**15 SHC judges attend reception for CJ

*HYDERABAD, April 15: The ‘suspended’ Chief Justice of the Supreme Court of Pakistan, Mr Justice Iftikhar Mohammad Chaudhry, has stressed the need for supremacy of the constitution and law.

Addressing a large gathering of lawyers at a reception organised by the Hyderabad Chapter of the High Court Bar Association and the Hyderabad District Bar Association in the civil courts building here on Sunday, he said a civilised society was ruled by the constitution and a representative system of governance.

Deviation from constitution, he added, led to anarchy and bad governance while complete obedience to constitution by everyone ensured rule of law. He also said that unless all citizens had access to justice and got resolution of their disputes they would be at the mercy of the strong and the oppressor.

Activists of several political parties carrying party flags gave a warm welcome to Justice Iftikhar on his arrival here from Sukkur by road.

** Everyone was taken by surprise to find 15 sitting judges of the Sindh High Court at the reception. They were Mr Justice Sarmad Jalal Osmany, Mr Justice Ameer Hani Muslim, Mr Justice Mohammad Moosa K. Leghari, Mr Justice Faisal Arab, Mr Justice Sajjad Ali Shah, Mr Justice Ali Sain Dino Metlo, Justice Mrs Qaiser Iqbal, Mr Justice Rehmat Hussain Jafri, Mr Justice Zawar Hussain Jafri, Mr Justice Anwar Zaheer Jamali, Mr Justice Mushir Alam, Mr Justice Munib Ahmed Khan, Mr Justice Khilji Arif Hussain, Mr Justice Maqbool Baqar and Mr Justice Athar Saeed. Hyderabad District and Sessions Judge Zafar Ahmed Sherwani, Additional Advocate-General of Sindh Masood A. Noorani and some judges of subordinate judiciary were also present.**

Justice Iftikhar was given a standing ovation and as he began his speech slogans of “Go Musharraf go” were raised.

The focus of the CJ’s speech was on the rule of Constitution and law and access to justice and his exercise of suo motu jurisdiction which led to dispensation of speedy justice in several cases all over the country. He said he believed that when justice was dispense by a court no less than the apex court the executive found it difficult to disobey it.

He said constitutionalism was antithesis of dictatorial or authoritarian system of governance. He said that the institution of judiciary, its sanctity, independence, impartiality and ability to do justice was “our common goal as we have to strive, in our humble way, to maintain and enhance the prestige and authority of this institution”.

HCBA President Abdul Sattar Kazi, Pakistan Bar Council’s Vice-Chairman Ali Ahmed Kurd, Supreme Court Bar Association President Muneer A. Malik and former president of the SCBA Hamid Ali Khan also spoke on the occasion.

Mr. Malik demanded unconditional withdrawal of the presidential reference and release of lawyers and other people arrested while protesting against the filing of the reference.

“All those who were behind this reference should be unmasked and brought to justice. The state should account for every one of the missing persons and those responsible for their unlawful detention should be brought to book,” he said.

Ali Ahmed Kurd called upon President Pervez Musharraf to disclose the names of the five generals who were with him when he called the Chief Justice to the Army House on March 9.

“Tell us General why those five generals had adopted a threatening posture towards the chief justice. And I am telling this with full responsibility to the audience that Musharraf would have to apologise for that,” he declared amid applause.

Hamid Ali Khan urged people to seize the opportunity and change history and decide to take Pakistan on the road of constitutional dispensation.

“It’s time that we should be counted,” he said, while referring to those who had resigned in support of the CJP.

It should be kept in mind that govt. fired a session judge for participating in CJP’s address to the Rawalpindi Bench. The govt. can’t move against any judge of the superior judiciary without going through the SJC, and since the SJC is sorta pre-occupied, the Pres. and PM team is left holding each other’s balls.

btw, are the lawyer's Bars in each province still kicking ppl out who are speaking up against Ifti?

and the rest is fine, but even if the reference is withdrawn and all, it makes no sense to release all ppl arrested in protests, if someone went and damaged private or public property while protesting, or attacked other lawyers, or attacked law enforcement perconnel, then they need to have charges against them and pay the price. there is no excuse for that.

the kicking out of lawyers is just hot air actually. The bar can’t kick out any lawyer just like that. For that the lawyer has to be issued a notice first. He gives his side of the story and only after that is his membership suspended. So most of what u r hearing on media is legal stuntmanship :hehe:

oh my god..this is a super cool judge guys. He has completely computerised his court. He is amazing. All cases in his court are heard only in English, he is the force behind the use of internet in the courts. Very good judge.

so lets say they have their facts wrong in this case only and in other things that you are posting as examples the media is 100R% accurate.

even then, if its not expulsion, but serving notices, on what grounds? just because they dont tow the party line of whoever the bar association is supporting?

umm...maybe the bars just want to have a unified voice..u know like the MNA's get notices when the vote against the party lines in the parliament. Is that right?

yup but a political party is a diff thing than a bar association. These guys are claiming to try to do the right thing, if so why would they want to suppress dissent in such a manner.

yeah I read this as well, it seemed that the judiciary was going to cave into the governments badmashi initally but the scale of the public response gave those with backbone an extra boost to stick it out and fight within the system, on the flip side it took the wind out of the sails of the government chamchas.

mushy supporters never saw or acknowledged the moral high ground my friend. another day, another excuse. The suspensions started from 9th March. why the late awakening?

and just to re-iterate my point..lawyers r still going to go through the notice procedure etc and if lawyers on whom the notices r served can justify their postion, they retain their membership.
a little know factoid: Naeem Bukhari already got his membership back though LHC.

u see..there is a set procedure to be followed. The same can’t be said of the govt. clutching on straws here my man. govt’s on the ropes on this issue.

Something ominous happened on Sunday. Several ruling PML Central Working Committee (CWC) members held a meeting that was presided over by the PML President Chaudhry Shujaat Hussain, in which it was suggested that the presidential reference against the suspended Chief Justice of Pakistan Mr Iftikhar Chaudhry should be withdrawn to “stop it from becoming a political issue”.

During the meeting, the party’s deputy secretary general, Iqbal Dar, charged that the party had not been consulted before the filing of the reference against the chief justice and demanded that an inquiry committee be formed to “discover” the “motives” behind the reference. “The reference should be withdrawn for an amicable solution to the judicial crisis,” Dar said. Is this the language of Chaudhry Shujaat Hussain?

How very apolitical, and even more exemplarily professional of the honourable highnesses our Lord Judges, to openly take part in a movement, which may have started on different footings but few weeks later is nothing but political.

sir jee, did u listen to his speech? Pls dont make judgements based only on what u read in the media. I listened to his speechs at Rawalpindi Bar and Sukkur Bar and when slogans were raised in Sukkur, he stopped his speech and said that he was really impressed by the discipline shown by the bar members today in organizing the event but that discipline should extend to the member behavior and they should not shout any slogans. In Rawalpindi bar, he threatened to walk out when lawyers started sloganeering. Please verify facts.

haris bhai...when the symbol of supreme justice is made humiliated by a third class police officer on streets and whole world is seeing that...then will the lord justices will not come forward to welcome a man of thier same profession !!!!!

None of the Lawyer was ready to take govts side, Khalid Ranjha and Waseem Sajaad did, and they are facing a boy-cott kind of thing.

what if there is a boy-cott kind of thing similar to lawyers, in other aspects of life, boy-cott the corrupt politician, boy-cott Generals planning conpiracy against the state, boy-cott govt officials for not providing what they ought to...
