Termination of pregnancy = aka abortion

i am sure that abortion, ot to be politicaly correct, termination of pregnancy is unlawful in islam.
in the UK you can get an abortion done untill 24weeks gestation. does any1 know if abortion in any circumstance is alowed in islam?? like if the baby has got downs syndrom or is a high risk to the mums life?

Jurists have agreeed that abortions are allowed ONLY IF the mothers life in in danger. The reason for this is obvious.

If the mother's life is in danger, then abortion is allowed.

If the baby has or might have a down-syndrome, then abortion is not allowed. Allah is the Sustainer, Provider.

Praise be to Allaah.
There are many causes of deformity of the foetus, many of which could be avoided; one could protect oneself from them or reduce their effects. Islam and medicine both urge people to avoid the causes of disease and to protect themselves against it as much as possible. The teachings of Islam urge us to protect our health and to protect the foetus from many diseases which are caused by ignoring the teachings of Islam and falling into sin such as zinaa (unlawful sexual relationships), drinking alcohol, smoking, and taking drugs. Modern medicine also warns mothers of the imminent danger of taking some medications, or being exposed to x-rays or gamma rays, especially in the early days of pregnancy.
If it is proven in a definitive fashion, beyond any doubt, by a trustworthy medical committee, that the foetus is deformed, and that this deformity cannot be treated by the specialists, then in my view it is permissible to abort it, in view of the difficulties it would face in life and the hardship this would present to the parents, and the burdens and responsibilities of care it would place on the society. These considerations and others prompted the Islamic Fiqh Committee of the Muslim World League in its 12th conference held in Makkah on 15 Rajab 1410 AH (10/2/1990 CE), to issue the statement that “it is permissible to abort a foetus which is deformed in the manner mentioned above, with the consent of the parents and within the first 120 days from the beginning of the pregnancy.”
The decision of the committee was in accordance with the fatwa of the Standing Committee for Academic Research and Issuing Fatwas in the Kingdom of Saudi Arabia, no. 2484, issued on 16/7/1399 AH.
But if the soul has been breathed into the foetus and it has completed 120 days, then it is not permissible to abort it, no matter what the deformity, unless continuation of the pregnancy would put the mother’s life in danger. This is because after the soul has been breathed into the foetus, it is considered to be a person who must be protected, regardless of whether it is free of disease or not, and regardless of whether there is hope of recovery or not. That is because Allaah has a reason for everything that He creates, which many people do not know, and He knows best what is right for His creation, as Allaah says (interpretation of the meaning):
*“Should not He Who has created know? And He is the Most Kind and Courteous (to His slaves), All Aware (of everything). *

In the birth of these deformed children there is a lesson for those who are of sound health, and it teaches us of the power of Allaah Who shows His creation the manifestations of His might and the wonders that He has created. Killing and aborting them is a purely materialistic view which pays no attention to matters of religion and morals. Perhaps the existence of these deformities will make people more humble and submissive towards their Lord, and make them bear them with patience, seeking a great reward from Him.
Physical deformity is something that Allaah has decreed for some of His slaves. Whoever bears that with patience will attain victory. This is something that happens and has always happened throughout history, but unfortunately studies indicate that the rate of physical deformity is increasing, as the result of pollution of the environment and the increase of harmful rays in the atmosphere, which was previously unknown.
It is by the mercy of Allaah that many deformed foetuses are miscarried or die before they are born.
The Muslim woman and the Muslim family must bear with patience whatever happens to them, and seek the reward for that with Allaah. And Allaah knows best.

^^ is it true that after 120 days that an Angel is sent down to blow the breath of life into the fetus? is this why one should not abort after 120 days?

The holy Quran spells out the stages of human development, and it is when the rouh enters the body when life begins, just like we all know the end is when the rouh departs and goes back to the source of all life. Allah Sub hanahu wa Taala.

but the pill works in the same way as abortion, it does not allow the implantation of the fertilized egg.

therefore my question is that, when does life begin? if it begins with the sperm uniting with the egg, then the contraceptive pill is ending life!!!??

^^ please review the questions from the link I posted above. It should cover contraception by way of bc pills..
other contraceptives which are used as exterior means on male and females organs are more closer to what the sahabah practiced "azaal" or "coitus interuptus"- and to that Prophet SAW is reported to have said to the effect: pregnancy can happen even if it drops on a rock...meaning that only Allah is the one Who will give life or limit it.

by the time you find out you are pregnant the egg has already been fertilized.....abortions take place AFTER this happens.

the pill prevents this fertilization process from happening in the first place...so how are u ending life? the sperm nvr reaches the egg when taking oral contraceptives.

any method that acts AFTER the egg has been fertilized is not allowed.....if you are referring to the morning pill( ? ) ....then no it isnt allowed because it prevents the implanting of a fertiilized egg into the womb.

So from the Islamic prespective....once fertilization takes place....it is not permissible to have an abortion. Unless there are medical reasons.

yes i am speaking about the cotraceptive pill which women take every day and this prevents the FERTILIZED egg from implanting. this is the most common form of contraceptive used in the western world today. is is legitimate in islam?

i only want to know if a bunch of cells in the uterus are considered "life" or not? as the pills does not let these cells inpland and develop into a fetus.

first of all....women take contraceptive pills to inhibit the release of the monthly egg from the ovary...therefore preventing fertilization. If the egg isnt released then it cant be fertilized.

I think perhaps you are misunderstanding the way the birth control pill works...because you said above that that birth control pill prevents a FERTILIZED egg from attaching which is false.

to answer your question.....the birth control pill is permissible in Islam because this method is used BEFORE fertilization takes place. Any method that is used AFTER fertilization takes place is not permissible.

Abortion and the termination of pregnancy is the expulsion of a foetus from the womb of a woman. This may either be by consuming of certain drugs or by emptying the womb through the process of suction.

Life is sacred:

Islam regards human life sacred. Allah Most High says:

“And verily we have honoured the children of Adam” (Surah al-Isra, V.70).

It does not matter where the life exists. Whether the life is extra-uterine or intra-uterine, its location has no significance on its sanctity. This sanctity applies not only to human life, but to the human body as well. Hence, according to Shari’ah, the physical body of a human after death is just as sacred as it was before death. The degree of sanctity of life is greater than that of the body. This is one of the reasons why it is unlawful (Haram) to consume the meat of a human, dead or alive.

The Shari’ah ruling on abortion:

Abortion can be divided into two stages:

a) Abortion after the soul (Ruh) enters the foetus

b) Abortion prior to the entry of the soul in to the foetus

Before mentioning the ruling on abortion with regards to these two stages, it must be remembered here, that according to Shari’ah the soul (Ruh) enters the foetus at 120 days (4 months) from conception.

The Jurists (Fuqaha) have based this duration upon a Qur’anic verse and a statement of the beloved of Allah (Allah bless him & give him peace). In the verse Allah states the stages of development of the embryo in the womb of the mother. Allah Almighty says:

“And verily we did create man from a quintessence (of clay). Then we placed him (as a drop of sperm) in a place of rest, firmly fixed. Then we made the sperm into a clot of congealed blood. Then of that clot we made a (foetus) lump. Then we made out of that lump bones and clothed the bones with flesh. Then we developed out of it another creature (by breathing life into it). So blessed be Allah, the most marvellous creator” (Surah al-Mu’minun, 12/13/14).

In the Hadith recorded by the two most authentic authorities, Imam al-Bukhari and Imam Muslim in their respective Sahih collections, the Messenger of Allah (Allah bless him & give him peace) discussed in detail the periods elapsing between these stages, mentioned by the Qur’an.

Abdullah ibn Mas’ud (Allah be pleased with him) narrates that the Messenger of Allah (Allah bless him & give him peace) said:

“The seed of one of you remains in the womb of the mother for forty days in the form of a Nutfa (sperm). Then it remains like a clot for another forty days, and then for a same number of days like a lump of flesh (when the formation of the limbs and the growth of the bones begin) (Sahih al-Bukhari & Sahih Muslim).

The great Hanafi Faqeeh Ibn Abidin States in his Radd al-Muhtar:

“The soul enters the foutus at one hundred & twenty days (4 months), as established by the Hadith” (Radd al-Muhtar, 1/202)

The ruling on abortion in stage (a) i.e. after the entry of the soul into the foetus which is (as explained) 120 days, is that, it is totally impermissible and tantamount to murder, as it results in the taking out of an innocent life. All the scholars have unanimously condemned such a ghastly act.

Imam Ibn Tamiiyah states in his Fatawa collection:

“Aborting a foetus has been declared unlawful (Haram) with the consensus of all the Muslim scholars. It is similar to burying an infant alive as referred to by Allah Almighty in the verse of the Qur’an: “And when the female infant, buried alive, will be asked as to what crime she was killed for” (Surah al-Takwir, 8) (Fatawa Ibn Tamiyya, 4/217).

Ibn Abidin (Allah have Mercy on him) also states the prohibition of this gruesome act in his treatise ‘Radd al-Muhtar’:

“If a woman intends to abort her pregnancy, then the Fuqaha have said: If the period of the soul being blown into the foetus has elapsed, it will be impermissible” (Radd al-Muhtar, 5/276).

However, some Fuqaha and contemporary scholars have given a dispensation to abort the pregnancy after 120 days, in the situation where the life of the mother is in certain and absolute danger. This is based on the Juristic principle stated in the books of Usul al-Fiqh:

“If one is overtaken by two evils, one should choose the lesser of the two” (al-Ashbah wa al-Naza’ir, P.98)

They state that the mother’s life should be saved and the foetus aborted, as the mother is established in life, with duties and responsibilities, whereas the unborn child is still in the mother’s womb. But it should be remembered that the mother’s life must be in certain danger, and that this should be advised by a qualified and experienced Muslim doctor.

With regards to stage (b) i.e. prior to the entry of the soul into the foetus (120 days), the ruling is that, even in this case it is unlawful (Haram) to abort the pregnancy.

The reason why abortion prior to the soul entering the body will not be permitted is that, although there may not be life in the foetus, but the foetus is considered to be part and parcel of the mother’s body as long as it remains in the womb. Thus, just as one’s very own life and also all the limbs and organs of the human body are trust given by the Almighty Creator, so too is the foetus also a trust given to the mother by Allah, and she will not have a right to abort it.

The only difference here is that the sin of aborting the foetus will be of a lesser degree then aborting it after 120 days. It would not be regarded as murder, rather violating the rights of a human organ entrusted to the mother by Allah Almighty.

It is stated in Radd al-Muhtar:

“It is not permissible to abort the pregnancy before and after the entry of the soul into the foetus” (Radd al-Muhtar, 5/279).

However, in certain extreme circumstances, it would be permitted to abort the pregnancy, before the entry of the soul (120 days), such as: when the woman conceives after being raped, the mothers life or health is in danger, or repeated pregnancies severely damages her health, etc…

Imam al-Haskafi writes in Durr al-Mukhtar:

“Aborting the pregnancy will be permissible due to a valid reason, provided the soul has not yet entered the foetus”.

It should be remarked here that pregnancy due to unlawful and illegal sex is no reason and excuse for abortion. The embryonic life farm in the mother’s womb is honoured and sacred even though it is a result of adultery (Hidaya, 2/292).

In conclusion, abortion after 120 days is totally unlawful and tantamount to murder. Some Fuqaha, however, have given a dispensation only in the situation where the mothers life is in certain danger. As far as abortion before the 120 days have elapsed is concerned, it will still be unlawful, though the sin will be of a lesser degree, and it will become permissible if there is a genuine and valid reason.
