In the missing persons case hearing the Mr. Justice Javed Iqbal about two months back remarked that the SC can not march on the wishes of the people or the media. These were the real cruel words. I am 83 retired. I did not know what or who the Chief Justice of Pakistan was and who were the Chief Justice of Lahore High Court or any other court. When on 21 July 2007 the TV channels repeated telecasts that the Chief Justice had been removed even then it did not attract my attention or any interest. The only and the first time I opened my ears and was forced to gaze the screen seriously was when I heard that the advocates had surrounded the house of the chief justice and that this was the chief justice listening the case of missing persons. In the next two three days people like me even my 8th class old wife knew that the chief justice was removed for the main reasons because he was with determination hearing the missing persons case which the America did not like at all. This created a real respect for the chief justice. The comments of old colleagues in the street were almost the same concentrated on one main issue that the chief justice despite pressure was listening missing persons case and had saved the steel mills. The SC recently directed the Petitioners to trust the new Missing Persons Commission now dealing the case. The SC however did not give any assurance to these hapless aggrieved petitioners enabling them to “manufacture” the advised trust that the Commission will not have as its members Jamshed Dastis, Nazir Jats, Riaz Shaikhs. The CJ took suo moto notice of police torture in public by Chiniot police. The LHC CJ takes suo moto notice against Misri Shahah Police. Did these suo moto actions produce any real result and is anyone in the police afraid of such notices? The answer is very simple and the self explanatory from the other day beating by Faisalabad Police a lady who came to register a theft complaint. The CJ takes suo motor notice of deadly skin disease in Lundi Khosa village. The CJP takes suo moto notice “action” against Talibans. The CJ takes suo moto against corruption in LNG Tender, what the nation in practical got in turn. In April 2010 LHC took suo moto notice and barred unscheduled load shedding. Has the load shedding in Punjab or more specially in Lahore reduced. The Attorney General who resigned recently met the Chief Justice Mr. Iftikhar Choudhry in Karachi. A detailed report with photograph appeared in all newspapers. Though the newspapers did not indicate yet it could safely be taken that the meeting was held in the Karachi Office of the Chief Justice or in his residence/rest house. What was the photograph of Benazir Bhutto doing on the table of the Chief Justice and what message was it was to give to the nation? The most and highest respected Dr. A. Q. Khan in his article on 12/4/2010 “This land has been looted hundreds times” writes that as far as poor masses are concerned they are puzzled if “really” any change in the judiciary has come. Columnist Rafiq Dogar on 21/4/2010 in his column referring to Chief Justice’s poetry verse that “the dark night had after all to finish, today every Zaalim shivers from the name of black coats”, question has any practical “ray” of light from that new born “noor” reached to the ordinary man yet. The well read columnist Dr. Ajmail Niazi in his column “Bogus Degrees, Bogus people” writes that by giving relief (option to resign from MNA seat or proceed with the case) the Court has in fact “given us pain (takleef) ”. He very wisely questions that the disgraced Dasti had again been given the election ticket is this not a contempt of court. The Chief Justice the other day rejected appeal of one convicted on contempt of court charges that if his sentence is cancelled then all others will start contempt. Is this not a contempt on the face of the court that PPP has shown the court by awarding ticket to Jamshed Dasti that it has more power than the Court. A column in daily Nawaiwaqt of 3/5/2010 entitled “Syed Gilani ka Ikhtram-e-Adlat” refers to a remark by a judge “for its freedom grateful from Umrah-Jati to Aiwan-e-Sadar judiciary”…. Salim Saffi the other in his column says “let alone the common man, even the most emotional advocate Ali Ahmed Kurd too had become the most disappointed from Mr. Justice Iftikhar Mohammad Choudhry. A very meaningful and a very nice column recently appeared from the columnist Saeed Minhas. He tells how the Advocates Heroes of the 2 years marvelous struggle with their rightly earned glory today are engaged in their professional duties. He cites how due to this struggle the case of Haris Steel Mills has gone from one hero to another. Another hero has charged a fee from one client at Rs. 50 million but declared it as Rs. 4 million. One ex-judge-turned advocate hero is charging similar large figures for defending the Steel Mills etc. The columnist raises a very meaningful point namely that was the struggle for the personal glory or for the strength of the judicial system? He further writes that whilst some heroes out of their real hard struggle have achieved “glory” yet no body remembers or talks about 100 plus those ordinary people from the masses and the ordinary advocates who lost their lives during this struggle eg the advocates burnt alive in Karachi, 12 May 2008 killing while stopping the deposed CJ at Karachi airport, advocates/people injured in Islamabad clashes, Lahore bomb blast during advocates march etc. He particularly mentioned the name of Dr. Saeed Khurishd the former Civil Judge who resigned in protest and lost his both legs in Islamabad protest march blast. Reading of the column enlarges the heart of hapless people like me when it comes to the lines that Dr. Saeed was later offered a big job which he refused on the ground that his struggled was not for personal glory rather he resigned on a matter of principle. Still such people live amongst us, ALLAH!! The columnist finally raises a vital question that if all this struggle was to strengthen the personal glory (of whom!!!) then what would happen after 2013 when the Justice Iftikhar Choudhary will retire. Many similar meaningful voices have of recently arisen out of which two were from the top columnists and an anchor writer who in the dotted lines expressed that how strange it was that today the fullest concentration is on NRO and issues circling around it forgetting the most important cases namely the missing persons. These voices raised a very meaningful genuine question that while full bench and large bench were formed for NRO why the full Bench was not formed in case of missing papers. SC fixed the sugar price at Rs 40/-. It is today not available at Rs. 70/-. What did the SC? Thousands and thousands of mobiles are snatched every month even causing some deaths through out the country. In order to remove the real cause of it so far our new born dear SC has taken not suo moto action enquiring from the mobile companies why they were not blocking the stolen mobiles which blocking would end the easy earning element form this snatching lucrative business. Just as a strategy PPP and its cronies have manufactured that it would not allow trial of grave of Benazir, “judicial murder” of ailing Nusrat Bhutto etc. How strange is that same SC or the Chief Justice took notice of and the Ministry of Interior representative had to apologize in the court when CJP showed his anger as to why old Nusrat Bhutto was summoned to come to the Court. Did the same SC or CJP did not see how many hundreds too old, fragile, sick, too poor to afford proper conveyance keep coming to attend hearings daily all over Pakistan in courts, keep sitting on open grounds but only and only to hear about adjournments. Rangers recently abducted in Lahore a policeman on duty on the orders of son of DG Rangers. An FIR was lodged and under the carpet of “independent investigations” the case was brushed under the carpet since culprit was heir of a big gung/. The number plates LWR-7275 both were fake. Earlier a similar incident took place in Islamabad which also was reported to the Ministry of the Interior. A similar incident was registered on May 23, 2009 in Islamabad when the Rangers used similar powers, their vehicles plates were found bogus and a case was registered with Islamabad police. Recently Lahore DSP on TV alleged he was being pressurized to release the dacoit. He was suspended, arrested and beaten on the ground of violating administrative discipline. Upto that the matter might be administrative but what the nation saw with utter shock was that the hand-cuff accused which the nation saw on TV on of whom saying it was his first criminal attempt, after the arrest of DSP were released and this then became a more heinous criminal case of larger community interest and most badly needing a suo moto notice. Saleem Safi another senior journalist while telling how our rulers and leaders all have their businesses and Mahals in Capital No. 3 of Pakistan “Dubai”, and who was “in” and “out” during Salim’s short stay, wished when would the SC take a suo moto note of banning that those who can not bring their money property in Pakistan, can not teach their children in Pakistan are barred from entering into the parliament to loot us. The columnist Salim Saffi has raised a very important point that whatever may be the system of appointment of judges this is of no importance to the common man. As a judge who ever may have appointed him he only delivers justice. A middle aged man missing since 2003 was recently brought to SC on stretcher. SC sent him to hospital. The job which the new born SC should had done viz enquire from him from where he came, where he had been for 7 years, who brought him etc, make the information public and then seriously start marching on the basis of information gained as this information was a gateway towards the mystery if these people actually go for Jihad as Musharraf said or elsewhere. But our new born judiciary looked the other way by allowing a commission to deal with the matter despite knowing Commissions all the word means “killing the matter slowly”. How strange is when the “people and media” were marching in fact hand pushing forward collectively the petrol-empty “judicial bus” the passengers like Justice Iqbal felt the worth of both but as soon as the “new birth” completed “the push forward” of these two forces has no weight in the eyes of Justice Javed Iqbal. There is no denying that the fact and the whole truth that the people (the word people including the black coats) and the media provided the whole and full energy to resuscitate the judiciary in coma. The new born judiciary has in fact delivered nothing to the nation so far except for NRO related matters. The real matters on which its suo moto notices were genuinely required like small aged students waiting hours to welcome the foreign visitors, silent release of arrested dacoits etc have been left. The new born judiciary by offering an option to Jamshed Dasti did not show its honest independence. It thus cared for the status of the accused. A retired army officer on this recently wrote that a 9th class student was punished for copying in the examination, he being poor was not given an “option” to surrender his said examination paper or proceed with law process.
