They have come to a settlement already.. Katie will be getting sole custoldy of Suri (Tom had said he wanted joint custody up till now)..
Makes me wonder what he and/or the Scientologists are scared of coming out..

Katie knew he was a scientologist when they married. She knew what she was getting into. She also "audited" or what ever it is that they do. Basically she walked into it with her eyes open. 5 years later she doesnt want suri to have anything to do with Scientology and wants a divorce. If the issue was spousal abuse, then there is something to it. But if I remember correctly, she was pregnant when they married so she ought to have some idea that she could not isolate her daughter completely from that aspect of Tom's religion after marrying him. I am not a legal expert, but can the courts grant her sole custody based on the fact that she now wants to raise her daughter as a catholic ? I mean Tom has his rights too...

^I don't think she knew fully what she was getting into (esp as scientology involves stages or tiers).. I think as time went on and she got more deeply involved and her environment became so controlled (there were reportedly only scientologists working in the home) she became more skeptical and then to the point where she wanted out..
She wouldn't get sole custody just because she wants to raise Suri as a Catholic, there would need to be more to it.. For Tom to go from wanting joint custody to agreeing to Katie's demand there is prob something else going on behind the scenes.. Why would he back down on something so major?

From Katie's part, looks like this whole divorce was planned like a military operation. You don't get a divorce from Tom Cruise overnight and get a full custody of Scientology's precious little future star- their daughter Suri- within a week. Of course it helps when your father and brother are both lawyers, but the fact that he gave in without putting a contest only suggest that Katie has some real crap on him and she planned this thing long and hard.

There are reports that Hollywood's big cats advised Tom to keep his reputation 'clean' and they'll be on his side while the church obviously wanted him go after Katie. I'd imagine Scientology is not the main culprit here, Tom had to reach an immediate settlement and give Katie whatever she demanded to keep the 'family secrets' behind closed doors.
Him being in a middle of shooting a movie and more movies coming out now and in near future, Katie chose the perfect timing to play her cards. He simply can't afford to get involve in an ugly and very public divorce and custody battle at this point of his career.
