Shariat wins, Gudia lost

What about woman’ right in Islam?
Is it an independent decision and not Shariat rulings put up in her mouth?

Gudia says that she has taken her decision as per Shariat commandant. She cannot take the decision as per her own independent wish.

Arif was caught by Pak army during Kargil. During all these four years of his absence he was declared deserter, lost.
His wife Guria was married to another man Taufiq
Arif found and released from Pak jail.

Gudia is pregnant from the second husband.
Shurriat court annuls her second marriage. At public demand the Shariat court asks Gudia to take an independent decision.

Gudia says that her decision depends on Shurriat law ruling and she wants to go with her first husband Arif.

and if she wants to go back to arif, then what is the matter????
she can always take divorce from taufiq and have her nikaah read to arif....

Indian “Muslims” like that don’t usally take such things seriously, these type of Muslims are usally the type who beleive Hanuman is just as devine as Allah Ta’ala (nauzobillah) and celebrating Divali is a good thing. :rolleyes:

The Indian Muslims who do take Islam and it’s rulings seriously are the types who know where their loyalties lie.

and armughal according to shariat wouldnt the second marriage be annulled? im thinking of a hadith or something along these lines. kay when the lady was marrying the second gentleman she was already married.. something like that.

once the qadi (judge) has cancelled the nikaah with her first husband, she is no longer married and is free to re-marry any other man after the period of iddat....

and according to shariat, once her first husband comes back, she is free to choose with whom to stay....
if she chooses to stay with her second husband, she can continue to do so and the first husband has no right to demand her to be back with him....
and if she chooses to go back to her first husband, then she acn take a divorce from the second husband and re-marry the first husband after the iddat and then reading the nikaah....

i seriously dont udnerstand what is the issue here and how shariat wind and she loses sort of thin even arises....

i m not a scholar but majort of these so called "sharia courts" seem to have the knowledge of a student rather than of alim. i dont know the fatwa on this issue from credible sources, so i wont comment on this particular issue, but wallah o alim. she is pregenant with the second husband...who will be his father? but if the ruling is true in terms of shaira, then i hear and i obey, inshallah.
