It is a private company and they have a dress code for their employees. If you are not comfortable with that dress code, don’t work there.

The only issue is - ABF assumed the lady would not be willing to take off the hijab. They did not specify the dress code to her. She learnt after the fact the reason for her not being selected.
They had an obligation to inform her of the dress code.

Yes, absolutely. If your religious dress code is in conflict with the company’s dress code requirement…the company, a private business, should not be required to change that to accommodate you.

The rejection is not because of the religion of the applicant but their corporate policy. I don’t think this is discrimination. However, if there is a job where you do not need a particular dress code and you are rejected because of your religious beliefs, then it is discrimination. Ever seen a Sikh man as a salesman at A&F store?
There are millions of such jobs and people are happily employed there regardless of their religious beliefs.
I’m waiting for a time when a hijabi woman applies for a job at hooters.

Yes I am serious. Unless in the job advertisement they state “only gay dudes and duudettes with chiseled bodies” need apply, they have an obligation to clarify the (lack of) dress code. The employer shoukd nor make assumptions that the candidate may not meet dress code.

I would agree with you. The job description should mention dress code restrictions, if any.
Regardless of the specifics of this case, do you think corporations are justified in rejecting applicants because they expressly would not adhere to their dress code for religious reasons?

A&F is just playing safe this time. Last time they hired a Muslim lady and then fired her for wearing hijab and it was ruled discrimination. However, they are perfectly within their legal rights in not hiring someone who will not adhere to their dress code.

In today’s political climate it’s utter willful ignorance to suggest that this isn’t a matter of discrimination on the part of the American management. A&F operates in the middle east…really like to know if said “policy” applies there. Second, GO inside an A&F store. If that’s a dress code, then the meaning of the word has really changed. So spare us that lame ass argument.
I would agree, there are some lines of work where refusal to abide by the dress code, or perform certain acts, will automatically rule out a person’s application. For example, can’t be a beer taste tester without being willing to drink beer. This is not that sort of situation.
Anyway, they can do whatever they want…and we can shop wherever we want. So fine…support bigots and shop at A&F…
