ISLAMABAD: Two of the most powerful Sindh ministers and close cronies of President Asif Ali Zardari, Dr Zulfiqar Mirza and Nadir Khan Magsi, are proclaimed offenders in a Lahore murder and attempted murder case with their perpetual arrest warrants still valid and awaiting execution, it was learnt.
However, despite all this, they have not yet appeared before the competent courts in the Punjab to prove their innocence and clear their names but have made their way into the provincial assembly and also taken oath as Sindh cabinet ministers.
Despite repeated calls made on his mobile, at his residence number and messages dropped, Dr Zulfiqar Mirza did not return the call. However, Nadir Khan Magsi when approached simply denied he was aware of any such case. “I have no knowledge of this,” the provincial minister said, adding that he was hearing for the first time about his alleged involvement in such a case.
A Punjab government spokesman, when approached, confirmed to The News after checking the police record that the two influential Sindh ministers were still proclaimed offenders even as of today following court orders.
Copies of court rulings, the first information report of the murder and attempted murder case, the recorded statements of the accused who were later convicted and court warrants as attested by the respective court on July 21, 2010, show Mirza, Magsi and Dr Nisar Ahmad as absconders in a murder and attempted murder case in which one Ghulam Mustafa was killed while Imran Aziz Khan advocate, son of the then Chief Justice of the LHC Justice (retd) Rashid Aziz Khan, was severely wounded on April 30, 1999 on The Mall, Lahore.
According to the documents, the car used by the killers, who were later apprehended, tried and convicted, was allegedly recovered on the pointation of accused Muhammad Khan from the house of Zulfiqar Mirza in Islamabad.
The two accused, later convicted, including Muhammad Khan Chachar and Muhammad Yousaf, during the course of investigation disclosed that they had committed the crime on the alleged conspiracy and abetment of Zulfiqar Mirza, Nadir Khan Magsi and Dr Nisar.
Even one of these accused, Muhammad Yousaf, recorded his confessional statement under Section 164 CrPC before the judicial magistrate in which he stated that they had committed the murder of Ghulam Mustafa and injured Imran Aziz Khan, advocate, on the alleged instigation of Zulfiqar Mirza, etc.
The real target of the assassins was Imran Aziz but his office clerk Ghulam Mustafa, who was accompanying him on the fateful day outside Aziz office situated at 30-Mall Mansion, got killed as a result of indiscriminate firing on them.
One of the witnesses told the trial court that different accountability cases were pending against Benazir Bhutto, Asif Ali Zardari and Begum Nusrat Bhutto before accountability bench of the LHC and that Benazir Bhutto through two letters addressed to the then CJ LHC and father of Imran Aziz requested that the cases relating to her and the other two should not be entrusted to any such bench which was headed by Justice Ihsanul-ul-Haq Chaudhry but both of her requests were turned down in March 1998.
The court convicted both the accused on June 19, 2000 and gave them death sentence, imprisonment for 10, seven, five and three years besides fine. However, Zulfiqar Mirza, Nadir Magsi and Dr Nisar were declared proclaimed offenders.
The convicts went into appeal in the LHC where they filed a compromise with the legal heirs of deceased Ghulam Mustafa as recorded before the district and sessions judge, Lahore, who in his report after recording these statements observed regarding the proclaimed offenders (Mirza, Magsi and Dr Nisar) that the said compromise cannot be taken into consideration and no opinion can be expressed about its genuineness unless and until the absconders appear before the court and face trial according to the law.
The LHC accepted the appeal of the convicts Muhammad Khan and Muhammad Yousaf in terms of compromise and pursuant thereof conviction and sentence recorded against them by the trial court in murder charges.
However, their conviction in other charges including the attempted murder of Imran Aziz were maintained in toto. The LHC judgment said: “The death sentence of both the appellants namely Muhammad Khan and Muhammad Yousaf Mughio in not confirmed and Murder Reference is replied in the NEGATIVE. However, the conviction and sentences recorded under sections 324/34. 337-C, 337-F(VI) and 337-A(ii) PPC and sentence in their default are maintained in toto…” Sources said that Zulfiqar Mirza, Nadir Magsi and Dr Nisar continue to be proclaimed offenders even as of today as they never appeared before the court to get themselves cleared.
