and i felt truly ashamed of what I saw. Millions of people displaced because of lousy decisions made by the **civilised, educated leaders in Pakistan and in western countries. When the country which is supposed to protect them does little for them, what can they do?

I felt ashamed of myself because I passed judgement on them just because i read some biased article and watched some biased TV programmes. i had a pretty much easy life but others have not. Its truly upsetting when you hear of illegal Pakistani immigrants being caught in the UK and deported knowing full well that they may have spent so much money trying to get here and then it could all come to nothing.

It was strange watching all those innocent families living this fearful existence being shoved around by one then another. They were told by these **educated, civilised **people that being a Mujahid is cool, being a jihadi is wat life is about - for 20 plus years they were pumped with an ideology which changed and destroyed the social fabric of their society yet they were told it was right. Those that spoke against it were labelled **TRAITORS. **These tribals were more islamic before their systematic brainwashing.Then suddenly educated, civilised, democratic Bush decides change and they were expected to do so but one problem - they forgot to sprinkle stardust on the people.

People assume the tribal culture is Pakistan's biggest problem. Are Nawaz Sharif, Fazul Rehman, Bhutto, Musharaf, Zia ul haq, Altaf Hussain tribals?

The tribals are not our subjects and we just cant use that colonial attitude with them which your post has a strong scent of. One of the great things about people from the tribal belt is that they have a great sense of dignity and respect even throughout poverty as a whole and view themselves as equals to others regardless of wealth, status, power.

There has to be changes in the tribal set up but until we dont have changes in the rest of the country any changes there will be pointless. I dont see how a democracy is any different to the current tribal jirga system? Why dont they incorporate its positive aspects?

Its about time we as a nation stopped the tribal being used to fulfill the needs of power hungry people in Pakistan and Internationally. Pakistan has done little to treat them with dignity overall - it has failed all its poor people in fact, not just tribals but people from all regions and provinces. its sad but the tribals have been screwed by the Mullahs, the democrats, the generals, the right wing, the left wing, the nationalists, muslims and non-muslims.

Where did we as a nation go wrong?

I hope they don't become civilized like the Indic people(whom you are a member of), who are so civilized that they submitted to every Tom, Dick and Harry in their entire know history and they are proud of it. No other group of people in the world can match the kind of civilization that they practicing.

Well that is a really good question.

Where did we as a nation go wrong?

Unfortunately we forgot or ignored the basic necessities for making a nation. Or more precisely we went after the wrong priorities.

We thought religion will guarantee our cohesion. But it didn't because it cannot.

Cohesion comes from strapping and binding the nation with good infrastructure, with prosperity, with hope, and above all with justice.

For the tribals, we let them form a state within a state for the last 60 odd years. No decent country in the world allows arms militias, smuggling bazars, and ungoverned territory, unless you are talking about Basket case, cesspool African and some Asian societies.

Even now it is time to help tribals become civilized quickly, because if we don't, then they will suffer just like tribal Afghanis are suffering just across the border.

And how can we help them become civilized? By encouraging them to establish police, bureaucracy, multi-level courts, and multi-level executive branches.

Instead of lining the pockets of big Khans in FATA, we must build motorways all the way to the border.

Instead of lining the pockets of political agents, we must help the poor masses in FATA get access to clean water, jobs, and education.

It is time to end the draconian tribal system, the abomination called FCR. They need courts, and civil institutions. Time to kick out the pathetic jaghra jarga system.

I beg to disagree. Karachi is not a #7 i.e. city state as it doesn't maintain its own army.

In fact Karachi is a part of #8 i.e. a nation state or sovereign state called Pakistan. You remember? that when the violence in Karachi exceeded a threshold, the nation state had a will to send in troops and bring down the violence to a tolerable level.

Current army ops in tribal areas or semi-tribal areas are also the result of Pakistan being a nation state. Even though many of our pathetic and confused intellectuals do not care to strengthen our nation state.

Tribals must become civilized like ________________. and pick your favorite country. But for Allah's sake do not wish them to be like Afghanis, Yemenis, Somalis, Liberians-barbarians, and other basket countries in the world.

Why do we need to impose another culture on Afghan culture? If a culture is pervasive today, it doesn't necessarily mean its good.

I am sorry, but the violence you see now is a result of IMPOSING talibanic culture on a liberal tribal Afghanistan by Pakistan and USA.

Has USA ever tried to impose a culture on Amish people?

Have you ever visited an Amish area/village/town ?

Amish people are the most peaceful, law abiding citizens. They abhor violence. No guns, or rocket launchers will ever be found in an Amish property unless the US government allows them to do so.

While we justify Talibanic and FATA tribalism with Amish examples in America, we must also remember the infamous tribe of David Koresh from Waco texas.

FYI that tribe came close to the Mahsud tribe in one way. They too started accumulating guns and weapons in their compound/village.

Do you know what happened to the tribe of David Koresh?

The US government ordered them to cleanup their act. The tribals responded by firing and the police.

Guess what happened next? The US government burned their compound to the ground with women, children, men, everyone alive.

That's how a strong, sovereign, nation state protects it from the internal enemies. They burn them alive.

One wishes that Mahsoods etc. were like Amish. then there would be no problem.

However the FATA has become a much larger version of David Koresh. And some government either Pakistan or some other will come and burn it down unless we Pakistanis work with our tribal brothers and sisters and gently get them out of their weaponized, terroristic state.

No one "imposed" anything on them. Smuggling and weapons bazars, kidnapping and ransom was part of the "golden traditions" of tribal area looooooog before Commie attack on Afghanis.

So let's not use that excuse.

We the Pakistanis slept while tribals became worse and worse in their bad habits. Had they been civilized, Qaida would not have been fully entrenched in that area.

It is time to cleanup the mess and change the Jaangli tribal culture so that people living in FATA would no longer be vulnerable and inclined towards large scale terrorism.

BTW the same thing is true with other semi-tribal areas of Punjab, Sindh and Balochistan.

I would say the same to you, Forget about this tribal shribal thing.

I hope you get over this inferiority complex of yours but i think it is not your fault, it is the fault of your ancestors who passed this to you from generation to generation. If i were you I would go to their graves or their crematorium and ask them that why they acted so CIVILIZED and did not resisted any invader who treated them like dirt. And because of that treatment you feel so inferior and jealous of the freedom loving tribals. But sorry my friend you have equated slavery with civilization, no hope that you will ever recover.
