Yeah. I don't think anyone has ever argued in court that the woman deserved to be raped, sounds ludicrous.

Regardless of how a woman is dressed...or even if she's flirting with a guy....does it necessarily mean that she agreed to having sex with him? No, it doesn't.
I think the lawyers would use the issue of "no mutual consent" as well as medical evidence (injuries, etc)....to fight the case. Does the person accused of rape have a criminal record with similar charges....testimonies of any witnesses, etc. The lawyers would have to take into consideration many things.
Saying that woman "deserves" to be raped....is far from ethical....and it's an "opinion." Lawyers examine facts and evidence, not opinions.

No one deserves cruelty! Some twisted minds do argue that women of “bad character” deserve to be raped but they’re psychos.
RV has covered what I was going to say from a forensics point of view. In rape cases, any evidence of force and struggle such as torn clothes, injuries to both parties etc. proves the theory of mutual consent wrong. If it wasn’t a rape and if the victim had made injuries to her/himself, that can be proven too.

By arguing a woman deserves to be raped, the defendant has in effect all but acknowledged committing the crime of rape. There is no defense before the courts, where a defendant can argue that a victim "deserved" to be raped or to in some way argue that rape as an act is acceptable - so if a lawyer or client tried to use this as a defense, I'd say stupid client and stupid lawyer.
Kakabilli got it right on the money - a lawyer must demonstrate consent to the action - absent consent - he'd likely be found guilty.
