US spouse Visa

Assalam o Alaikum everybody,

I am new to the forum and there is some help I seek:
a) My wife is a US national, basically of Pakistani origin wants to file a petition for me, she does not have a NICOP (Nat ID card for overseas Pakistanis, Will she be needing it?
b) Over Nadra Marriage Certificate, it is stated that her Nationaliy is Pakistani (American isn’t mentioned), Can that be a problem?
c) She is a student, would that be a problem? I mean, she doesn’t have a full time job.
d) Apart from English translation of Nikah Nama and Birth Certificate, what else would I be needing?
e) I was born in Quetta and I spent most of my life here in Lahore(did my matriculations from Lahore and on my ID, my permanent address is that of Lahore), I went to my hometown when I was 5, so from where would I have to get my birth certificate issued i.e. Quetta or Lahore?
f) My dad isn’t dead but I don’t have any record of him whatsoever i.e. Id card etc (his id card number isn’t even mentioned on my CNIC card) I only have his name affiliated with me, he kinda lost contact with us in 2000 and possess a criminal record too in ‘90 Can that be a problem?
g) Estimated waiting time?

a) She is a US national how? Is she a citizen yet?
b) That might be a problem. She needs to show it on the Nikah nama if she is an American Citizen.
c) It could be but as long as there is someone in her family or friends that could take financial responsibility for you, it shouldnt be an issue.
d) At the time of filing that is what you would need but as the case progresses you will need some other things such as your police report and medical report (both of these will be asked once the case is transferred to the embassy)
e) Quetta.
f) They wont care much of your dad as long as you have a valid passport.
g) Depends on the admin process. Could take anywhere from 9 months to 3 years.

yes she is a US citizen. She was 16 when she went to states.

She came to pak after getting the pakistani visa stamped on her US passport

I think there are no issues. just follow the process. The spouse visa doesnt take long (about 3 months). The only issue is that if she is a student, how will she sponsor you ? This can be done by her Family co sponsoring. Have her family hire a lawyer here in US to manage process. you should not have any issues. You will need your Birth Certificate. Regarding your Father, sorry to hear. However, in US visa process, birth certificate is only required item. Pakistani Nicop etc has no place in the process from US side. and Yes you will need evidence of Marriage with Marriage certificate. You will get a two year conditional and you will get interviewed in two years again. Good luck. All will work out.
