Sexual Assaults Shoots up in Islamic Pakistan under the Sharia laws:
Ever since Pakistan adopted the Islamic rule based on Quran and Sunnah back in 1974 amending the constitution, it has been noted that crimes of sexual assaults on women had risen dramatically.
Under sharia laws, women observe, more diligently, the rules of purdah and acts of extreme modesty and, virtually no contact with strangers.
After careful studies, it became clear that the cause of the dramatic rise in sex crimes against women was non other than the sharia laws itself. Under the sharia laws, a woman needs 4 male witnesses in order to press sexual assault charges against a man. This made it extremely difficult or next to impossible for a woman to press charges.
If a woman proceeds with the charge and, cannot provide the 4 male witnesses then, the victim herself is accused of fornication and comitting of adultery, with the sentence of death. The places of confinement for women are overflowing with women accused of such adulterous acts under the zina laws.

farhana, calm down, I wasn't judging you, just asked a question. I find it strange to see so much negative feelings towards our great religion, at the same time people saying 'I am muslim'. Almost contradictory don't you think? There is nothing wrong with islam, Allah revealed it, how can our creator reveal anything wrong?

First of all, its called an "Islamic rule", but it isn't. It doesn't distinguish between fornication, adultery and rape. It makes it alot more difficult to persecute perpetrators of violence against women.
Second, your discounting other factors that contribute to increased violence, i.e. poverty, lack of law enforcement, corruption, illiteracy, etc...
I think you are confusing two things. There is a part of the Quran where in business deals there should be one male witness, or two female, the idea being that women are not often involved in business, so they won't understand it as well as men. Well, when developing the Sharia, the jurists decided to apply this one specific verse on business dealings to all of the law system. This was the mistake, I believe.
Then there is the other issue about proving rape. There must be four witnesses to prove it. But there also must be 4 witnesses to prove adultery. Unfortunately, once a woman admits that she had sex, even though she says it was rape, if she can't prove the rape then the courts often convict her of adultery. Their rationale is, well, she says she had sex, if it wasn't rape, it must be adultery. So you can see how God's law is twisted to be against women.
In my opinion, most of the disadvantages toward women in our so-called Islamic countries are because of incorrect intrepretation of Quran and incorrect application of precedents, rather than the true intent of God. Who am I to know the true intent of God? I am just me, and this is just my opinion.

you're quite right mundyaa, death by stoning of the woman, while you would probably be set free, on some excuse that she seduced you, and chances are you would be believed.

In the case of a rape,if there are 4 people there "witnessing" the act while the defenseless woman yells out for help, would'nt common sense be applied by those 4 "spectators" in trying to get the victim out of this situation??
As I understand it, its four witnesses to prove ADULTERY, not rape. The reason for this is to insure that the burden of proving adultery fall on the accuser, since the punishment can be great.
Pakistan's so called Shariah law has confused adultery with rape.

Could you, maybe, explain how this would make a POPSITIVE differece for women and, if so, how come the confinement homes used to lock up women on ZINA charges are overflowing with women who have been locked up for years!

Achtung, Adultry is a mutual act between consenting adults, if four witnesses are called upon ( personally i think they should mind their own flippin' business....but hey!! ), which of the two should ( or would?? ) be punished. I bet the first stone will be thrown on the woman.

Blitz...I don't think the punishment for adultery is stoning. It's lashing.
I agree its difficult to find four witnesses, I think thats a way of avoiding to many falsely accused being punished.
You would hope that justice would be served justly. But your probably right, women would be more prone to being accused of encouraging the act. Damn patriarchy...
Volume 8, Book 82, Number 816:
Narrated Ibn 'Abbas:
'Umar said, "I am afraid that after a long time has passed, people may say, "We do not find the Verses of the Rajam (stoning to death) in the Holy Book," and consequently they may go astray by leaving an obligation that Allah has revealed. Lo! I confirm that the penalty of Rajam be inflicted on him who commits illegal sexual intercourse, if he is already married and the crime is proved by witnesses or pregnancy or confession." Sufyan added, "I have memorized this narration in this way." 'Umar added, "Surely Allah's Apostle carried out the penalty of Rajam, and so did we after him."
The 4 witneses are also for men to be proven guilty. Also, when two parties commit adultrey, both of them HAVE to be stoned to death but in fornication its 80 lashes.
