**SC hearing petition against president’s dual-offices **

ISLAMABAD: Supreme Court on Thursday continued hearing of petition against dual-offices of the president.

A seven-member larger bench headed by Chief Justice Iftikhar Muhammad Chaudhry is hearing the petition.

In his reply, the counsel of president Syed Sharifuddin Pirzada told the court that President Musharraf would continue his dual offices till his successor would take over after November 15.

Attorney General Malik Qayyum requested the court to grant him one-month period for filing detailed reply.

The court said that he would be given one-week period for submission of the reply. Malik Qayyum said that he would inform the court after getting instructions.

I have a conspiracy theory. My thoery is this that CJP is Musharraf’s man, working on his agenda to create such a chaos in Pakistan that Msuharraf can justify to international world that Martial Law is the only option

if this is true, then it is the stupidest thing i have ever heard. 1973 constitution is not a divine document created to exist in its unmodified form for all of eternity. constitution of pakistan is a man made document which reflects the wishes of pakistanis whose views are represented by members of national assembly. thus spirit of constitution can only be determined by people of pak because they are the ones who are responsible for making it. supreme court’s task under the constitution is to ensure that all laws of pak comply with constitution. supreme court cannot tell people of pak that pakistani people cannot amend a document made by the people in the first place. for example if pakistanis want a presidential form of government and they provide 2/3rds majority to a party advocating presidential form of government, then the supreme court cannot stand in the way because otherwise judges of supreme court would be deemed to have more power than the people of pakistan. btw 6th amendment to pak constitution pretty shows who is the boss. google it up.

also to me the fact that supreme court would entertain challenges to their own judgement indicates that supreme court now wants to grab political power. musharraf would be well within his rights to impose martial law should supreme court annul laws it declared legal in the first place. no govt can function if every single one its actions are challenged in the supreme court even those that were previously declared constitutional. while martial would be negative in the short run, its a lot better than having destiny of pak being controlled by a bunch o bozos siting in the supreme court.

Musharraf already tried it once…didn’t he? u know…trying to house arrest the CJ, cutting off all communication links with the outside world. Was the CJ not missing between 9th and 11th March? Is that vendetta not coming back to bite him in the behind now?

Now as for people jumping up and down, left and right, questioning gravity, I ask ye “What has the SC done radically different since Jul 20th that it was not going to do before 9th March?”

Missing person’s case? Already under way on 9th Marc.
Nawaz Sharif case? Already gave a similar judgment in 2004.
Musharraf’s uniform? It was going to be challenged in the SC ANYWAY.

A blind can see the connection between the Presidential reference and the Presidential uniform. CJ had given hints on the illegality of the unifrom beyond Musharraf’s current term at a graduation ceremony of young cadets (in hassanabdal I think?) at the end of Feb. By mid-march, he was under house arrest. So WHAT vendetta? WHAT exactly is the judiciary doing NOW that is

a) beyond it’s mandate…or unconstitutional?

b) making people in the presidential camp so insecure?

Someone please help me out here. I am stumped.

CJP was himself involved in the legalistation of Musharraf's rule.

In a sad twist of fate my friend, the same SC that legalized his rule also happens to be the competent authority to declare his rule illegal.

legally speaking u can't do anything about that. He gave a decision, which only endorsed several previous judgments. He can always go back and revise the decision citing error of judgment or whatever. Perfectly legal. Plus, the only vendetta I see is coming from the Caesar's camp. Why r v signaling out CJP here? Was he alone in that bench? He wasn't even CJ then...in fact several senior judges were around back then. Still we point him out? Why? Why the insecurity. I still dont have my answer.

CJ himself is illegal. he is there because he made something illegal into legal, so if we do want an indpendent and clean judiciary, we need to root out all teh justices who were involved making the illegal rule a legal one.

Yes, I’m pretty sure. According to article 43 Mushrraf cant be president.

Chapter 1: "The President" of Part III: "The Federation of Pakistan"

43. Conditions of President’s office.
    (1) The President shall not hold any office of profit in the service of Pakistan or occupy any other position carrying the right to remuneration for the rendering of services.
    (2) The President shall not be a candidate for election as a member of [20][Majlis-e-Shoora (Parliament)] or a Provincial Assembly; and, if a member of [20][Majlis-e-Shoora (Parliament)] or a Provincial Assembly is elected as President, his seat in [20][Majlis-e-Shoora (Parliament)] or, as the case may be, the Provincial Assembly shall become vacant on the day he enters upon his office.

What if Gen Musharraf decides that he will not recieve any salary as an Army Chief?
