A 25-year-old waitress who turned down a job providing "sexual services’’ at a brothel in Berlin faces possible cuts to her unemployment benefit under laws introduced this year.

Prostitution was legalised in Germany just over two years ago and brothel owners – who must pay tax and employee health insurance – were granted access to official databases of jobseekers.

The waitress, an unemployed information technology professional, had said that she was willing to work in a bar at night and had worked in a cafe.

She received a letter from the job centre telling her that an employer was interested in her "profile’’ and that she should ring them. Only on doing so did the woman, who has not been identified for legal reasons, realise that she was calling a brothel.

Under Germany’s welfare reforms, any woman under 55 who has been out of work for more than a year can be forced to take an available job – including in the sex industry – or lose her unemployment benefit. Last month German unemployment rose for the 11th consecutive month to 4.5 million, taking the number out of work to its highest since reunification in 1990.

The government had considered making brothels an exception on moral grounds, but decided that it would be too difficult to distinguish them from bars. As a result, job centres must treat employers looking for a prostitute in the same way as those looking for a dental nurse.

When the waitress looked into suing the job centre, she found out that it had not broken the law. Job centres that refuse to penalise people who turn down a job by cutting their benefits face legal action from the potential employer.

“There is now nothing in the law to stop women from being sent into the sex industry,” said Merchthild Garweg, a lawyer from Hamburg who specialises in such cases. “The new regulations say that working in the sex industry is not immoral any more, and so jobs cannot be turned down without a risk to benefits.”

Miss Garweg said that women who had worked in call centres had been offered jobs on telephone sex lines. At one job centre in the city of Gotha, a 23-year-old woman was told that she had to attend an interview as a “nude model”, and should report back on the meeting. Employers in the sex industry can also advertise in job centres, a move that came into force this month. A job centre that refuses to accept the advertisement can be sued.

Tatiana Ulyanova, who owns a brothel in central Berlin, has been searching the online database of her local job centre for recruits.

“Why shouldn’t I look for employees through the job centre when I pay my taxes just like anybody else?” said Miss Ulyanova.

Ulrich Kueperkoch wanted to open a brothel in Goerlitz, in former East Germany, but his local job centre withdrew his advertisement for 12 prostitutes, saying it would be impossible to find them.

Mr Kueperkoch said that he was confident of demand for a brothel in the area and planned to take a claim for compensation to the highest court. Prostitution was legalised in Germany in 2002 because the government believed that this would help to combat trafficking in women and cut links to organised crime.

Miss Garweg believes that pressure on job centres to meet employment targets will soon result in them using their powers to cut the benefits of women who refuse jobs providing sexual services.

"They are already prepared to push women into jobs related to sexual services, but which don’t count as prostitution,‘’ she said.

"Now that prostitution is no longer considered by the law to be immoral, there is really nothing but the goodwill of the job centres to stop them from pushing women into jobs they don’t want to do.”

Disgusting. Poor women are between rock and hard place, why is it that women seem to be suffering either thru taliban or thru such laws?

On a more serious note - this looks like another bureaucratic stupidity. They never realised that 2 individually good laws can occasionally combine to form a bad situation. I still remember the fiasco of Indian babus when the morons officially provided passports with 20 years validity. It was a move to cut paper costs and
other hassles, but they never intimated other countries ! (At least not all of them).
Result was that some ports of entry allowed passengers with 20 year passports and others deported them. Finally the government rescinded them.

And on top of that this article is more then a few years old. I would not be surprised if the law has changed since. Can the OP please find if this is still the case?

^^ Why should i goto west... I am good enough to make good earnings in my country.. The westerns, most of them do suffer and come back home crying.. lots of stuff on that.. u can google for it...

Now you are admitting that west and that country like Germany can make such stupidity... i guess , u western influnced instead of defending their wrong deeds should stand against it, before it reaches ur house.. or may be westerners are so dumb to notice this, or may be it is personall affair of the state to turn a women into prostitutes....

Isnt there a better way to bring attention to a problem that's essentially a technicality? The title could have easily been "work as cashier or we stop your benefits". Instead the author went for a much more provacative title.

The Pakistanis, especially the ones that have an education and want a bright future for their children, are willing to sacrifice their mediocre livings in Pakistan and run away to any foreign country... lots of stuff on that.. u can google for it.

One reason Pakistan is the mess that is today is because the early generation, the one that enjoyed cheap and high quality education, has run away to the west. Some of Pakistan's best accountants, doctors and engineers are working in foreign countries as taxi drivers, cashiers and handymen and most of them have absolutely no problem with it. The others, the ones that were too poor to afford an education or too stupid and well connected to care, either work in dead end jobs or leech off of family dynasties. Ask a Pakistani "in the west" about the west and 99% of them would say the lifestyle here, as difficult as it may be, is a million times better than the garbage back home.

Speaking from the position of an unbiased onlooker, I cannot see this article being accurate. It assumes that people have no other choice. Consider a clerk as a professional, if there is a job say as a decorator available and the professional clerk does not take this job then the benefits stop? I don't think so.

1) One may need to be qualified
2) One may need to have had prior experience
3) One may need to go to and pass an interview
4) One may need to have the edge to compete with the rest of the applicants

Likewise the only way I see this article being applicable is if a professional seller of sexual services will turn down a position for not being paid enough. Besides if a person really did have to resort to that they would probably do so privately anyway, unless they wanted pimp protection, paid holidays and sick pay.

Then you have the whole other dimension which is of harrassment and rape. Should a person really be forced to go in to such a job, he or she could easily file a law suit under the two headings above, or simply go to work and refuse to be touched and then get sacked and hence back on benefits.

But I agree we are becoming like monkeys and dogs if such things are gaining legal status.

there is no limit to stupidity, i was always against to move out of the country, and if somebody have to do it then it better be planned, and once one have saved enough, he should go back to his home-country to play his role in the development...

But South Asians lack this capability, they are good in pointing fingers that how much backward their country and life-style is, but they would seldom do anything to fix it, it is not they cannot do it, it is they cannot afford to do it, they have to work like a donkey around the clock to get a life-style, which they have no time to benefit from.. ( what is use of Sound System if you gonna spend 10-12 hours in office, and remaining either sleeping or socializing, and socializing also take place because one want to have more contacts to benefit its job)...

Dont tell me that you keep getting job offers even without applying for them..

If such a law exists it needs to be changed, though at times I have felt that getting benefits is not good. People living on benefits would definitely disagree with me here and use this as the reason for not finding a job. Also, people have the power to change the law.

^^ I use to get them in 2006/7, when everything was fine and that was only because i did some deals in Indo-China & MENA regions... most of them were part of the consortium, that's how I know them and they knew my skills... many of my colleagues went and settled their, most of them are looking forward to fly back... it is complicated & greedy world...

the law of any society tells us about the moral values of that particular nation/society/country.. as u rightly said, people can change the law, as laws are their to protect rights... anyway, i guess it is not only Germany who have these kind of laws.. may be there are others who are doing it too...

U are right!!! a job of engineer cannot be giving to a doctor... but if recession is at its worst, an engineer can be offered with a low level job in his sector... i guess same is the case here, she was bartender/waitress, THEY have lowered her job-level with the available one...

I think they totally misused the law. legalisation of prostitution is very much needed, but using such laws to push women 'legally' into the business is wrong. very wrong.

how is the Pakistani lifestyle any different from this? In this day and age everyone works like a dog. No one has time to listen to a sound system. The only difference is people in the west dont have to worry for their family's safety and security day in and day out.

It also helps that the west isn't seeing skyrocketing inflation. Talk to 99% of Pakistanis living in Pakistan and theyll tell you their rupees are becoming worthless. The cheapest bottle of ketchup costs the same for you guys as it does for us. You guys are earning in rupees but living like you have dollars.

Yes, the dream of a easy life in the west was a hoax but it's still a MUCH better life than what's back home.

This article is a farce. No one is pushing women into prostitution. They can go work as cashiers as they want. Heck, go sell newspapers or something.

This is a classic case of a woman chosing to go into prostitution for the easy money (and lots of it) and then blaming society for making her do it.

As opposed to those who think this is some kind of glitch in the system, this is the inevitable combination of two factors that have taken over europe:
a) Socialism
b) Moral nihilism

There is no difference between prostitution and clerical work from the perspective of the state. Furthermore, the state is responsible for taking care of everyone and supporting the downtrodden. Therefore the state can make this support contingent on the person not refusing work, where this work can be prostitution (since prostitution doesnt have a negative moral value). For those who say she can find other work if she doesnt want to prostitute, that is not the point. The only job offer she currently has is prostitution. The state is forcing her to take that, or get no financial support.

This is the inevitable result of a godless society which entrusts all public welfare to an amoral government. Not a glitch. Inevitable.
