Shariah laws regarding divorce

I wasn’t sure where to post this so feel free to move it if you’d like.
I wanted to find out what the shariah laws are regarding marriages and divorce. A friend got a dissolution of marriage through the courts 4-5 yrs ago and has the paper work. But now her ex is trying to get her back. His case in the high court was thrown out but he’s still at it. Can the shariah court order her to go back? And can the ex get an appeal against it.
I’d appreciate some input on this, especially from any practicing lawyers in Pakistan, if there are any.

Re: Shariah laws regarding divorce

I don’t think if once the dissolution of marriage is legally done through a court , Shariah court can revise the decision …

People.. they should also take it serious … divorce is not a wager

I will try to look it in the books tofi , then ya can have a final verdict ..

At the mo i aint pretty sure ..

Re: Shariah laws regarding divorce

if she was over and done with the marriage, how can he get her back through shariah law..wund't that be forcing her to stay in a marriage? im pretty sure forced marriages are not allowed in islam.....

Re: Shariah laws regarding divorce

This is a question for an aalim.

Re: Shariah laws regarding divorce

By aalim I'm assuming u mean a religious aalim. If so that's not really what i want, I actually wanted an advice from a lawyer.

Re: Shariah laws regarding divorce

You'd still need the religious aalim. Your question comes down to if her divorce was final according to shariah, in which case he could not take her back. This is something an aalim could tell you.

Re: Shariah laws regarding divorce

What I meant was according to the governmental law (if that makes sense) can the shariah court over-ride the legal courts which dissolved the marriage, whose papers were finalzed and she has a copy of.

Re: Shariah laws regarding divorce

Shariah court can only over ride the law court if it is proven that divorce was given only once or twice then the court can re unite them. But if they have thought that the divorce by the court was final and they accepted it then it will get complicated.

I would not ask a lawyer as they can prove it right or wrong in either way. Better ask an Imam.
