India’s opposition leader LK Advani has appeared in court and been charged with inciting Hindus to attack a mosque in the town of Ayodhya in 1992.

The demolition of the Babri mosque sparked religious riots in which more than 2,000 people were killed.

Mr Advani has denied any wrongdoing over the destruction of the mosque.

A court had ruled that Mr Advani had no case to answer, but an Indian high court then overturned the ruling in 2003 and ordered him to stand trial.

Mr Advani, who heads the main opposition Bharatiya Janata Party (BJP), appeared before a judge in a lower court in the northern town of Rae Bareilly to answer charges about his alleged role in the demolition of the mosque.

‘Creating enmity’

He was accompanied by seven other defendants, including two of his former colleagues in the cabinet - Murli Manohar Joshi and Uma Bharati.

“This is the first time all the eight accused have appeared before the court,” a lawyer for India’s top investigating agency, the Central Bureau of Investigation, PK Choubey told the BBC.

He said the judge read out the charges “regarding giving provocative speeches leading to demolition of the mosque, creating enmity between Hindus and Muslims and inciting people for riots and public mischief”.

Mr Advani and the seven other defendants were released on personal bonds and told to appear in the next hearing on 30 August.

The BBC’s Ram Dutt Tripathi in Rae Bareilly says Mr Advani did not say anything in court and addressed a public rally in the area after the hearing was over.

He told supporters he was sure the Indian people wanted a permanent Hindu temple built at the Ayodhya site.

The site, in Uttar Pradesh, has a makeshift temple amid continuing disputes with Muslims over ownership.

“I am confident that people will not sit quietly till a grand temple of Lord Ram is built at his birthplace,” Mr Advani said.

Gun battle

BJP leaders said that the case against him was “politically motivated”.

“This is a false case. No one incited anyone. Hindus had come to do voluntary service that day, and they built a makeshift temple at the place of the mosque,” BJP official Vinay Katiyar told Associated Press.

Many Muslim leaders reject this view.

“The demolition was a planned move. The workers came with axes and shovels. Leaders like Advani… asked their workers to raze the mosque,” Zafaryab Jilani of the Babri Action Committee, which wants to rebuild the mosque, said.

Earlier this month, six gunmen stormed the complex.

One blew himself up and the others were killed during a two-hour gun battle with police.

Mr Advani has always denied charges over his alleged involvement in the destruction of the mosque in 1992.

A local state court had in 2003 acquitted him while ordering seven others, including a former minister, Murli Manohar Joshi, to stand trial.

But the high court in Allahabad in Uttar Pradesh overturned the ruling following a petition filed by two Muslims who argued Mr Advani could not be exonerated while the trial of the other seven continued.

Indian court system is a real faluir. there are 27 cases pending against the Imam Bukhari of Delhi Jama Masjid, but no one dares to take him to court.

Simple. 1992 and now 2005. It does not take 13 years to bring someone to court. Well in the Indian justice system it does.

Anjjan it really is a failure. Why doesn't the Indian courts do anything about him? Why haven't you complained? I suggest you do so.

Thanks CM, for advice. I would definitely like to see Imam Bukhari of Jama Masjid behind bars.

In India the courts are control less. What do you think who controls the courts in your country, as one of your PM was hanged in just one and half year after he was dethroned, another one was exiled in 10 months after dethroned.......a marvelous speed.

And he was hanged despite the fact that a person cannot be hanged unless there is a unanimous decision which was not the case with Bhutto, 2 judges dessented. Also it was an unprecedented death sentence to a person for ‘having’ someone killed, a person who ‘has’ someone killed cannot be hanged!
And today those judges say sorry, it was a mistake, we were under pressure…what pressure? a bloody judge can pass a judgement sitting in his toilet.
As far as the second PM is concerned, the courts had no role to play.
The standard of judges has fallen so much that it cannot fall anymore, ‘zero’ character, u can fix a time wit em, theyll call u at mcdonalds to ‘finish’ the case off.

A senior high court judge on his way back from Dubai could not find his baggage so he ** declared the airport a court of law and said if his baggage wasnt found in 45 minutes, he would hold the PIA people in contempt of court**

The difference is we aren’t “the largest democracy”. A democracy has a fair justice system. India is neither a democracy nor does it have a fair justice system. How long before you put Advani in jail? After he is dead?

A democracy is just not voting. It is about institutions and laws and respect for life. Gujrat would never have happened in a Democracy. A man who burned down a mosque would not be free and a popular politician for 13 years in a demcracy.

Really? I know for a fact that a majority of Western Europe fit that bill 2 years ago. Switzerland is one. All the Scad. are. Japan is. New Zealand is. The problem is that you guys don't accept the fact.

I guess you have never heard of Malaysia or Indonesia Anjjan. Secondly Anjjan learn to read i said we aren't a democractic state and i am ok with it. So get your own house in order first.

Han we dont except the fact that a pakistani comes up and says what to do with the judiciary.. he he..
till 1971 women were not allowed to vote in switzerland!!! and it had a democratic tredition that goes back a long way before india got independence.
And nobody complains about Indian judiciary system. Its slow but is impartial.
If Indian democracy is not vibrant, ofcourse we could have had more of it replicated in the other indian states in the following months after gujarat.
Go up and read the comments and judgement passed by the high court and supreme court against the gujarat govt.

It was 1991 dumbass. Speaking means nothing. Implementation means everything. Just because you write it out does not mean it will happen. I judge on concrete actions not on what type of paper the judgement is written on.
