GENEVA: The United Nations endorsed the rights of gay, lesbian and transgender people for the first time ever Friday, passing a resolution hailed as historic by the US and other backers and decried by some African and Muslim countries.

The declaration was cautiously worded, expressing “grave concern” about abuses because of sexual orientation and commissioning a global report on discrimination against gays.

But activists called it an important shift on an issue that has divided the global body for decades, and they credited the Obama administration’s push for gay rights at home and abroad.

“This represents a historic moment to highlight the human rights abuses and violations that lesbian, gay, bisexual and transgender people face around the world based solely on who they are and whom they love,” US Secretary of State Hillary Rodham Clinton said in a statement.

Following tense negotiations, members of the Geneva-based UN Human Rights Council narrowly voted in favour of the declaration put forward by South Africa, with 23 votes in favour and 19 against.

Backers included the US, the European Union, Brazil and other Latin American countries. Those against included Russia, Saudi Arabia, Nigeria and Pakistan.

China, Burkina Faso and Zambia abstained, Kyrgyzstan didn’t vote and Libya was suspended from the rights body earlier.

The resolution expressed “grave concern at acts of violence and discrimination, in all regions of the world, committed against individuals because of their sexual orientation and gender identity.”

More important, activists said, it also established a formal UN process to document human rights abuses against gays, including discriminatory laws and acts of violence. According to Amnesty International, consensual same-sex relations are illegal in 76 countries worldwide, while harassment and discrimination are common in many more.

“Today’s resolution breaks the silence that has been maintained for far too long,” said John Fisher of the gay rights advocacy group ARC International.

The White House in a statement strongly backed the declaration.

“This marks a significant milestone in the long struggle for equality, and the beginning of a universal recognition that (lesbian, gay, bisexual and transgender) persons are endowed with the same inalienable rights — and entitled to the same protections — as all human beings.”

The resolution calls for a panel discussion next spring with “constructive, informed and transparent dialogue on the issue of discriminatory laws and practices and acts of violence against” gays, lesbians and transgender people.

The prospect of having their laws scrutinised in this way went too far for many of the council’s 47-member states.

“We are seriously concerned at the attempt to introduce to the United Nations some notions that have no legal foundation,” said Zamir Akram, Pakistan’s envoy to the UN in Geneva, speaking on behalf of the Organisation of the Islamic Conference.

Nigeria claimed the proposal went against the wishes of most Africans. A diplomat from the northwest African state of Mauritania called the resolution “an attempt to replace the natural rights of a human being with an unnatural right.”

Boris Dittrich of the lesbian, gay, bisexual and transgender rights program at Human Rights Watch said it was important for the US and Western Europe to persuade South Africa to take the lead on the resolution so that other non-Western countries would be less able to claim the West was imposing its values.

At the same time, he noted that the UN has no enforcement mechanism to back up the resolution. “It’s up to civil society to name and shame those governments that continue abuses,” Dittrich said.

The Obama administration has been pushing for gay rights both domestically and internationally.

In March, the US issued a nonbinding declaration in favour of gay rights that gained the support of more than 80 countries at the UN. In addition, Congress recently repealed the ban on gays openly serving in the military, and the Obama administration said it would no longer defend the constitutionality of the US law that bars federal recognition of same-sex marriage.

The vote in Geneva came at a momentous time for the gay rights debate in the US. Activists across the political spectrum were on edge Friday as New York legislators considered a bill that would make the state the sixth — and by far the biggest — to allow same-sex marriage.

Asked what good the UN resolution would do for gays and lesbians in countries that opposed the resolution, US Deputy Assistant Secretary Daniel Baer said it was a signal “that there are many people in the international community who stand with them and who support them, and that change will come.”

“It’s a historic method of tyranny to make you feel that you are alone,” he said. “One of the things that this resolution does for people everywhere, particularly LGBT people everywhere, is remind them that they are not alone.”

Because homosexuals are born that way, and condemning them for expressing themselves as god made them is as unjustifiable as condemnong someone born with any sort of anomaly or difference, that they didnt choose for themselves. one would condemn you because your a hateful bigot.And you also make the dumb claim that its kufar. Stupid thing to say considering homosexuality is common in all groups, religions, ethnicity,and even among animals... You dont have to be a Non Muslim to be homosexual, u just have to be human.

If as an example you have cancer you dont say oh i born with this accept it you look for cure to get rid of it. To claim people have dna or gene that make them gay is same as people who claim they have gene or dna that makes them violent or dna gene that makes them criminals it complete rubbish no proof for it whatsoever. Most importantly i judge all matters to what the prophet(saw) said, not what UN or barak obama says so i cannot accept something haram and make it halal and the punishment for homosexuality is death clear and simple so no way it can be accepted by honest muslims.

When someone has cancer, you try to cure them, bcs the cancer is going to kill them otherwise. Homosexuality isnt going to kill u. Secondly, curing someone, assuming they want to be cured is one thing, but condemning someone and denying them equal rights is quite another. If someone is born a particular way, its simply how they are. There is a kind genetic condition associated with violent even criminal behavior. There is also evidence to show that the minds of sociopaths are actually wired differently from normal people. Your comparison also fails because while anger can lcause violence, homosexuality in itself is not.harmful to anyone else. We prosecute people with anger problems not because of their temper, but because their temper caused them to harm another.I think u misunderstood what the.prophet said. If it were a sin, God wouldnt have created them that way.I base my conclusion on understanding and compasion. where is your proof the argument of the gene and dna have been debunked using the example of the violence dna/gene was just an example of the ludicrous argument used previously it has 0 scientific backing. what do you have to back up your claim is it your leg? secondly the ruling in islamic state is death penalty for anyone caught doing homosexuality in public the prophet (saw) was clear cut on this matter for you to say there is misunderstanding or ambiguity you have not even bring one evidence to back your claim. But just because someone is homosexual doesn't mean they commit sinful acts, for someone to feel an attraction to a person of the same sex is not a sin, for them to act upon it is, however society does not look at this and condemns homosexuals regardless of whether they commit the sin or not. Regarding the third sex in Pakistan there was a BBC documentary that showed a lot of the 'khusray' had deformed genitalia, some as a result of birth defects and others were victims of malicious crimes in the same way people will cut off children's limbs to get them to beg and will later collect the money from them. For there to be no rights for these people, for them to only be able to dance to earn a living and be condemned and shunned by everyone is truly disgusting.

As strict as some Islamic rules are it is also a very just and kind religion, for anyone to take someones rights away without a proper trial is wrong, no one but a judge can rule whether the person should be punished or not.

We need to realise that homosexuality or transgenders aren't always choices made by people, there are children as young as 4-5 who are transgenders, to me that is most likely a genetic trait, without evidence that this isn't a genetic trait you cannot convict someone. Have some humanity people, countries like Iran which have a strict implementation of Sharia law allow sex change operations if the patient is physically 'diseased', each case is regarded separately, for us to make a general statement encompassing everyone regardless of the person's situation is completely wrong.

Also as far as physical evidence of DNA goes, there is no physical evidence for many psychological problems, science is still progressing, we cannot make a judgement without sufficient information.

Its beyond me how otherwise well meaning people can study Islam, and all they take away from it are the parts that pertain to sin, who is commiting it, how they should be punished etc etc. Its all about punishment, or some form of oppression or another in guise of Islam. People like this Javaidmianded may have studied Islam, but all he got out of it is hate. People like this one, think dehumanizing homosexuals and non muslims is prerequisate to being muslim.How about all that stuff about compassion and love? Or did u decide to skip those parts?

when a matter is decided by islam who am i or you unless you secular or non muslim to disagree with it?

The point being if somebody in islamic state commits homosexuality and its proven in court you know the penalty it is death, no question same with adultery if proven in court whoever commits adultery no doubts about judgment what will happen next.

Being born with deformed genitalia as you mentioned is not a crime and is not part of this topic. The subject is in islam is homosexuality permitted and very simple answer is no, if you have evidence to proove me wrong welcome to publish it.
