Justice triumphs at last. David Hicks is one step closer to be able to receive the British citizenship he’s entitled to as the child of a born Briton - and the British government will most likely soon be forced to act to have him repatriated to Britain. All of the other British citizens at Guantanamo were repatriated and freed since there is no evidence against them.
Shame on Australia, that in order to be able to enjoy freedom, one of its citizens must swear his loyalty to another country instead.
The home secretary has failed in an attempt to strip an Australian terror suspect held at Guantanamo Bay of his right to British citizenship.
A solicitor for David Hicks, 30, said British diplomats would now have to lobby US authorities for his release.
Mr Hicks, a Muslim convert, was captured in Afghanistan in 2001.
The Court of Appeal upheld a High Court decision that there was “no power in law” to deny him his claim for British citizenship.
Born to a British mother who emigrated to Australia, Mr Hicks is from Adelaide. He sought a UK passport in the hope of securing his release.
Britain has managed to get all nine of its nationals held in the US base released.
This was after the UK government complained that the system there failed to uphold basic standards of international justice.
Re: UK Govt loses Guantanamo citizenhip case; now forced to support Australian detainee
The Australian press have reported that even though it's not final as to whether he'll be allowed British citizenship, Britain's embassy in Washington has already submitted a request to allow a representative of the British Government to visit Guantanamo Bay to administer the oath of citizenship.
The USA has refused to allow that.... so this should be interesting.

This guy gave up citizenship when he decided he was going to Afghanistan and fight a jihad. Anyway, he can do whatever he wants...he is on the list to be tried. I bet his status does not change, he stays locked up. This is what he wanted, the cost of jihad...now he is paying it.
Unlike Arabs in Gitmo, Americans have little sympathy for an Anglo. He spend the rest of his days in jail.
