Can they claim it as mutah or whatever the sunni equivalent of mutah is (misyar?) that is practiced in Saudia? Personally, I would do that as if it is a temporary marriage, then might as well sample the goods for the time being.

^It would only work if you're not trying to register it which is obviously the illegal bit.. You can do misyar or second/third/fourth without registering and they will turn a blind eye, just like having a halal 'mistress'..

No. In the U.S., the key is the INTENT of the parties at the time of marriage. USCIS is not saying that you can't marry someone in order to get a green card. The issue is that you can not plan in divorcing that person once you get the green card. There are plenty of marriage where green card is obviously a "benefit" to the immigrant. However, in a "real marriage", despite the benefit, the husband/wife still plan on building a life together. In "sham marriages", the INTENT is to get divorced when the immigrant gets the green card.
Same concept would apply to mutah. If you get married with the INTENT to get divorced, then USCIS counts that as a sham.
That's why most arranged marriages (at least the ones I deal with) do not generally face a problem with USCIS. The couple may not be experts on each others history or behavior, but during the interview and through the documents/evidence filed.....the USCIS wants to be shown that the couple INTENDS to build a life together as husband/wife.

They just dont go out there and arrest people! the couple is given an interview (a fair chance) to prove the legitimacy of the marriage, and before they apply for papers, they are told that if they are caught lying there can be consequences as applicable to the law. The US and UK dont go around arresting people for nothing like you're suggesting!

they do go around arresting couples trying to get married, the punishment in most cases is 12 months prosecution
obviously, if ur applying for marriage visa from outside of the country to come to that country then they interview you then otherwise if your both already here, and if they suspect anything then they make some investigations secretly and then arrest them

You're wrong spock, our friend here is obviously an expert on all matters illegal. They will secretly investigate you and right when you're about to say qabool hai the qazi who's an undercover police officer jumps up and yells 'Aha, you're under arrest and you have the right to remain silent'. And just like that, the dulha and dulhan are thrown in jail for the next 12 months with no trial at all! It's horrendous really.

I'm definately with Spock on this one.
Star4u theres no way in Hells chance that in the UK the police will beable to simply dive in like that, maybe if there was a firearms offence on the Wedding or the Marraige was between two Maffia organisations and it was the only chance to bag all the bad guys at once... even then it would take so much red tape to get the authority to barge in.
I can say with 100% confidence that in the UK its very difficuilt for Local authroities to prove sham Marriages let alone get Police involved, besides it's not a Police matter anyway at least to start with, the Police need to be given direct go ahead by the Home office if they have to arrest a foriegn "scammer".

All I gotta say, is that if your parents are so freaking paindu they don't even let you know your husband's full name and birthday before the shaadi and don't let you talk to each other even though you're about to be MARRIED, you deserve to stay back and rot in a country like Pakistan where you can live in all your backward glory to your heart's content.

I've been looking on youtube for a clip of UK Border force to post but I cant find it, maybe someone else can.
In this one episode this pakistani guy is trying to marry a drunk white women that looks like a 'big issue' seller in a registry office. The police swoop in and it's so funny because the groom starts resisting arrest while shouting 'IMRAAAAAN, IMRAAAAN THEY ARRESTING ME' while 'Imran' is nowhere to be seen.

There’s many such marriages that happen in the US when the dude is losing his visa status and marries a US citizen just to secure his status. Some of the couples you see are like totally
. For the cases that are successful, the guy gets his greencard and gracefully divorces his American wife after the minimum requirement, then goes home to bring back a cute bride
. There’s no hard feelings as the lady probably got some compensation from the guy and there was a verbal contract. I know many cases like this. In fact one couple was so strange that the immigration folks would give them surprise visits to check out what they were up to. Somehow they pulled it off!

I think this thread might have something to do with the BBC programme (Panorama is the TV equiv of the DailyMail) that was on tonight.
From what was shown, there were cases were the police and UKBA stormed/stopped church weddings (there were a lot of weddings happening with Nigerians and Eastern Europeans) and arrested the couple. But that was after investigation into gangs that perform sham marriages and notification from the minister.
The main case they were reporting was of a Paksitani guy who conned a Spanish woman into thinking she would be offered a job, so she produced all her documents. Her passport then went missing. After she was back in Spain, he used her documents to get the certificate for marriage and then 'married' her at a registry office, with the bride being some random who claimed to be her. But legally, it's this Spanish woman who is married to him, without her knowledge or consent, even for a fake marriage.
