I think the ppl who call mushy a dictator are too immature and young and have not seen the 90's "democratic" period of lawless, self interest and accumulating wealth of the same politician that they are bloody supporting....

When you are Chief of Army staff, you don't need political capital to impose martial law. You only need force of arms and Musharraf has plenty of that. The reality is that if he wished he could have implemented rule by personal decree, rather than subjecting himself to the laws of Pakistan.

That is the difference between a dictator like Zia-ul-Haq was and a lawful, democratic leader like Musharraf is.

basit mian nobody is supporting politicians nor is musharraf's govt any different from the politicians of the nineties in terms of corruption. infact mushie is pretty much set to form a govt with one of those lawless self interested wealth accumulating politicians pretty soon according to most analysts :)

so youre saying the only other option Musharraf had was martial law. No real credit to his government then, because then his government would be dissolved too. Or are you saying musharraf IS the government, in that case hes not very democratic is he :)

and I dont think he could have imposed martial law and gotten away with it. other martial laws have been ousted by mass protests and civil disobedience, and if the massive protests over just sacking the CJ are any indication, martial law would have been pretty much suicidal.

Everybody have seen that period. No doubt there is nothing speacial bout that period however this Busharraf regime is also no exception. Only a change of president and remaining 80% same ruling politiicans.

Having said that democratic rule is better than military rule for a second.

A 13-member full court Friday declared the decision of suspension of Chief Justice of Pakistan Chief Justice of Pakistan Iftikhar Chaudhry as unconstitutional and restored him on his designation.

What choices did he have, none. The wave of protests against him was too much for him to handle, he did try his hand in Karachi on 12 may and also his attacks on TV stations, in both cases he failed. Nothing more he could have done.

In early days he did everything he could, but few days back when govt lawyers made ass of themselves in court by introducing scandalous documents...justices were pissed to say the least. From then on we knew which was this decision was going.

Plus the subsequent events all caused him to think twice, especially after that lal msjid drama and suicide bombings across the country. Right now this SC decision is actually a good decision for the govt b/c Mushrraf no longer has to worry about lawyers who were pissed at him, too. Now Mushy is going to act like a hero by accepting SC decision & he will say "I'm the biggest democrat on the planet". Just watch..its win win for Mushrraf.

The above statement has been proven correct by the reaction of the government in accepting the court’s decision.

Our former elected civilian leader Nawaz Sharif would have had the Supreme Court physically attacked (as he did in 1997) had the judges made such a decision against him. While our honourable lawyers supporting the CJ had emphatically said they would not accept a decision against their man, and even burn down the Supreme Court!

But President Pervez Musharraf is an honourable man (as presiding Judge Ramday said), and so is Prime Minister Shaukat Aziz in accepting the court’s verdict. This has once and for all proven that Musharraf is no dictator, and he unlike our elected rulers of past and some lawyers, is prepared to accept the decision of the court with good heart. What a man! We need him (as Justice Ramday also said) and long may he continue to rule.

I would still prefer Musharraf over Benazir or Nawaz. The courts will make all leaders more accountable in the future. The decision has strengthened the institution of judiciary which is now better able to act as a check and balance against the executive and other institutions.

Though lots of questions have been left unanswered (which might be addressed in the detailed judgment later) and many question arise after this judgment, I'm happy that the Judiciary apparently prevailed. The benefits of that ought to be reaped by Musharraf in the long run. Ive always said that he's the most democratic dictator who's never used his true dictatorial powers. This certifies it. It wouldnt have been an issue for him to declare emergency and suspend everything but his danda during the chaotic July we've seen. He didnt.

That aside, on the role of the judiciary, atleast under Musharraf it was apparently always more 'azaad' than ever before under previous rulers. This strengthens the belief. And, I just hope the public honeymoon with 'judiciary' is over soon and the scars and wrinkles behind the cosmeticized appearances is bared once again, so people of Pakistan can recall atleast this much, that the judiciary; judges and lawyers, though a pillar that has to be strong and independent, has like many other institutions also never been as angelic as it has been made to appear since March. It may improve, and like Qazi Hussain surprisingly in a smart statement said today, "the judiciary's tests begin now...", I feel they better take charge of their role at grass roots first and address the common man's issues to win real hearts from now on to prove their real worth. Taking on the govt with over ambitious motives shouldn't be the judiciary's primary interest. Primary interest should be pro-active concern for common man's issues; rapes, murder, extortion, kidnap, robbery, property disputes, consumer rights, wadera/influential rule to name a few. Excellent delivery in these areas will bring the actual change in law & order situation and judiciary will be hailed for its boldness and strength. Unfortunately, my paranoia strikes hard because though the present gold plated image of the judiciary makes it seem it's an excellent institution since time immemorial, which is highly untrue, and the cries and voices raised by the sudden flag bearers of independent judiciary i.e all lawyers and legal professionals, seem lies and empty deceptive slogans, because of the poor track record. Being portrayed a messiah, the harsh truth is, it isn't one! This was not just simply always obvious, it was also proven by the duplicity in ideologies, sinister agendas, political,anti-state commentary as well as stirring of social unrest by legal professionals during the four months since March.

Now that it's over, let's hope the judiciary and its members get back to their actual work and show respect, restraint and rationality for national interest, atleast a fraction of how the govt has shown regarding the verdict.
