US visit Visa during immigration process

If someone is going through US immigration process, has had interview but waiting for teh background check to be completed, could that come to US on a visit visa during that period? what if they are from one of the visa treaty countries like UK

anyone know.

Thanks

Re: US visit Visa during immigration process

No there is no such Visa treaty. An Individual has to wait until his/her process is done back home.

From my limited knowledge, i would say no because an entry as visitor supposedly forfeits the 'change of status' process. If this is imp. you should consult an immigration attorney for sure, they'll charge around $200-250 for a half hour phone call I think, but give you a safe answer with peace of mind.

These are visa waiver countries. People get a 3 month visa waiver on landing in the USA.

Re: US visit Visa during immigration process

People I know who live in Canada and have a multiple visit visa come and go as their 'immigration process' also goes on. I am not sure what happens once it reaches finger printing etc. process.

Yeah but if you're on a visa, and goto a Canada, you arent required to submit the I-94, and get a new one on the way back, if its less than 30 days right?

Re: US visit Visa during immigration process

^ You do as far as I know.

Re: US visit Visa during immigration process

I would doubt it..honestly, it's more of your ethnicity than it's of the country that you are coming from.. Other factors could be age and gender.. young and male.. chances are slim!

not for me, I am a brit and yank simultaneously.

its for someone else who is a UK citizen, has been to US numerous times on visa waiver, had immigration ointerview and just waiting for background check to be completed.

I think that once u have your interview date from that point onwards you can not come to US, thats what I remember.

Obviously it is an issue for ppl who have to be here for business trips and cant because of this stuff.

Re: US visit Visa during immigration process

Early this year, my bro was also waiting for the background check for his imigration process to be completed and the officials at the US Embassy told him not to travel as that might effect the background process and take longer.

So if that person doesn't have any emergency situation then s/he should just wait for the process to be completed.

Re: US visit Visa during immigration process

not to travel anywhere or to USA

Re: US visit Visa during immigration process

^ im pretty sure its just the US... I know someone who travelled to dubai from pak a few times... and his thingie went through smoothly

Re: US visit Visa during immigration process

^^ yeah.. US!

They need L1 Visa (if they work in a Multinational company, with or without blanket protection). This is a dual-intent visa that allows them to apply for sponsered immigration whenever and still enter and leave US, Or apply for Green card after working in US for a year.

Self business owner don't have option I guess.
