It is just a coincidence that the Supreme Court was about to decide about dual role but security in the country got so bad that emergency had to be declared.

Oh, and did someone tell you about the similar Lal Masjid coincidence when case against govt/Mushy was about to be heard in Supreme Court, the condition got so bad that army/govt had to take action.

‘Phone call’ that led to emergency

KHURRAM SHAHZAD
ISLAMABAD - A reported telephone call by Justice Iftikhar Muhammad Chaudhry about a decision on the petition of Presidential election prompted the authorities to impose state of emergency in the country.
A government official, when asked about the reasons behind the move, said that Justice Iftikhar reportedly informed one of his friends on telephone that the Supreme Court was going to hand down verdict against President Musharraf, which was tapped by the secret agencies.
The agencies intercepted a call from CJ’s phone few days ago in which he even disclosed the number of judges favouring and opposing this decision, and this forced the top policymakers to devise the emergency plan, the official said.
The official, working closely with one of the Presidential aides, further said that the government took extra time in execution of this plan so as to make it safer.
“They have been holding clandestine meetings for the last few nights, which cost them almost an extra day than the estimated time to execute the emergency plan,” the official disclosed.
“Iftikhar Chaudhry told his friend that eight judges gave their opinion against General Pervez Musharraf, while three others were in his favour,” the official said adding that this information was substantial for secret agencies to take the extreme action of emergency imposition.
Meanwhile, it was learnt that Pakistan People’s Party Chairperson Benzir Bhutto recommended the name of Justice Abdul Hamid Dogar for new Chief Justice of Pakistan.
“The top government quarters took BB in confidence on the issue and she nodded in favour of Mr Dogar,” the official stated.
To authenticate his information, he said that Justice Dogar was appointed by Benazir Bhutto in 1995.
Meanwhile, another source revealed that a midnight crackdown against lawyers’ community was expected on Saturday while the judges refusing to take a fresh oath under new PCO were being put under security house arrest.
He said that all important leaders of the lawyers were also likely to be taken into custody.

It will be interesting to hear from people on paklinks who think that the Court was supporting fanatics. Wonder what they say about the timing of martial law?!

If this is true then all rhetoric by anti-Pak generals about Court releasing fanatics is obviously a lie (which we already know).

This is not related to the whole emergency situation, but why was a chief justice of Pakistan discussing a legal case with his friend on a phone call? that seems very wrong.

and more importantly who was that 'friend' that was getting this behind the scenes info.

Obviously suich a verdict would have had an impact on financial markets, and people who would know if this verdict would have minted rupees.

but tell me should the chief justice of a nation be discussing coming verdicts with his 'friends'. Should any judge by discussing soon to be announced decisions with others?

Not at all. I had noted in the very begining that my inquiry was separate from teh phone tapping discussion, and later when my inquiry was not answered yet the illegality of the phone tapping was instead thrown it, I very openly agreed that the tapping was illegal. On the other hand, no one has answered my question whather it is appropriate for the chief justice to be discussing the outcome of such a critical case (or any judge discussing any yet-to-be-announced decision) with his 'friends'

From what I see, I have made my position clear that if this all is true then indeed the phoen tapping was illegal.

I dont see other making their positions clear that is indeed this all is true, what do they think od the chief justice discussing details of a verdict with his 'friends'

well I agree that phone conversation with "friend" where he talks about upcoming decision is not appropriate, but in the end we are believing in 'agencies' claim that he was talking to a friend about it. We all know that SC building was bugged, may be the agencies didn't want to reveal that info so cooked up a 'phone conversation'?

Judges are human beings, and CJ was not even on the bench, but he may have given his opinion how the justices on the bench were leaning. Thats not uncommon, nor is it illegal unless there is a gag order.

on the contrary, its is uncommon and it is in very poor judgement. and its not opinion, its details of how many judges were for it and how many were against it is the type of information that no one should be leaking.

No its not. This is not inside trading. When the judge is not on a bench he is a private citizen just like you and me. As for details of the judgment, it say nothing about it. Reading from the article we can only guess...most likely he was saying which way the judges were leaning.

first of all thsi was being discussd in supreme court and he was teh chief justice..secondly, if he was saying how many people were for it and how many were opposed it, that sowed he had inside information, and no legal ethics class will agree that a judge in possession of such information should be sharing it.

again, I agree reading from the article we can only guess, thats why i have said from the start 'if this is true' because you and I both know why all that has happened has happened.
