Shirk is also attributing or taking on abilities which only Allah has the right too. Like its Shirk to say one is equal/greater than Allah and that is either idolatry or polytheism.

We do judge, our entire justice system is based on judging people. What we dont do is judge them without evidence, because that would be an "injustice."
