Is it so the SC has given options to Attorney General.. and he is the one who will decide what the court should do..

What if he says leave it to the people and asks the courts to remain patient..???

NRO case: SC says PM violated his oath

ISLAMABAD: A five member bench of the Supreme Court has decided to refer the six options relating to the NRO implementation case to the Chief Justice for constitution of a larger bench for hearing of these options.

Announcing the verdict on NRO implementation case‚ the bench headed by Justice Asif Saeed Khosa said the six options are being handed over to the Attorney General.

01: To initiate the contempt of court proceedings against the Chief Executive and the Secretary Law for not implementing the NRO verdict.
02: To declare the chief executive ineligible from the membership of the Parliament.
03: The court may form a commission to get the verdict implemented.
04: The people themselves decide on the issue and the court exhibit patience.
05: Contempt proceedings against Chairman Nab may be initiated.
06: The action may be taken against President for violating the Constitution.

The Supreme Court said in its order in NRO implementation case that the government has failed to implement the verdict.

‘The government is not taking interest to observe the order for the last two years. We knew that the actions we are about to take they may be unpleasant.’

‘The court has taken oath to defend the Constitution. The prime minister respected the party over the Constitution.’

‘The president in an interview to Geo News said his government would not implement one part of NRO verdict.’

As per Article 189 and 190 all institutions are bound to help the apex court, the order said.

‘Prima Facie the prime minister is not an honest man and violated his oath.’

The court recommended the case to the chief justice to form a larger bench to hear the case on January 16.

A Five-member bench of Supreme Court (SC) headed by Justice Asif Saeed Khosa resumed the hearing of the case pertaining to the implementation of National Reconciliation Ordinance (NRO) verdict today.

Clarification:
AG has not been given option to decide from 6 options. Larger bench will decide which course they have to take. Govt. will not have a right to appeal because there is no appeal against the larger bench. Seems PPP govt. wants to go down as shaheed by not implementing the NRO verdict, while judiciary wants to give full chance to the govt. to implement the decision.

SC has shown utmost constraint and patience in this matter..

SC knows that Govt is self proclaimed shaheed e jamhooriyat and will NOT write anything to anybody. They know their days are numbered and hence they wanna go out with a bang rather than meekly.

It seems the establishment has decided to get rid of the present ruling dispensation as nro case and memo gate are staring them in the face and then the statements of primeminister regarding Osama bin laden and that the coas and isi chief have exceeded beyond their authorities have not gone well with them.

‘Unpleasant’ steps if govt fails to implement SC verdict by 16th
**ISLAMABAD: Announcing its verdict in the NRO implementation case on Tuesday, Supreme Court’s Justice Asif Saeed Khosa remarked that despite clear court orders, the government and the NAB were not serious about implementing court orders, DawnNews reported.

**Justice Khosa said that the apex court was giving a last chance to the government to implement its verdict on the National Reconciliation Ordinance by Jan 16.

He said in case of non-implementation, the court would be forced to take certain steps which would not be “pleasant”.

The court’s order referred to six possible options to proceed with the case in case the government fails to implement its decision on the NRO.

Reading out the order, Justice Khosa said the court was disappointed that the government had not implemented its verdict on the National Reconciliation Ordinance.

He further said that the National Accountability Bureau’s chairman deliberately avoided action against Malik Qayyum and Adnan Khwaja.

Justice Khosa said that the law secretary placed more importance on foreign trips than the apex court and its proceedings.

The government and the NAB were not serious in implementing the orders and had not acted on those for over two years, Justice Khosa said, reading out the verdict.

He moreover referred to President Asif Ali Zardari and said that the president had, “in an interview, refused to accept the court’s orders”.

The prime minister and the law minister also publicly refused to accept the apex court’s orders, Justice Khosa said, adding that the president and the prime minister preferred loyalty to party over loyalty to state.

He added that a wrong precedent is set when the government breaks the law.

Justice Khosa moreover said that the prime minister had violated his oath of office by not implementing the apex court’s verdict on the NRO and that the court could declare him ineligible for the position.

Giving one last chance to the president and the prime minister, the court summoned the attorney-general on Jan 16 and adjourned the hearing.

The whole gang is getting together to select the option of allowing people to decide about their eligibility. What a sham!!! :pullhair:

If people are so good to decide about constitutional matters, than perhaps the “collective wisdom” of parliament should dissolve the institution of courts and hoist party falgs on all court buildings. After all they are conquering courts.

as much as i'd like the government to continue its tenure, but with their actions they seem to have brought up their demise, the mililtary and judiciary both at the moment are going against the government...the statements that gillani has made in the past few days havent helped...i think the time is coming for zardari to go for a long treatment (in Dubai)...

It's an open secret how desperately they are persuing political martyrdom and I pray to Allah almighty not to grant them their dying wish.

Looks like court also had this in its mind, therefore they added the clause of leaving the matter to the judgment of the people. I will go for it, however insane it may sound at the moment.

what does option 4 mean? Is SC avoiding ppp's political martyrdom? Isnt it opening a dangerous precedent? Any criminal can come to government and ask for options?

i m not a PTI fan..but this comment just reminded me of a joke IK once shared..it was abt a jungle with a Pig as its head..and when a calamity hit the jungle the head asked all animals to prepare for a sacrifice to save the jungle from calamity. once ready the pig said..meri qurbani to haraam hai..so someone else should come forward and sacrifice. :d
