Khumar is right, you will most probably get a replacement, and that too after a few weeks. So spare yourself the trouble, guys at apple are not stupid, 
I still say, ebay option is the better one. You can always ask a friend to outbid the highest bidder if the price is too low.

You guys quit going off-topic. I’m not done with my iPod drama yet. 
I called Apple last night (after being on wait listening to the strangest music) and I told the guy it was freezing often. He asked how often, and I lied and said like every week. He told me how to restart it, and he said if I had further problems, then I should call back and let them know. I’m not gonna bother restarting it, but tonight I’m calling Apple back up and telling them that I’m still having the same problem.
And then, if all goes as planned, they will offer to exchange it for a new one or maybe even give me a refund.
1 step closer to getting that 4gb video ipod. hahahah i’m such a freaking genius.

Okay, so I called Apple again today. This time the guy I was talking to was Indian. His name was Prakash, and he was South Indian (I could tell this by his accent :D).
So, anyways...I told him my iPod was still freezing, even after I restored it. He said they can do a service, meaning they will send an empty box to my house within the next few days, I will put my iPod in the box, and then send it off to the Apple company for them to fix, and then send back to me. I asked him what about if my iPod is STILL screwed up. He said that then they will exchange a new one for it. :D sweeeet! haha
So then I bugged him some more to ask if I could get a refund, and he was like no, I'm sorry. And then I asked him well how are you gonna fix the iPod? There's no screws on it! How will you open it? He said they have special tools and procedures. Well, anyways then he asked me where I was from, and I said my parents are from Pakistan, and he said oh really?! and I said yah and I'm guessing you're Souf Innian? And he said YEA HOW DID YOU KNOW?! :O And I said oh because of your accent you dummy.
Anyways, well I was just thinking....is it really worth all the trouble? Sending the iPod in, getting it serviced, getting it back, then calling them again and telling them it's still not working properly, then sending it again, and THEN finally receiving the new one...then selling that on ebay for $130, then using that money to get the new one. is it really worth it?
