^^^ I think we arguing over semantics when they mean exactly some. Btw, just b/c you file motion to appeal doesn’t mean verdict of trial court is automatically get set aside pending appeal. In this case, court heard the argument and overturned the lower courts decision.

  (v) Set aside is the action of nullifying an order, decision or judgment by another order or decision or judgment of the same authority or a higher authority. By this action the position prior to the issue of original order is restored.

The court set aside the original punishment pending the result of the appeal which was never contested. If there was nothing in the case then BB should have contested and come out clean, why take advantage of NRO?
