How can we forget when non-functional CJ Ifti:-
- Ignored the constitution and swore an oath on Musharraf’s PCO, and thereby got promoted to the Supreme Court.
- Validated the military coup and suspension of the constitution under the “Doctrine of Necessity”.
- Allowed Chief of Army Staff Musharraf to singlehandedly amend the Constitution of Pakistan, without recourse to any authority.
Yet today he is the defender of the constitution, against one man rule, and independence of judiciary and all that jazz.

Mr. Justice Falak Sheer has challenged Iftekhar’s seniority. He also denied sitting on the bench becasue of this very reason. Fact is that Iftekhar is junior to Bhagwan Daas (if we go by age) and he is junior to Falak Sher (if we go by appointment date). Flak Sher’s application is under review by govt to set the seniority rules (which Govt is entitled to by constitution) and this application was submitted long before all of this crises.

- Non-functional CJ Ifti first objected to almost half of the judges on the Supreme Judicial Council.
- Then he objected to 2 more SC judges for having lunch with the govt’s counsel.
- Now we find out that another justice - Falak Sher has all along objected to Ifti’s position as Chief Justice.
So many superior judges either objected to by Ifti or in objection to him.

LAHORE: Justice Khalilur Rehman Ramday, head of the 13-member full court of the Supreme Court hearing the constitutional petition of Chief Justice Iftikhar Muhammad Chaudhry, said on Wednesday that if the treatment being given to judges in Pakistan continued, people would start frightening their children by saying, “If you make mischief, you’ll be made a judge and if you make even more mischief you’ll be made the chief justice”, BBC Urdu.com reported. During the hearing, the government’s lawyer said that CJP Chaudhry had moved a premature application before the SC. To this, Justice Ramday said the government lawyer was making a dangerous statement. Justice Ramday said the government lawyer’s argument simply meant that the Supreme Judicial Council should be allowed to try the CJP and then he (the CJP) should move the court against its findings. Justice Ramday said that if the SJC gave an unwarranted ruling against the CJP it could not be challenged. The government lawyer countered that an unwarranted decision by the SC would also be unchallengeable. Justice Ramday responded that a review application could be filed against an SC decision. When Malik Qayyum said that judges do not give judgements against each other out of courtesy, Justice Ramday asked if his statement meant that the judges on the SJC were not expected to give a ruling against CJP Chaudhry. Qayyum said the SJC was created for judges’ accountability and no one could interfere in its work. When Qayyum referred to former chief justice Yaqoob Ali Khan’s case, Justice Ramday jokingly asked him why he was always trying to intimidate the SC. Gen Ziaul Haq had sacked Justice Yaqoob Ali Khan soon after ousting prime minister Zulfikar Ali Bhutto. Justice Ramday is Justice Khan’s son-in-law. daily times monitor

The non-functional CJ’s counsel try to use falacious reports in the media to have two “biased” judges excluded, but the Supreme Court not only laughed out that suggestion, but warned the media.
Comments on CJ case banned
The Supreme Court of Pakistan on Wednesday issued a code of conduct during the hearing of the constitutional petition of Chief Justice Iftikhar Muhammad Chaudhry from May 14 onwards on day-to-day basis. **The order of the apex court states that it is notified for information of the general public, the lawyer community and the print and electronic media that the Reference against Justice Iftikhar Muhammad Chaudhry, Chief Justice of Pakistan, is sub judice before the Supreme Judicial Council and the constitutional petitions on the subject are sub judice before Full Court of the Supreme Court of Pakistan. It further says that the discussions, comments, or write-ups, which are likely to interfere with the legal process, ridicule, scandalise or malign the court or any of its judges; or touching the merits of the case are strictly prohibited. Violation in this regard shall be dealt with under the law relating to Contempt of Court. **
The order says that on each date of hearing of the constitutional petitions, the members of the bar, media people and the litigant public visiting the Supreme Court shall abide by the instructions or guidelines issued by the court. It orders that the entry will be allowed to Advocates of the Supreme Court/Advocates-on-Record whose cases are fixed for hearing before any of the benches on such days. Entry will also be allowed to the litigants on proof of identity. Advocates of the Supreme Court/Advocates-on-Record will be allowed to visit the bar room and the court offices in connection with official business. Judges Gates of all the Courts, i.e. the Supreme Court, High Courts and the Civil & The District Courts are the exclusive entry points for the judges of the concerned courts and are never open to the lawyers or the members of the general public. Maintenance of the dignity and sanctity of the courts is legal and moral duty of the members of the legal fraternity. The registrar of the apex court, therefore, decided that the bar members shall ensure that no Advocate of the Supreme Court or of any other court enters, or attempts to enter, in the Supreme Court premises through the judges gate, and no advocate other than ASC/AOR enters the Supreme Court premises from any gate. No person, whether a member of legal fraternity or any one else, is allowed to raise slogans within the Supreme Court premises or at the judges entry gate. **Entry of members of media (print and electronic) into the courtrooms will be regulated through entry passes issued by the Registrar Supreme Court. **

Haris, there is a lot selective amnesia from pro-CJ supporters. They laud his “struggle for the constitution” etc, when the recent history is that he tossed it on the side to get himself elevated to the Supreme court, and actually gave Musharraf the “dictatatorial” powers. They support his so-called campaign against disappearances, but then justify extra-judicial killinsg and kidnappings by the PPP govt in Karachi in the 1990’s. It’s all about politics, and not principles at the end of the day.

He may or may not weep, but the nation will surely weep, shortly after his removal (if he is removed that is), and when the champions *of human rights, democracy, freedom of press and judiciary who were taking Pakistan to *great heights and have proven and exemplary track records and were *unfairly interrupted *by the *unruly *Khakis and their Chief, come back.
Musharraf may not weep, at least not for himself, for he is a toughy, but he will surely weep for the nation and its irrational behavior and inability to learn lessons. If history repeats itself again at this point, the cycle shall set in for ever leaving little hope from the public or the leaders. And we, the nation will not just weep but wail the day those *champions *of yesteryear comeback and grasp Pakistan never to release from their selfish clutches.
We will weep, but we will then deserve it...
