A clause from Shariat Bill , what a joke ....

This is just one clause , i wonder what’s in the other clauses,

Point Number 15 of the Shariat Bill that was tabled in the house of parliament on May 27, 2003 by MMA, mainly targets women.

Some of the points discussed in the current Shariat Bill are:

*** Women are to observe Purdha from the age of 11 onwards.**

I think 11 is alrady too late and alot of non-mehrum can see her so why not make purda must for a girl at the time of birth.

*** No images of women on the billboards**

We might see some mulana selling fair and lovely.

*** To forbid male doctors from examining women.**

Do we have enough lady doctors for 60% of Pakistan’s population.

*** To forbid male coaches to train sportswomen.**

It is practically happening in NWFP

*** To forbid women clothing to be stitched by male tailors.**

This is funny, but atleast alot of employment oppertunities for women in that area. as for men tailors , they should pray that men population in pakistan should increase to 70%.

*** To abandon the family planning policy because it is considered un-Islamic and because the size of the population is not a burden on the economy.**

family planing is un islamic = ok

The ratio of doctor-pateint is horrid in Pakistan to begin with, especially for women and especially in rural areas. Male doctors not being able to treat women is basically a death sentence to many of these women.

Some of the clauses need consideration but the rest seem ok. Its a matter of knowledge.

majority make no sense, its not a matter of consideration.
now they will sit around thinkign up punishments for ppl who break these rules.

Could they focus on other stuff like sectarian violence, bonded labour, child labour, abusive work practices, lack of proper education.

Our people have a problem, which worries me. Why can't we accept what people voted for. The people voted for MMA, so let them have it. LEt them taste their laws. InshaAllah in the next elections, we will see a refinement. The waderas are not good but unfortunately they form the forces besides MMA and they are in power. Islam challenges their way of living, so naturally they are making all efforts to malign MMA.

On the other hand, MMA might be called immature. Since many of their MNA's do not have the real ISlamic vision. This is called democracy! This is how they will learn and become better. I am quite sure, for a majority of them, this is their first time they have come to real life out of MAdrassas. Let democracy take its course.The MMA also has a point! They are saying that the Army should let the PArliament function. I am sure all the other Islamic clauses can be worked out. The main issue is real democracy.

I personally think, that Musharraf, who is my favorite, is a human being and so can make mistakes. The newest mistake is going to the US visit without consulting even his own governement or the Parliament. Where is Shoora??

If you just look across the border in India, you find people like LAloo parsaad, uneducated, and didn't even know how to talk, and was a chief minister of Bihar. They do have democracy! We must learn from them, even though they are our enemies!

Democracy and real Islamic democracy can keep the country united.

i agree with you "Islamabad" but its more that 50 years since the birth of pakistan and its a very long time , but still our country is standing at the same spot like 50 years back in political picture.

i also like Mushruf, the question is for how long he will be there. he might be assinated (Allah forbid) then what. these MMA are there just like PPP and ML.

some one has to come up with real voice. coz if USA goes for IRAN than no matter what its pakistan's number. and trust me we dont have any place to go.

once side is india , other russia, the afghanistan (who are more eager to have contacts with india). so its about time that MMA should know how to talk democratically. they have to learn now .

Coz personally i think the testing phase is over now. its time for practicallity.

I am not against bringing islamic law in pakistan i.e. true islamic law,

what i am against is Mulla's islamic law e.g. shariat Law, what ever , whereever and how ever a mulla likes just give a fitwa and wants every single pakistani to obey it.

i.e. if i am not mistaken, in 1980's, under the influence of mullahs in NWFP people actually throwed Acid on girls not doing purda and now blacking up the signboards with girls pictures on it.

this is certainly no islam and no idea when people will know whatever a mulla says is not truth.

PROPOSED DRAFT FOR ENFORCEMENT OF SHARI"AH ACT

WHEREAS sovereignty over the entire Universe belongs to Almighty Allah and the
authority to be exercised by the people of Pakistan including those of N.W.F.P
through their representatives within the limits prescribed by Him is a sacred
trust;
AND WHEREAS the Objectives Resolution has been incorporated in the Constitution
of the Islamic Republic of Pakistan as a substantive part thereof;

AND WHEREAS Islam has been declared to be the State religion of Pakistan, and
it is obligatory for all Muslims to. follow the Injunctions of the Holy Quran
and SUNNAH to regulate and order their lives in complete submission to the
Divine Laws;

AND WHEREAS it is one of the fundamental obligations of the Islamic State to
protect the honour, life, liberty and the fundamental rights of the citizens as
guaranteed under the Constitution and to ensure peace and provide inexpensive
and speedy justice to people through an independent Islamic system of justice
without any discrimination;

AND WHEREAS Islam enjoins establishment of social order based on the Islamic
values of bidding what is right and forbidding what is wrong (Amr bil Ma'roof
wa nahi anil Munkar);

AND WHEREAS in order to achieve the aforesaid objectives and goals, it is
necessary to give to these measures constitutional and legal backing;

It is hereby enacted as follows:

Short title, extent and commencement.-

  1. This Act may be called the N.W.F.P. Shari'ah Act, 2003.
  2. It extends to the whole of N.W.F.P.
  3. It shall come into force at once.
  4. Nothing contained in this Act shall affect the personal laws, religious freedom, traditions, customs and way of life of the non-Muslims.

(2) Definition of Shari'ah.--ln this Act "Shari'ah" means the Injunctions of
Islam as laid down in the Holy Quran and Sunnah.

(3) Supremacy of Shari'ah. The Shari'ah, that is to say, the Injunctions of
Islam as laid down in the holy Quran and Sunnah, shall be the supreme law of
the whole of N.W.F.P

(4) Law to be interpreted in the light of Shari'ah: All the courts in N.W.F.P.
shall interpret the laws according to Shari'ah.
EXPLAINATION: While interpreting the statute-law, if more than one
interpretation is possible, the one consistent with the Islamic principles and
jurisprudence shall be adopted by the courts.

(5) Observance of Shari'ah by the Government and the citizens: All Muslim
citizens of NWFP shall observe Shari'ah and act accordingly. Likewise, the
rules shall be incorporated to ensure that the Provincial Government and its
servants follow the Shri'ah. While legislating, particular attention shall be
paid to the fact that no law is enacted against the Shari'ah and Constitution
of Pakistan.

(6) Teaching of and Training in Shari'ah: The Provincial Government shall
make effective arrangements:
a. to include the course on the Islamic jurisprudence in the syllabi of the
law colleges;
b. for the teaching of Arabic language

(7) Islamization of education:
1. The Provincial Government shall take necessary steps to ensure that the
educational system is based on Islamic values of learning and character
building;
2. the Provincial Government shall, within one month from the commencements
of this act, appoint a Commission consisting of educationists, jurists,
experts, ulemas and elected representatives as it may deem fit and appoint one
of them to be its chairman.
3. The function of the Commission shall be to examine the educational system
of Pakistan to achieve the objectives referred to in sub-section (1) and make
recommendation in this behalf.
4. A report containing the recommendations of the Commission shall be
submitted to the Provincial Assembly for necessary legislation.
5. all executive authorities, institutions and local authorities shall act in
aid of the Commission.
6. The Ministry of Education of NWFP shall be responsible for the
administrative matters relating to the Commission.

(8) Islamization of Economy:
1. In order to ensure that the economic system of the province is constructed
on Islamic economic principles, the Provincial Government shall, within one
month of the commencement of this Act, appoint an Economic Reform Commission
consisting of economists, bankers, jurists and ulemas, one of whom shall be its
Chairman.

  1. The functions of the Economic Reform shall be: a) To recommend measures and steps, including suitable alternatives, by which the economic system enunciated by Islam could be established. b) To recommend ways, means and strategy for such changes in the economic system of the province so as to achieve the social and economic well being of the people as envisaged by the Constitution of Pakistan. c) To undertake the examination of any fiscal law or any law relating to the levy and collection of taxes and fees or banking or insurance law or practice and procedure to determine whether or not these are repugnant to the Shari'ah and to make recommendations to bring such laws, practices and procedure in conformity with the Shari'ah. d) To recommend suggestions for the elimination of Riba and alternative economic proposals. e) The Economic Reform Commission shall, from time to time, submit its report to the Provincial Government, which shall be placed before the Provincial Assembly. All executive authorities, institutions and local authorities shall act in aid of the Commission. The Ministry of Finance shall be responsible for the administrative matters relating to the Commission.

(9) Mass media to promote Islamic values: The Provincial Government shall take
steps to promote Islamic values through such mass media which is not against
the teaching of Islam.

(10) Protection of life, property and personal freedom: In order to protect
the life, honour, property, personal freedom and rights of the citizens, the
Provincial Government shall take necessary legislative and administrative
measures, wherein the public display of the arms shall be banned.

(11) Elimination of Bribery: The Provincial Government shall take legislative
and administrative measures to eliminate bribery, corruption and malpractices
and provide for exemplary punishments for such offences.

(12) Eradication of Social Evils: The Provincial Government shall take
effective measures for enactment of laws for the eradication of social evils
and promoting Islamic virtues on the principles of amr bil Ma'roof wa nahi anil
Munkar as laid down in the Holy Quran.

(13) Eradication of obscenity and vulgarity: Effective legal and
administrative measures shall be taken by the Provincial Government to
eradicate obscenity and vulgarity.

(14) Reforming judiciary in Provincially Administered Tribal Area
1. The Provincial Government, within one month of the commencement of this
act, shall appoint a Court Reform Commission consisting of ulemas and jurists
and legal experts, one of whom shall be its Chairman. The function of the
Commission shall be:
a) Examination of existing laws prevailing in the provincial areas of NWFP
b) Examining the defects in the existing laws and offer alternative
proposals.
c) Compilation of Islamic Code of Civil procedure, Islamic code of Criminal
procedure and Islamic law of Evidence.
2. A report containing recommendations from the Court Reform Commission shall
be submitted to the NWFP Governor for the implementation within the
Provincially administered Tribal Area.

  1. All executive authorities and institutions shall act in aid of the Commission and the Ministry of Law shall be responsible for the administrative matters relating to the Commission.

(15) Rules: The Provincial Government may make rules for carrying out the
purposes of this Act.

OBJECTIVES AND REASONS
This is the obligation of the Provincial Government to establish Shari'ah
within the limits of its jurisdiction. For this purpose, while staying within
the sphere of the Constitution of Islamic Republic of Pakistan 1973, this
proposed draft for enforcement of Shari'ah is submitted for legislation.

accepting the group that is in power is okay. I dont see m,ass protests from anyone that MMA should step down. But as citizens it is people's right to make sure that they voice their opinions about the government policies, bills, and resolutions that they are not comfortable with.

Democracy is not just electing someone and letting them do what they want, democracy is to elect someone and to be able to voice your opinions, for or against bills and decisions, whether you voted for the aprty or not.

Last month while making his budget speech, the MMA finance minister replaced GST (General Sales Tax) on all its occurances, with GTS, which stands for Government Transport Service!

And they say the Madrassa degree is equivalent to BA!

The Talibans were Great Fighters. Becuase they were trained as fighters. They made a mess when they had to make laws and govern the country. Becuase they had no prior traing of governence.

In my opinion governing a region is a very difficult task and Good government requires competent people with deep knowledge and understanding of their respected fields. Unfortunately the NWFP government does not have competent people to make senseable policies. So they are not touching the real issues.This Provincial government is just trying to frustrate the Federal government by
these senseless moves.

The government in NWFP is not sincere in bringing Shariah Law in province, they have no courrage to face real issues

Name one country which was not created through toil and strife? The Taliban never had a chance of creating a government...There efforts to create an Islamic state was cut short by the Americans...The fledgling state of Afghanistan was uprooted before it could take root...

Now I know there are mod-Muslims here who believe that Israel an ideological Jewish state, should be recognized and it's policy of 'every child going through military' should be supported, but they would have been vehemently against the Taliban implemeting the same...

Despite continous pleas for assistance in recreating a homeland, in their own homeland, the Taliban were ousted for no apparent reason that Osama Bin Laden lived in Afghanistan and the biggest terrorist Sharon is left to run a rogue state which occupies free lands and kills refugees in the thousands...

That's the problem with mod-Muslims. They view themselves as the world wishes to portray them...No identity, no beliefs no compassion...If there is comapssion, it's always for those who are against Muslims...

No country has been created without toil & strife, but usually this is the toil and strife of the founders of the country and that of the people to a lesser extent. There is no justification for people trained and educated in Pakistan to go and capture the land of the Afghanis in the name of 'strategic depth', and then commit the most unbelievable cruelties on all the people especially the women and young girls of that country, and then say this 'toil & strife' is for the country! All Afghans truely hate Pakistan and Pakistanis for what we had done to them.

And no, if people elsewhere are terrorist, it is not even half a justification for you to become one. Are you to follow the example of prophet Mohammad, or that of Mr. Sharon?

Lajawaab, have you ever really read what Taliban's perception of islam was? that was NOT a true islamic state and by the look of things, it was not going to be one. I can state so many clear cut cases of direct contradiction with Basic and well-knon facts and regulations of islam even though im no where any authority on islam but atleast i know these kinda basics. its Primary and secondary education stuff which they consistentely contradictred and killed ppl for that.
