THE Punjab government has launched a probe into the alleged gang rape and murder of a young girl at Arifwala Tehsil Headquarter Hospital (THQ) and directed medical superintendents of district and tehsil hospitals to appear before the Punjab Surgeon Medico-legal with case record.

The subject of the letter written by the surgeon medico-legal (1888-94/SML, April 18, 2009) is investigation of case no 173/09 U/S 302/376/109 PPC against Malik Usman and Ghulam Hussain. The letter said that “Reference Government of Punjab, Health Department letter No S.O (H&D) 1-34/2009 (Pakpattan) dated April 17 vide which the undersigned (the surgeon medical-legal) has been appointed to conduct an inquiry into the matter citied above”. It said Usman Zafar etc committed gang rape with Kiran Bibi (aged 15/16 years) and she was taken to Arifwala THQ Hospital for medical examination where she later expired.

The letter said that a procession was staged demanding immediate arrest of Dr Sagheer Ahmed, the medical superintendent of Arifwala THQ Hospital, for patronising culprits. It was also alleged that the girl was killed with a poisonous injection, the letter said.

The surgeon medico-legal directed Dr Abdul Shakoor, the MS of the Pakpattan District Headquarter Hospital, Dr Sagheer Ahmad, the MS of the Arifwala THQ Hospital, Dr Saima Saba, WMO of the Arifwala THQ Hospital, and Dr Fouzia Tariq, the WMO of the Arifwala THQ hospital, to appear in the office of the surgeon medico-legal on April 27 along with a written reply, witnesses and all original record of the case.

According to the victim’s family, 13-year-old Kiran Amjed was kidnapped by Malik Usman, son of Malik Zafar, and two unidentified people from outside the Government Girls High School Arifwala on March 31. Kiran, a student of Class 8th had gone to the school to get her class 7 result.

Muhammad Amjed, father of the victim, said Malik Usman and two of his friends took Kiran some place where they gang raped her and she returned home at about 4pm. He said Kiran was very depressed and scared when she returned home and did not tell anyone about the gang rape. He said later Kiran narrated her ordeal to the family and he along with his brother took Kiran to local magistrate where she recorded her statement and they then went to Arifwala Tehsil Headquarter Hospital for her medical examination and treatment.

He said Kiran was admitted to hospital where one Ghulam Hussain, son of Muhammad Tufail, met the family and told them that he was an employee of the hospital and that he will take care of Kiran. He said Ghulam Hussain was not an employee of the hospital but was in fact a close friend of Malik Usman - something they learnt later.

Amjed, a blind man, stated that Ghulam Hussain asked the family to go home because no family member was allowed to stay in female ward of the hospital. He said he and his family members came home and next morning came to know that Kiran had expired in the hospital.

He said he learnt from hospital staffers that at night Kiran went to wash room and Ghulam Hussain followed her. He said on her return she started vomiting and died.

Muhammad Hanif, uncle of Kiran, said Ghulam Hussain injected Kiran with poison on the instruction of Usman. He alleged that local MNA Rana Zahid Hussain was also involved in the case because he was a close friend of Usman.

He also alleged that the medical superintendent of the hospital and other staffers of the hospital were also involved in Kiran’s murder. The family claimed that local police left several lacunas in the FIR because the accused were from an influential family of Arifwala and close aides of MNA Rana Zahid. They said police and the accused were trying to change the gang rape and murder case into an abortion case.

The family had also filed two writ petitions in the Lahore High Court seeking directions for police to arrest the nominated accused and to take action against the doctors and other medical staff of Arifwala Tehsil Headquarter Hospital.

In the petitions, he said that police did all this unlawful act at the behest of local MPA and MNA and were protecting the culprits to please local political figures. He said despite the nomination of the accused(s) in the FIR, the police was reluctant to arrest them. He said police had not recorded his correct version about the incident to safeguard the accused.

In another petition, Hanif said THQ MS Dr Saghir Ahmad and other employees of the hospital mishandled the case of Kiran and showed violence of criminal nature against the victim which resulted in her death.

He said the post mortem and medico legal reports were manipulated to favour the accused(s) under the influence of the local MPA and MNA. He prayed to the court to direct the Pakpattan DPO to register a criminal case against hospital authorities and to shift the investigation of the case out of Pakpattan district. Local MPA Dr Farrukh Javed told The News that police were trying to hush up the case because of the strong political background of the accused.

He said a major lacuna left in the FIR was that police wrote that the family suspected that Ghulam Rasool poisoned Kiran in the hospital whereas it should be read that Ghulam Rasool had poisoned Kiran. He said the word ‘suspicion’ will help the accused in the court of law.

Dr Farrukh said he has also taken up the case in the Chief Minister’s Complaint Cell so that culprits do not get away.

He said he has also given financial and legal assistance to the victim’s family because after the event majority of female students in Arifwala were feeling insecure. “I want girls to go to schools and colleges with full confidence and this will only happen if the accused get an exemplary punishment,” he said.

When asked whether Kiran was gang raped or died due to a mistreated abortion, Dr Javed said that she was just 13 years old and could not have relations with anyone with her own will. He said she was exploited due to any reason and died of septic shock and in his personal opinion that amounted to rape. He said Septic Shock was a serious medical condition caused by decreased tissue perfusion and oxygen delivery as a result of infection and sepsis, though the microbe may be systemic or localized to a particular site. It can cause multiple organ dysfunction syndrome (formerly known as multiple organ failure) and death, he said adding its most common victims were children and the elderly, as their immune systems could not deal with the infection as effectively as those of healthy adults.

On the other hand, Dr Sagheer, the MS of the Arifwala THQ Hospital, claimed that some individuals were politicising the issue because they did not get PML-N tickets in the previous elections. He said Kiran had relations with Usman and died due to a mistreated abortion. He also claimed that no poisonous injection was given to her in the hospital.

Asked as to why he and MNA Raza Zahid held a long meeting before Kiran’s body was handed over to her family, he said he was a good friend of Rana Zahid who came to the hospital to help the poor family. He said Rana Zahid’s rivals were politicising the issue and they were also against him (Dr Sagheer) because of his strong connections with the MNA.

When contacted, then Arifwala City Police Station SHO Nasir Ghumman said he did not leave any lacuna in the FIR. He said the FIR was written according to the statement of the complainant and was red loudly before the notables and victim’s family and they agreed over its contents. Asked that the complainant was an illiterate and uneducated person but on the FIR his signatures were in English, the SHO said that he was an educated person but now was lying to others about the signatures.

The News also tried to contact MNA Rana Zahid on his cell phone but he did not pick up the phone. The scribe also sent an SMS to the MNA but he did not reply.

Anjum Aqeel Khan stands accused of ugly rowdiness after failing to have his way at a college in the capital. Despite his claims that he was only trying to help one of his constituents seeking admission to the college, his deeds have once again raised the issue of action against errant lawmakers.** 

The PML-N occupies the moral high ground in national politics to such an extent that people expect it to act swiftly in such cases. In a couple of cases, it has indeed done just that. A few months ago, it forced its legislator from Rawalpindi to resign his National Assembly seat after his involvement in an exam scandal. More recently, it made one of its Punjab legislators relinquish her post for using a stolen credit card. However, some other incidents have gone unpunished. A Punjab minister got away with two brawls in full public view. A provincial legislator accused of raping a woman in Lahore was not even arrested before he struck an out-of-court deal with his accusers many days after the incident.
Instead of trying to punish or absolve all its erring cadres on its own, the party should have allowed the law to take its course in each case. By turning over the erring legislators to the police and the courts it would have easily avoided the charge of being choosy, and by being neutral would have helped restore the much-needed trust in the judicial system. After all, a functional legal system does not involve political parties taking up police and judicial responsibilities. ISLAMABAD, Sept 5: The PML-N parliamentarian accused of attacking a college and manhandling one of its professors is trying to settle the issue out of court, sources in the police and the college told Dawn on Saturday.

They said the aids of Anjum Aqeel, MNA, had contacted Prof Laiq Ali Khan of F-10/4 College for an out of court and police settlement.

The sources said the MNA had, in his personal capacity, approached the professor and tendered apology.

However, the chief proctor of the college, Gul Mohammad Khan Swati said the MNA’s aids had approached the college professors seeking settlement of the issue.

He said the MNA and his accomplices had violated the sanctity of the teacher and the college. “Apology would not work now and the law will take its course,” he maintained.

He said the MNA had recommended a student with 373 marks for admission which was below the merit. However, the college administration decided to accommodate him under the sports quota.

After this, the student came back with a fake certificate on the letterhead of the football association which declared him a sportsman of cricket, he added.

When the fraud was pointed out, the MNA became angry, the professor said.

Meanwhile, the police approached its prosecution branch seeking legal advice regarding the case registered against the MNA.

The police said its legal branch has to approach the secretary National Assembly and discuss the matter with him. The matter will be brought to the notice of the speaker NA if the police succeeded to convince the secretary for taking legal action against the parliamentarian, they added.

A parliamentarian is equal to a grade-22 officer and it is breach of privilege if the police directly approached him/her.

Strike called off: The FG College Teachers Association in a press statement on Saturday night said on the request of the director general education they had decided to call off the strike for three days on the condition that immediate action should be initiated against the accused MNA and his accomplices.

It demanded that the PML-N should also take disciplinary action against the MNA and that political interference should be checked in educational institutions.

LAHORE: Pakistan Muslim League-Nawaz leader Zaeem Qadri “abused” reporters during a press conference in Lahore, a private TV channel reported on Wednesday.

According to the channel, journalists had gathered to cover a press conference by Qadri and Punjab Prisons Minister Chaudhry Abdul Ghafoor. During the question-answer session, Qadri was caught on tape using an expletive while referring to journalists as he whispered in Ghafoor’s ear, the channel added. Ghafoor nodded in affirmation to the comment, it added.

Journalists have protested against the PML-N leaders’ attitude. The Punjab Union of Journalists has announced to boycott the party’s coverage until the leaders apologise.

Sessions judge summons PML-N MPA from Layyah
LAYYAH: The Layyah district’s sessions judge has summoned PML-N MPA Mahar Ejaz on September 14 in a case involving the MPA allegedly threatening a woman over telephone. The judge, Muhammad Rasheed Qamar, gave the directives after Darul Aman Superintendent Afia Bilal alleged that Mahar called her and pressurised her to delegate the Darul Aman’s naib qasid, Muhamamd Abbas, to his personal staff. She also accused the MPA of threatening her with dire consequence if she failed to comply with Mahar’s demand. Afia said Mahar had been interfering in the affairs of the Darul Aman previously as well. She requested the court to initiate criminal proceedings against the MPA. Ghafoor roughs up jail staff

LAHORE - Punjab Minister for Prisons, Ch. Abdul Ghafoor, in yet another, incident became rash on the staff of Camp Jail only to satisfy family members of two drug traffickers jailed in a case under Section 9-C CNSA (20 Kg charas) and in another case of 9-C PS ANF (35 Kg charas).

The Minister used filthy language against the jail staff and shouted on them, a document available with TheNation revealed on Friday.

The Minister had visited the jail on the complaint of mother and sister of two under trial notorious drug dealers on September 5, where he roughed up jail staff allegedly for taking bribe from relatives of prisoners.

The jail sources confirmed that Arslan and Usman, two under trial prisoners are detained there for the last over four years, and their family members had approached the Minister levelling allegations of bribery against jail staff.

According to jail sources, family members of the prisoners had complained to the Minister that Rana Latif Assistant Superintendent Jail and Sohail Ashraf, Court Munshi were involved in receiving bribes and torturing the prisoners severely.

The Minister allegedly rushed to the jail and burst on the junior jail staff after suspending Rana Latif, Assistant Superintendent and Munshi Suhail. He also became rash with Munshi and tried to beat the Munshi physically by snatching stick from the Superintendent jail, but he saved his skin by slipping away from the office, a jail official seeking anonymity said. The IG Prisons conducted an inquiry into the matter, but jail officials were found innocent and allegations could not be proved against them.
Consequently, IG Prisons restored the suspended officials but they were transferred again on the instructions of an official of Chief Minister Secretariat due to reasons, best known to him. The jail officials, maintained that alleged drug traffickers had been punished 21 times in the jail for breaching jail discipline and a case of carrying narcotics in the jail had also been registered against them with the local police station, documents of which are available with this scribe.

LAHORE: The Lahore Press Club administration on Tuesday filed an application at the Qila Gujjar Singh Police Station against PML-N MPA Allah Rakha for forcibly entering the club and hurling threats and abuses at a woman who was holding a press conference against him.

Shaheen Kunwal was holding a press conference against PML-N MPAs Naveed Anjum and Allah Rakha, alleging they had illegally occupied her land. She said both the MPAs were property dealers and business partners.

MPA Allah Rakha rushed to the LPC and misbehaved with Ms Shaheen and hurled threats at her. Meanwhile, Lahore Press Club President Sarmad Bashir issued a statement to the media in which he said that the PML-N MPA had desecrated the sanctity of the LPC and had hurled abuses and threats at the woman.

When contacted, MPA Haji Allah Rakha denied the allegations against him. He said he had received a call from some of his journalist friends that a woman was holding the press conference against him. He said rushed to the LPC and went to the Press Conference Hall where Ms Shaheen Kunwal had almost wound up her press conference.

Businessman shot dead at MPA’s residence

A young businessman has been gunned down in the house of MPA Raja Sarfaraz Afzal advisor to the Punjab chief minister on wee hours of Saturday, police sources said.

The incident occurred at around 3:30 a.m. in Afzal House located in Afzal Town, Rehmatabad. The victim was later identified as Suhail Ali, son of Nawaz Khan, resident of Sector F-7/1, who was running a crockery shop in the City Centre in Saddar and was president of trader’s association, police sources said.

MPA Raja Sarfaraz Afzal of the PMLN when contacted by ‘The News’ confirming the incident said that it was an attempted robbery, but guards of the house gunned the robber while the others managed to escape.

The police also recovered weapons, three mobile phones, driving licence and credit cards from the custody of the victim and started investigation.

Nisar Khan, the real uncle of the deceased who resides in Sector F-7/1 told the police that they have family terms with Sarfaraz Afzal’s family and alleged that two brothers of Raja Sarfaraz Afzal — Gohar Afzal and Israr — along with another came to his house in Sector F-7/1 and took the deceased Suhail Ali with them for dinner. Nisar said that his nephew and his family had friendly relations with Sarfaraz’s family and he attended marriage ceremonies of Sarfaraz’s two sisters.

Advisor to CM Punjab Raja Sarfaraz Afzal confirmed friendship between his brothers — Gohar and Israr — and deceased Suhail saying that Suhail developed friendship with his brothers when they repeatedly went to his shop to buy crockery for his sisters’ dowry.

The MPA said that he was not present in the house when two masked persons jumped into his father’s house in Afzal Town at around 3:30 a.m., but dog of the house started barking on them, adding, consequently, guards and other servants rushed to the rear part of the house where they found two masked persons equipped with SMG and pistol. He said that guards retaliated and started firing at the bandits in response to their gunshot. He said that one of them jumped out of a high wall while the other received a bullet and fell down, adding that the guards overpowered him but he succumbed to his injuries.

The MPA admitted that the deceased attended the marriage ceremonies of his sisters. He was of the view that the victims had developed relations with his brothers to rob his house. The police officials are investigating the case despite heavy political pressure.
