First of all, the US constitution is primarily to stop the US govt from discriminating against its citizens.
The best bet is to just sue the company in court. ACLU would gladly help her. It isn’t like australia banning mosques or switzerland banning minarets.

Hmm. I don’t much care to shop there, but I wonder how exactly does wearing a hijab interfere with the store’s image?
A hijab sporting employee would most likely be wearing the shirts sold by the store…as do the other employees. It’s not a store that exclusively sells head-wear that they should be bothered by having a hijabi employee. She would have to greet customers and fold/organize clothes and man the register…basically the same duties as other employees…so how exactly does her “hee-jab” prevent those duties?
What is next? Will Abercrummy and Witch prevent obviously Muslim-looking customers from entering their stores? So it’s okay for Abercorny to collect profit from Muslim customers, but they can’t have any Muslim employees. Does Aberzombie have any branches in Muslim countries like Dubai etc? If so, does the managerial headquarter allow for hijab-wearing employees in those countries? If so, I wonder if there’s a consistency in the rules.

To the honorable posters who queried about Abercombie and Fitch dress code in the Middle east. I just got off the phone speaking to their spokesperson located in the Bahamas. Here is what she said:
Our dress code varies with the geographical location and is respectful of the local culture and custom. Here in the Bahamas, the ladies wear a two piece. In India, the gents wear tangled dhotis. And in the middle east, we are covered top to bottom. In the US, covering one of the two is optional.

You must not have been to their store. They are BIG on image. For the longest time, they had topless dudes at the front door as greeters. I don’t see that anymore but I can still tell that image is of importance to them. A store that sells Abayas will not hire someone who only likes wearing revealing clothes. I think a private company reserves the right to reject a candidate based on its dress code policy. Rejecting a candidate based on dress code is not up there with rejecting someone based on race, religion, ethnicity, or disability. Why does she even want to work there? Like WTF?

^Oh but I have been there and I’ve never encountered topless greeters. I’ve seen pics of topless models in their advertising, but not actually in the store.

^The closet Abercrombie store for me is about 45 minutes away. A long, long time ago I had been inside the very dimly lit interior of the store. There was quite a rush, but I don’t recall see any topless employees. Haven’t thought about the store in ages as I don’t shop there. But I googled it a while ago and yes, you are right, some of the pictures are rather bold. I don’t wear hijab, but the advertising alone makes me uncomfortable. So, I’d assume that a hijaban would be more conservative than me and thus feel even more uneasy in being associated with the store… though…I doubt she’d be doing anything different from the duties in other stores like Amer Eagle/Aeropostale/Forever 21.

) in jeans ads that I saw. I didn’t even notice them that much but for the old ladies coming and complaining to me about it. I guess some people just need to vent
