SC declares contempt law null and void

ISLAMABAD: The Supreme of Court of Pakistan declared the contempt law, recently passed by the parliament, as “null and void”, while hearing petitions against the law on Friday.

Chief Justice Iftikhar Muhammad Chaudhry, heading a five-member bench, remarked that the immunity provided by the new law is against the Constitution.

The chief justice added that the Section 6 and Section 8 of the new law are also unconstitutional and are against the freedom of judiciary.

The Section 11, which says that a hearing will be suspended when an appeal is filed, is also against the freedom of the judiciary, the chief justice remarked, and added that the new law is contradictory to the Article 4 and 9 of the Constitution.

No government official can be given any immunity, the bench maintained, adding that the 2003 contempt of court ordinance will now come into effect.

Earlier during the hearing, Attorney General Irfan Qadir completed his arguments and petitioners were ordered by the chief justice to give rejoinders as written statements due to lack of time.

While presenting his arguments, Qadir said that the words of the constitution should be “given new meaning” in accordance with the law.

This statement was greeted with surprise by the court.

**“You are the attorney general of Pakistan, how can you make such a statement?” enquired Chief Justice Iftikhar Muhammad Chaudhry, while Justice Jilani said, “You should know the consequences of giving such a statement.”

Justice Khawaja remarked that such a thing was not possible.**

While the contempt law meets its just nemesis as expected, the AG sparks a new debate on giving a new meaning to the constitution. Now what does he mean by “new meaning”, is beyond my guess, I am sure it will be as preposterous as the contempt law which ‘passed away’ a while ago.

it was clear like crystal court doesnt approved it anyway. now start count days for 2nd qurbani.country inside outside in a great mess and this poltical war between judicery and govt.making it more wrost.

^ there is no "war" between govt. and courts, we just have a gang of dakus from interior sindh trying to plunder the country and the court is trying to stop them from bleeding pakistan to its last drop of blood.

alot of people would say court is biased and all that, but how is it right to give unconstitutional right to all these public office holders to do whatever they want? there is something called accountability, which certainly does not exist in their dictionnary.

yeah, exactly everyone who is sitting in the parliament is from interior Sindh! :halo: if the corrupt person hails from a certain background, what it has to do with their wrongdoings? kindly, refrain from bringing ethnicitiies in every discussion.

Seems like, while Govt is busy in formulating a strategy to defunct the SC and SC fighting for the Pakistan, all other opposition parties including PML-N and PTI are supporting the govt in their on way...

contempt law gives a free hand to all the public office holder to loot. From PM to ministers. it was basically passed to protect the new PM( who has refused to revive cases against President) it was challenged in the court by dozens of petitioners, and now SC has struck down this law.

Every decent human being in Pakistan supports the supreme court’s decision in striking down the malicious, anti-islamic and anti-constitutional amendment in the contempt of court law. The only “people” who are doing strikes against this law and in favor of zardari (and obviously supporting his plundering of millions of dollars) are from where? yes, you guessed it right.

So I guess when Anwar Pasha cries of establishment of being ‘Anti-Sindh’ it has more to it then just being AP saying it, this is actually what PPP believes… every action against PPP is because the party is from Sindh.

If a party from punjab does the things that PPP is doing then establishment will be called anti-punjab. I hate people who justify looting the country on the name of ethnicity. So if these dakus are from sindh, then we should let them bleed pakistan to death just because they are sindhis ?
