ISLAMABAD: The Supreme Court on Wednesday accepted appeals for hearing against killing of four prisoners in custody of security agencies, DawnNews reporte

A five-member bench headed by Chief Justice Iftikhar Mohammad Chaudhry took up the matter here today.

The chief justice termed the killings in custody of security agencies as serious and directed the government to submit its report after investigating the matter.

The court also issued notices to the chiefs of Inter Services Intelligence (ISI) and Military Intelligence (MI) and the secretary defence.

Attorney General Maulvi Anwarul Haq told the bench that he would submit his report on the next hearing of the case.

We should give credit where it is due, this was something that the government should have done, but oh well they are busy looting the country. All power to the supreme court, two news today one is this one and the second I have posted in the balochistan thread.

^ I don't know when this appeal was actually filed so its hard to guess what took them so long. Anyways, its a good move. Lets see if army will listen to judiciary as we have seen govt has no intention of paying heed to judiciary.

As has been pointed out to you several times, no civlian govt in Pakistan's history has been able to control ISI killings.

When they try, the ISI kills the govt leaders themselves.

Janab these judges are also civilians and they also have that much Pressures. The working of this government is easy to judge, started from nro and now trying to loof and cover the traces if their loot, everything else is secondary for them sadly.

Yes, civilians are judges, and it has taken them years to come up with this, after much criticism. We will see if they actually do anything about it.

The govt is corrupt, just like all in Pakistan's history.

Well if the government had taken a stance and if they were overthrown in that process their standing could have dramatically increased amongst the people but they decided to support the status quo and save their government. Look at the prime minister's statement today and compare that to the one he gave 2 weeks back.

This is a fact. ISI is responsible for at least half of the mess the country faces today. But things are changing from every passing day as now it is becoming increasingly difficult for anyone to hide their dirty handiworks under the carpet.

Today's judiciary, along with media and a vigilant cival society, could gradually cut ISI to its size. But still the major role has to be played by politicians by winning the hearts and minds of people, not just seats.

SC must see it through to show ISI that it's not above the law.

I am not in favour of ISI working under civilian control. Rather, there has to be a transparent professional framework whinin which it should be operarting under a well-defined mandate, with army chief being fully answerable to the parliament on its scope of work.

There should be some middle ground, by giving the army/ISI more power than the elected representatives we have this situation in which the security forces abduct and kill any one they consider as 'terrorist' (and working against the national interests). These policies have back fired and instead of creating cohesion they are dividing people and increasing the gulf between the ordinary people and the army.

With current crop of politicians I sort of agree that ISI should not come directly under civilians but one thing is for sure: ISI must NOT involve in local politics.

I didn't know you could tell future, I am a normal human being. I can only look at present or past. Current crop may not be serial killers, but definitely serial sellers.

Adiala prisoner deaths: SC puts ISI, MI chiefs on notice
****ISLAMABAD: **The Supreme Court has issued notices to the chiefs of Inter-Services Intelligence and Military Intelligence agencies to explain the circumstances leading to the deaths of four men being tried under the Army Act.

Eleven prisoners, convicted for attacking the Pakistan Army’s General Headquarters in Rawalpindi and the ISI’s Hamza Camp, had gone missing from the Adiala Jail, and four were later found dead.

The three-judge bench, headed by Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, also issued notices to the defence secretary, the Advocate-General of Pakistan Maulvi Anwarul Haq and the accused commandant. The respondents have been told to file replies in the next hearing on January 30.

The orders were passed on Wednesday when the court took up a constitutional petition for hearing, after removing objections raised over it by the Registrar office.

Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, while hearing the case on Wednesday, said that when this case was brought before the SC, the court was told that the prisoners are under the custody of intelligence agencies and are being tried under the Army Act. “Now, four of them are dead. It must be found out how they died.”

The CJP asked the Pakistan Army’s legal officer if it were true that the four prisoners were killed. “If they have been murdered, then this is a grave issue.”

Petitioner Rohifa, through her counsel Barrister Tariq Asad, had petitioned the court for provision of ‘due process of law’ to her three sons Syed Abdus Saboor, Syed Abdul Basit and Syed Abdul Majid.

“The matter is of public importance. There is apprehension of deaths of the remaining detainees,” the petitioner informed the court. After the Registrar raised objections to the petition, Syed Abdus Saboor was killed by intelligence agencies, his brother Mufti Shakoor told The Express Tribune.

Agencies had taken Saboor into custody along with his two brothers and eight others on charges of the attacks, Asad said.

Abdul Saboor, 29, is the fourth civilian detained in the case to have died in mysterious circumstances over the past six months. Earlier, Mohammad Aamir died on August 15, 2011, Tahseen Ullah on December 17, and Said Arab on December 18.

Justice Arif Khilji observed that the manner in which bodies were left on the road for collection reflected a sad state of affairs. Asad said the accused started leaving bodies by the roadside after the Lady Reading Hospital in Peshawar refused to accept them.

Earlier, Asad said, the families of at least three men, who had died in custody because of torture, were left at the Lady Reading Hospital for their families. In the missing prisoners’ case, officials had told the court that these men were in custody of intelligence agencies and were being tried under the Army Act.%between%
