Why I believe the restoration of judges is still the most important Issue.

Seeing the ever increasing population of foreigners trying to teach us that may be the judges issue has prolonged for much too long, i decided to put my thoughts on this forum..

First of all the restoration of judges IS still a very short struggle and usually as a nation we expect to achieve some noble objective we shouldn’t worry abt the duration of this struggle… I don’t think any noble struggle in the history has achieved its objective within 3 yrs.. So bringing this point is useless..

Second thing is that Justice is the most important pillar… its not abt CJ Ch. Iftikhar.. its abt their stand.. and their stand is simple and straight that no Dictator should be able to fire the judges just for the fear that they will give a honest judgement…

Thirdly we don’t as the supporter of CJ expect him to be a SAINT.. he is definitely not one… as it will be false to expect that Quaid-e-Azam was a saint, he might have made mistakes but in the struggle of the creation of Pakistan he was the best man for the muslims of Subcontinent to support, same is here for the restoration of the Judges, there we should support this struggle, there might have been people take their own petty interest, so did many people in the struggle of Pakistan but the general people are still honest and true to the cause and that matters the most…

Fourth, the judiciary is for the check and balance system, and the check and the balance of everyone and everything, so there shouldnot be restriction on this thing…

Fifth, i agree, there r many other issues also lingering in Pakistan but as for a student during any particular subject final the most important issue is to study for that exam whether after a week there is his surgery.. and while studying you keep doing other important basic task so we can continue handling other issues too but the most important issue which WE CAN handle is the restoration of judges. it means that there will be some regulation and some check balance in other part of the govt organization and it will have a positive effect for the people of Pakistan in all walks of life… it provide a sense of security that justice is within their grasp and it will be honest…

Lastly Remember i m not gonna reply back, if you agree its good, if u don’t its even better and if u want to harp on ur string then its best. cuz in the last two case i will know i will know that ur allegiance is not with pakistan and you don’t want to see Pakistan rising above rest of the competition.

last just in keep in mind that Quaid was the biggest supporter of hindu-muslim unity, but he turned out to be the biggest blessing for us, and similarly Umer Farooq (RA) was the biggest enemy of the Prophet and now his rule is regarded as the benchmark for everyone… So definitely Ch. iftikhar is coming from a PCO background himself, but in his tenure he has shown lot of honesty and truthfulness and now we shouldn;t be judging him on some of his past actions..

Agree Law and Justice should be one of the most important pillars of a nation....

But not a corrupt CJ, especially when he has paid no interest in respecting the stability & security of the country.

Iftikhar Ch opposed to legitimising PCO judges

ISLAMABAD - Deposed Chief Justice Iftikhar Muhammad Chaudhry is seriously considering not to accept his restoration through legal package which is not only going to cut his tenure but would also authenticate those ‘brother judges’ who had taken oath under Provisional Constitutional Order (PCO) in the wake of November 3 extra-constitutional acts of President Pervez Musharraf.
Sources close to deposed Chief Justice of Pakistan have revealed that not only Justice Iftikhar is unhappy over the restoration plan through legal package but many other deposed judges have also conveyed him their resentment over such a proposal jointly crafted by ruling coalition under the nose of senior constitutional experts.
Besides Chief Justice Iftikhar Muhammad Chaudhry, eleven other apex court judges also refused to take oath under the PCO of President Pervez Musharraf after the events of November 3 when the ruling regime suspended Constitution, imposed emergency and promulgated PCO to refurbish the Supreme Court of Pakistan.
Against such a large majority, only five judges of the then apex court took oath under the PCO.
Justice Rana Bhagwandas, Justice Javed Iqbal, Justice Sardar Muhahhad Raza Khan, Justice Khalil-ur-Rehman Ramday, Justice Falak Sher, Justice Mian Shakir Ullah Jan, Justice Tassaduq Jillani, Justice Nasir Ul Mulk, Justice Raja Fayyaz, Justice Chaudhry Ejaz Ahmed, Justice Syed Jamshed Ali and Justice Ghulam Rabbani were the judges who refused to take oath under the PCO.
Sources close to deposed Chief Justice Iftikhar Muhammad Chaudhry have further said that besides majority of the deposed judges, several other characters closely linked with the movement for restoration of deposed judiciary are against the idea of accepting the legitimacy of PCO judges.
Pakistan Bar Council (PBC) and several other senior leaders of lawyers community including former Chief Justice Saeed uz Zaman Siddiqi and Justice Wajih Ud Din Ahmed have already opposed the idea of restoring deposed judges at the cost of legitimizing PCO judges.
“The deposed judges are fearing a massive backlash from lawyers community, media and civil society if they deviate from their previous stance that the PCO was illegal and taken oath under it was sin”, sources also revealed.
Many of the deposed judges have requested Chief Justice Iftikhar not to bow down before any such a plan as it would not only tantamount to contradiction of the stance of pro-deposed judges quarters but would also negate the seven-member bench court ruling that directed the judges to refrain from any such illegal order, sources privy to such deliberations further said.
Despite all the resentment from the deposed judges and legal fraternity, not only President SCBA Aitzaz Ahsan is so far silent on the plan to protect the PCO judges through legal package which would also give new life to deposed judges, but PML-N had also started adopting a new line.
In accordance with the day-one statement of Asif Ali Zardari, Co-chairman, Pakistan People’s Party (PPP), both the N-League kingpins, Nawaz Sharrif and Shahbaz are now openly supporting the idea of protecting the PCO judges through legal package.
Earlier, PML-N was not ready to accept the PCO judges while considering them ‘illegitimate’ and was seeking restoration of deposed judges through a resolution in the National Assembly instead of any package.
Attorney General for Pakistan, Malik Muhammad Qayyum on the other hand sees no harm if the deposed and PCO judges both work together.
“These judges could work together if the deposed judges are restored through any constitutional amendment and it would be quite constitutional,” Qayyum said while commenting on the issue.
