These are proven, well documented assets of our President without any known source of income. As Pakistani nation suspects these assets are illegally robbed from them, with any standards of morality the President being the office holder of the highest rank in Pakistan must explain how he accumulated these assets. Instead of explaining these valid questions the President started a topi drama, and some of our good friends are becoming partners in his crime by supporting this topi drama.

Legally speaking the President is not obliged to declare his assets. Morally with these serious allegations, if he has any shame should resign from the office and make himself answerable to the people who entrusted him to become custodian of this extremely poor nation’s intersts..

NAB files list of NRO beneficiaries; court terms ordinance a ‘washing machine’, ‘injustice’ to bereaved parties

ISLAMABAD: The National Accountability Bureau (NAB) on Tuesday submitted in the Supreme Court the list of the NRO beneficiaries, which showed President Asif Ali Zardari possessing assets worth $1.5 billion (Rs 120 billion) abroad and worth Rs 24.14 billion in the country.

Deputy Prosecutor General Abdul Baseer Qureshi presented the list of 248 NRO beneficiaries before the full court, hearing the petitions challenging the infamous ordinance, promulgated in 2007 giving legal cover to the corruption of politicians and bureaucrats

A 17-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, had directed the NAB the other day to submit authentic details of the NRO beneficiaries. According to the list, there are at least seven abolished references against President Zardari. The list indicates that the assets of President Asif Ali Zardari in foreign countries stand at $1.5 billion, including houses and bank accounts in Spain, France, the US and Britain while his assets in the country stand at Rs 24.14 billion.

In the list, President Zardari’s assets worth Rs 22 billion were mentioned as beyond means and the cases in this regard were withdrawn by the Accountability Court on March 5, 2008, under the controversial NRO.

Similarly, cases of corruption of Rs 268.3 million regarding the purchase of Ursus Tractors (Awami Scheme) and illegal construction of the polo ground at the PM House at the cost of Rs 52.297 million were terminated under the NRO in March 2008.Likewise, the list also includes allegedly causing loss of Rs 1.822 billion to the national exchequer by President Zardari by granting licence to the ARY Gold. The said case was also terminated under the NRO ordinance.

The NAB deputy prosecutor general told the court that information regarding the misuse of authority in affairs of SGS PSI Company by Asif Ali Zardari as well as illegal award of contract to Cotecna for pre-shipment was being collected.

The NAB list included names of Interior Minister Rehman Malik, Pakistan’s Ambassador to United States Hussain Haqqani, Defence Minister Chaudhry Ahmed Mukhtar, former NWFP chief minister Aftab Sherpao Khan, ex MNAs Nawab Yousaf Talpur, Anwar Saifullah Khan, Sardar Mansoor Leghari, Haji Nawaz Khokhar, Pir Mukarramul Haq, Brig (retd) Imtiaz, Usman Farooqi, Salman Farooqi, former president Habib Bank Younus Dalmia, Mirbaz Khetran and many others.

He submitted that the National Assembly’s standing committee approved the NRO, however, the concerned minister took it back from the assembly. During the proceedings, advocates general of the Punjab, the NWFP and Balochistan informed the court that under Section 2-A of NRO, no review boards were constituted in their respective provinces to decide the murder cases.

Advocate General Sindh Yousaf Leghari, however, informed the court that 8,000 cases were dropped under the NRO in Sindh, of which 3,000 were murder cases. He sought time to provide details of the cases decided under Section 2-A of the NRO in Sindh. The court directed the AG Sindh to submit report before the court today (Wednesday).

Abdul Hafeez Pirzada, counsel for Dr Mubashar Hassan, submitted the ordinance as whole was void because it was a fraud ordinance as it violated many substantial provisions of the Constitution.

He submitted that reconciliation meant reconciliation between husband and wife, between parents but this National Reconciliation Ordinance had trampled the rights of the entire nation. Pirzada contended that all stakeholders were not taken into confidence before its promulgation. “The nation is threatened with fragmentation,” Pirzada maintained.

At this, Chief Justice Iftikhar Muhammad Chaudhry said the 1973 Constitution was drafted with consensus. He further contended that the ordinance was void, ab-initio, as it violated the ruling of this court in Mahmood Khan Achakzai and Syed Zafar Ali Shah case that ruled that parliament could not alter the basic features of the Constitution.

“If parliament does not have such power, how can an individual,” Pirzada said, requesting the court to strike down the ordinance. Pirzada submitted that the ordinance had undone Article 62 and 63 of the Constitution, adding the condition put under Article 63 1-P for disqualification of a candidate had been obliterated by the NRO. The learned counsel requested the court to strike down the ordinance as it had usurped the judicial power.

Pirzada was still on his feet when the court adjourned the hearing for today (Wednesday). The court also restored a ‘dismissed due to non-prosecution’ petition of Tariq Asad, advocate, on the NRO and accepted it for hearing.

Earlier, Salman Akram Raja, counsel for Dr Mubashir Hassan, while resuming his arguments submitted before the court that the administration was given judicial authority under the NRO, which was in violation of various Supreme Court decisions. Chief Justice Iftikhar Muhammad Chaudhry observed that the accused were declared innocent under the NRO so that they could contest elections but dropping cases didn’t mean they were pardoned completely.

Justice Khalilur Rehman Ramday observed that judges were the guardians of people’s rights. “If somebody’s son is a murderer, the rights of his relatives cannot be abolished,” Justice Ramday said.

Justice Muhammad Sair Ali in his remarks termed the ordinance a ‘washing machine’ and ‘injustice’ to the bereaved families of those killed. On a court query whether the situation would move to the position of October 4, 2007, if the NRO was declared void, Salman Raja replied in the affirmative.

Other members of the bench include Justice Javed Iqbal, Justice Sardar Muhammad Raza Khan, Justice Khalil-ur-Rehman Ramday, Justice Mian Shakirullah Jan, Justice Tassadduq Hussain Jillani, Justice Nasir-ul-Mulk, Justice Raja Fayyaz Ahmed, Justice Chaudhry Ijaz Ahmed, Justice Muhammad Sair Ali, Justice Mahmood Akhtar Shahid Siddiqui, Justice Jawwad S Khawaja, Justice Anwar Zaheer Jamali, Justice Khilji Arif Hussain, Justice Rahmat Husain Jafferi, Justice Tariq Parvez and Justice Ghulam Rabbani.

The wind blows against NRO in SC

ISLAMABAD: The 17-member bench on Tuesday set its tone on discussing the consequences if the National Reconciliation Ordinance is declared void ab initio and Abdul Hafeez Pirzada urged the court to protect the Constitution “even if the heavens were to fall”.

The honourable chief justice asked both the lawyers, Salman Akram Raja and Abdul Hafeez Pirzada, who argued the case on Tuesday, about the consequences if the NRO was declared void ab initio. Both submitted that the cases withdrawn under the NRO should be restored to October 4, 2007 position.

When Salman Akram Raja was arguing on the illegality of the NRO and quoted Indra Gandhi’s case where elections were held null and void by the Election Commission but a constitutional amendment was brought to legitimise the polls and the Indian Supreme Court had set aside that amendment,** Chief Justice Iftikhar Muhammad Chaudhry asked the counsel to arrange the recent Italian Supreme Court’s judgment where the immunity enjoyed by Silvio Berlusconi, the Italian Prime Minister, was scrapped. **

While discussing the provisions of the lapsed NRO Abdul Hafeez Pirzada discussed in detail the conviction of a person in absentia. He was referring to Section 6 of the lapsed ordinance. Justice Khalil-ur-Rehman Ramday remarked that under section 89 of CrPC a person can be convicted in absentia and his property can be confiscated. At this stage the **Chief Justice also mentioned Article 63 (p) of the Constitution pertaining to disqualification of a person from holding a public office on charge of absconding from the courts. **

Both lawyers also focused on the powers of the legislature to make laws and observed that the NRO was an assault on the judiciary and was in fact an illegal legislative judgment in which thousands of cases were terminated within six weeks. Justice Ramday remarked, “This does not mean that we are the mighty powerful but we are the custodians of people’s rights.”

Abdul Hafeez Pirzada while explaining the term reconciliation said that NRO was not reconciliation, as it covered only that era when democratic forces were in power and the allegation of political victimisation was raised.

It appears from the mode of hearing that the judgment of these petitions would not be delayed and it may come in a few days as there is no one to defend NRO. The list of 248 beneficiaries of the NRO was also submitted in the court.

It was ironic to see that while the PPP leadership had been publicly defending the NRO for the past two years, inside the courtroom one could not find a single supporter of the despised and lapsed ordinance. Moreover, not a single judge in the 17-member full court gave any observation which could even remotely be construed to being sympathetic towards the NRO.

The President of Pakistan, Asif Ali Zardari, has assets of $1.5 billion (£920 million) around the world, according to the country’s main anti-corruption body.
A report by the National Accountability Bureau said that the wealth accumulated by Mr Zardari was “beyond his means”. It said Mr Zardari allegedly owned properties and bank accounts in several countries, including Britain, the US and Spain. In 1996 he allegedly bought a $4 million, 355-acre estate in Surrey.
Investigators said that most of Mr Zardari’s fortune was made during his wife Benazir Bhutto’s two terms in office as Prime Minister in the 1990s. They alleged that the money had come from kickbacks and commissions on government deals.
The report was given to the Supreme Court as it deliberated over a proposed amnesty for the country’s leaders.
Mr Zardari had faced six cases of kickbacks and misuse of power that were terminated under an agreement known as the National Reconciliation Ordinance in October 2007.
The amnesty, brokered by the US and Britain, was introduced by former President Pervez Musharraf under a deal that paved the way for Ms Bhutto to return home from self-imposed exile. Ms Bhutto was assassinated just over two months later, leaving Mr Zardari to lead her party to victory in general elections in February 2008 and then become President after General Musharraf resigned in August.
Mr Zardari’s aides dismissed the allegations as politically motivated. Farhatullah Babar, the chief spokesman for the President, said: “Reports of $1.5 billion dollars of national and foreign assets allegedly belonging to President Zardari are no more than regurgitation of a decade old unproven politically motivated allegations.”

I did provide a link from a leading publication from the country and there was not a specific denial from the presidential camp to refute these allegations as yet, the only person who is accusing me of lying is you, not even the president himself.

Of course these are not proven in a court of law because of reasons which are too obvious. Don't you think it is really shameful on your part to support crime against the nation on your part because apart from a deal to give longevity to a dictator who agreed not to persue these charges there is nothing which has been said logically to explain these crimes!
