Re: A black day for Pakistan.....

Dear guppies

Please remember that 99% of the Pakistani society “IS” corrupt, that includes businessmen, lawyers, doctors, shopkeepers, police and also the judiciary.

You all should have watched “AAJ with kamran khan” on geo, he showed proof recorded 2 months prior to what has happened to the chief justice NOW. The Chief justice’s son used his fathers post to get a good position in the government. Hundreds of other charges that have been clearly proven against the chief justice were explicitly shown on an “Independent channel” .

But as usual our Pakistani society will always side with the corrupt guy, which is happening in this thread. Sad….

PS : but I agree that musharraf should have followed the correct procedure and not follow a shortcut.

Re: A black day for Pakistan.....

I read this and say, “What a characterless nation we are...”

Recently the queen of England pardoned two Brits who were executed by the British army on charges of cowardice in the First World War”

Their great grand children had filed a petition so that their great grand parent should be forgiven.
The point to note here is that the great grand children did not Challenge the judgment of the British army , rather respected it and just asked for a pardon”

Look at us , Shame on us…

Re: A black day for Pakistan.....

^ Very true, that was the point I was trying to convey in PA, when this was issue about him getting his son at a high rank came out in the open, people were saying how it was because of Musharraf that no action is being taken against this guy, and now that action was taken (im not saying whether it was right or wrong) the same people are saying how its unjust, and oppressive!

Re: A black day for Pakistan.....

Believe me If I ever found out that the person who is buying me dinner or has invited me to his house, and he/she has been corrupt (nepotism, bribery, or stealing from government funds) I decline the offer and look down upon the person as society looks down upon a dirty old prostitute

Re: A black day for Pakistan.....

Should any one be surprised by such events happening in the Banana Republic of Pakistan..

Re: A black day for Pakistan.....

nyah, any country where the govt gets blackmailed by a bunch of religious nutjob loonies holding a children's library hostage, ...nothing from there surprises me.

Re: A black day for Pakistan…

Wrong. There are no less than 23 references filed against the superior judges in the SJC. Yet not one has been addressed under the chairmanship of Iftikhar Chaudhury, yet he gets time to summon newspaper editors to his chambers to warn them off printing stories about his son.

**23 complaints pending with SJC for years

Ahead of Presidential reference against the Chief Justice Iftikhar Muhammad Chaudhry, there are in the queue 23 complaints pending for a hearing with the Supreme Judicial Council against several other judges but no action has so far been taken, The Nation has learnt. These complaints include serious charges against several senior judges of the High Courts, the sources revealed to The Nation. One sixth of these complaints are against one individual judge. Some of these complaints, which range from corruption to misconduct, are pending adjudication for the last several years. Habib Wahab-ul-Khairi, a senior lawyer and one of the complainants, said the fate of complaints filed before the presidential reference, must be adjudicated ahead of the charges against Chief Justice Iftikhar Muhammad Chaudhry. “If there is any justice, we must get it ahead of Pervez Musharraf or any other complainant because we have been waiting for a hearing for the last many years,” Khairi, who was the mover of famous Al-Jihad Case, demanded. The Al-Jihad case had set the principle that the senior most judge would be the Chief Justice if the office falls vacant. “If a Supreme Judicial Council meeting can be summoned within days after receiving complaint against one judge, why the others are getting the advantage of inordinate delay, Khairi said.“The Acting Chief Justice should also ensure that no such judge should be included in the Supreme Judicial Council, who himself stands accused of any wrongdoing,”** Khairi demanded. Another senior apex court lawyer, Hafiz Abdul Rehman Ansari is also among the list of complainants in the Supreme Judicial Council with his grievance against a judge. Munir A Malik, President Supreme Court Bar Association, (SCBA) also confirmed that there are a number of complaints against some judges pending with the Supreme Judicial Council for the last many years. Under the rules of procedure, the fate of these grievances must be decided prior to that which is targeting Chief Justice Iftikhar Muhamad Chaudhry, he added.

Re: A black day for Pakistan.....

The more I read about how this CJSC was initimdating the free media, the more I am appaled, as I quite liked the guy. I mean Geo News has been ordered by the judges to apologize every day for the next few days for daring to broadcast about corrupt practices in the higher courts! Imagine anyone else (President, PM, ministers etc) ordering journalists or private tv channels to do that sort of thing. They would be accused of attacking the freedom of the press, and dictatorial practices etc.

[

If indeed 23 cases have been registered against judges in SJC, why are those udges not been suspended like Iftikhar Ch? Again, it tells s that case against Iftikhar is politically motivated and has nothing to do with coruuption per se.](“http://www.nation.com.pk/daily/mar-2007/11/index6.php”)

Re: A black day for Pakistan.....

question: for the 23 cases that areregistered, who has the responsibility of reviewing and resolving those and taking action? I am not familiar with pakistani system and how it is supposed to work.

Re: A black day for Pakistan.....

^ if it's Supreme Court judges, the traditional means is the Supreme Judicial Council, however the council has rarely been summoned in Pakistan's post 1973 history. As I said earlier the ouster of judges has almost always been on political grounds. The Council in turn consists of the same judges which to be honest is a classic case of conflict of interest. The bit which makes the internal accountability system quite flawed is the fact that only the President or governors can file references against Chief Justices..an ordinary citizen cannot.

On a side note Article 62 of the constitution is quite specific:

In Article 63 (disqualifications), clause (g) disqualifies a person if "he is propagating any opinion, or acting in any manner prejudicial to the ideology of Pakistan, or the sovereignty, integrity or security of Pakistan, or morality, or the maintenance of public order, or the integrity or independence of the judiciary of Pakistan, or which defames or brings into ridicule the judiciary or the armed forces of Pakistan."

Re: A black day for Pakistan.....

zakk thanks, i have to digest it a little..

Re: A black day for Pakistan.....

Then only angels and prophets can fulfil the article 62 ...as this was made by Manzoor Qadir in 1962 constituition under General Ayub...a very "legal" ruler indeed !!!!!!!
