U'll definately have difficulties there, the only reason u can get him out is if he's not abiding by the terms of his tenancy or not paying his rent. The loophole for not paying rent, is that when u take him to court, if he can claim to pay you the money then there's not really much u can do but accept the money. Is that what he keeps doing?
But i'm sure if u employ a really good sol u'll get him out
