**A 12-year-old schoolgirl has failed in an attempted legal challenge to her school’s ban on a full-face veil. **
Mr Justice Silber had been told that the girl’s three older sisters had attended the same school and had worn the niqab with no problems.
But the school, in Buckinghamshire, had told the girl it was not acceptable because teachers believed it would make communication and learning difficult.
The judge has now rejected her lawyers’ arguments for a judicial review.

They said after the judgment that the family were “bitterly disappointed”.
They are considering making an appeal, but would have to make a separate application for this as the judge refused them permission to do so.
For legal reasons the girl and the school have not been identified publicly.
**‘Religious tolerance’ **
It is understood she has been taught at home after falling foul of the uniform policy last autumn.
About 120 of the school’s 1,300-plus pupils are Muslims. About half of them wear the hijab headscarf, which is permitted.
In his judgement, Mr Justice Silber stressed that he was dealing with one particular case - not the wider issue of whether the niqab should be worn, in schools or anywhere else.

*He said the ban was “proportionate” in the light of certain factors: *

  • *the veil prevented teachers from seeing facial expressions - a key element in effective classroom interaction *
  • *the necessity to enforce a school uniform policy under which girls of different faiths would have a sense of equality and identity *
  • *security - the head teacher had said an unwelcome visitor could move around the school incognito *
  • *the need to avoid peer pressure on girls to take up wearing the veil *
    The girl’s solicitor, Shah Qureshi, said: "We believe there are a number of errors in the decision that have led to Mr Justice Silber reaching the wrong conclusions.
    “It is surprising that he decided that the school had not infringed my client’s freedom to manifest her religion given the fact that she entered the school on the understanding that the wearing of the veil was allowed when being taught by male teachers.”
    **New guidance **
    Schools Minister Andrew Adonis said: "We welcome this judgement. Decisions about uniforms and appropriate dress are rightly matters for individual schools to decide in consultation with parents.
    “Our new uniform guidance, due out shortly, will take into account the decision made in this case.”
    The school’s head teacher said it welcomed the court ruling.
    “We want to focus now on supporting our student. We hope that she will return to school and resume her education as part of our community.”
    The school had a long tradition of serving that community, she said, and was proud to welcome pupils from all faiths and religions with a view to helping them achieve their potential in a supportive learning environment.
    Bucks County Council’s cabinet member for schools, Marion Clayton, said its prime concern had been that the pupil should be in school receiving an appropriate education.
    "To that end we have worked with the school and family to seek a resolution. It is unfortunate that this could not be done without recourse to a judicial review. “We hope that this pupil will now return to full-time education.” Costs in the case were awarded against the family.

i dont even know where did this Ninja style parda started at first. My guess would be from indo-pak subcontinent .
we(pakistani & indian muslims)are so ignorant to differenciate between arabic **culture* and islam.We believe watever arabs do thats islam,now my question is how many arab women you see covering their faces*

Criteria is Quran, Sunnah, Ijma and not Arab women, and niqab is also wajib like hijab.

ninja style… kudos!.. two thumps on that… but I dont think alot of people in Pakistan believe what arabs do is Islam… or else they would have done Eid with them… some do.. dont get me wrong but our own Mullahs:maulana: are the real problem… they dont translate what the Quran says accuratly… I have noticed this numerous times in different mosques in Pakistan that they read a verse and then translate it… I am no alim either but i have also studied the religion and some times they dont say ir right… they twist it… so I think its the same with the NINJA style… man.. i cant enough of this..

I do not know a single arab girl in my college who covers her face. Hair, yes, face, no. Most of the niqabis are Desi.

absolutely righ decision, there is no need to be shuttle cock burqa or covering full face, anyway they are un happy about it in a christian country, they should move to place where they can do that.

I dont know after being given so much freedom, how twisted we have become to just get attention or want to be famous. they have allowed to pray, have places of worship without any problems.

they have also introduced faith related uniforms, some schools even allow shalwar kameez as uniforms. what else you need??? that kind of felxibility you will not find in any school in Pak or native countries.

last year similar girl missed three years of schooling just to get famous to wear full jilbab, at the end she lost the case on appeal. it does however got her face on national newspaper though. wonder if she had to pay all the court and solicitor fees, all this from free legel aid from government and being on benefits from government for living. I wouldnt imagine such thing a girl would do without her live parents.

want to live in the west, they could even force what france has done, but they havnt. so do enjoy freedom! dont push them to wall!! or else just be free and live in pak or india or afghanistan.

Are you saying that Shalwar kameezes are considered "faith-based" uniforms? Who decided that ?? I remember reading abt that girl, that's absolutely pathetic, to lose out on 3 yaers of schooling just for that. Screams ATTENTION SEEKER. Whatever happened going to an Islamic school? I thought Britain had alot of those?

I went to a Catholic school, uniform was a skirt, knee highs etc, gym uniform was shorts, but guess what our school never had a problem, if sme girls wnated to wear sweats for gym class, or wear "official" slacks in lieu of the skirt!

What si the point of drawing so much attention and segregating yourself frm society? Since when does it mean,that you either cover your face with a sheet, or you roam around in miniskirts and tank tops? There's a HUGE middle ground, including girls who cover their hair and assimiliate perfectly into society. I don't see why "assimilating" (maybe i'musing the wrong term, but at hte very least, NOT deliberately secluding yourself from society) means that 1 has to "lose" their religion, as so amny desis/Muslims fear.

Personally I don't think it is required for women to cover their entire face, but I know this is a favorite topic of debate amongst many so I will leave it at that.

However, one thing I gotta say is that news stories like this make me question why some people even chose to live in the western world. If you want your 12-yr old daughter to have full face niqaab, that implies it is important for you, in which case why don't you live in a place that agrees with your values and appreciates your actions. I am not saying this family should leave UK because of this, but in a more general sense, people should live where they are comfortable in the value system of the society around them. I am sure there are many places in the world where people appreciate a 12-yr old to wear a full face niqaab, some places may even penalize you if you refuse to do so. So its not like there are no other choices for ppl.

And that is exactly wat i'm saying....... ninja style originated from subcontinent not from arab land.If we are so desperate to follow arabs ,why dont we follow the covering head only part.

So, if in doubt about the Islamic ruling, on this subject one must follow what the Arab women in general are doing, instead of seeking a scholars advice.
…do you apply this logic every time you are not sure about something?

On the subject, I am totally neutral on this, (I don't know what the fuss is about) if a sister chooses to wear a niqaab or the hijaab, it is her choice, either way they have my full support., on the other hand if they choose to abandon it, makes no difference to me.

Personally I would encourage my daughter at an early age to wear the hijaab, but if later on she chose to wear the niqaab, I would fully support her.

Recently a scholar, whoes name I cannot remember, if my memory serves me correctly said, " Hijaab is compulsory, however if a female chose to wear the niqaab, then she should not be dicouraged''

Actually you don't know for sure that 12 year old will even have her whole life ahead of her, so if she wansts to do something that she believes is a part of her religion, u shudnt stop her. the "you're young now, u hav the rest of your life to do smething"...it doesnt work.
