Sc disqualifies dual national lawmakers

What happened to that dual nationality bill that Cabinet approved few months back?
which was like desperate attempt on part of PPP to save Rehman and others. So these looters can participate in next general elections.

Lets see what PPP does now.

ISLAMABAD: The Supreme Court was on Thursday ruled that lawmakers holding dual nationalities were not eligible to hold any public officers
and declared all such lawmakers as disqualified, DawnNews reported.

A three-judge bench led by the Chief Justice Iftikhar Muhammad Chaudhry which had reserved its ruling in the case relating to legislators holding dual nationality.

The 11 disqualified lawmakers include Zahid Iqbal, Farahnaz Ispahani, Muhammad Ikhlaq, Ashraf Chauhan, Nadia Gabol, Amina Buttar,
Zaheer Awan, Waseem Qadir, Farhat Muhammad Khan, Chaudhry Nadeem Khadim and Ahmed Ali Shah.
Five among the disqualified lawmakers were from the Punjab Assembly and two from the Sindh Assembly.
The bench further directed that the verdict be sent to the speakers of the concerned assemblies and the Senate’s chairman.
The bench said the lawmakers were being disqualified under Article 62 and Article 63 of the Constitution.
The court moreover directed the Election Commission of Pakistan (ECP) to initiate proceedings against the said lawmakers
who it said had committed perjury with respect to their oaths.

The court also ordered the government to withdraw the amount spent on the salaries and perks on the disqualified lawmakers
from them and deposit the amount in the national treasury.
It also directed the Senate and National Assembly secretaries to submit a progress report on the matter in two weeks’ time.

Ruling that Rehman Malik was a British citizen until May 29, 2012, the verdict stated that the PPP leader was not transparent with respect
to his statements and could no longer be considered ‘sadiq’ and ‘ameen’.

The bench also directed the ECP to initiate legal proceedings against Malik.
It ordered that a criminal case be registered against the leader, who, it said,
had submitted an erroneous affidavit for the 2008 Senate elections in violation of election laws.

The bench ruled the withdrawal of the amount spent on Malik’s salaries and perks from him and its deposition in the national treasury.

The Senate’s chairman should send a reference against Malik, the court ruled, adding that,
the minister’s affidavit for the Senate’s election was not transparent.

The bill had been approved by the cabinet, but not passed by the assembly yet.

Chief Justice Iftikhar Muhammad Chaudhry, heading a three-member bench, said they had prolonged the hearing so that the Parliament could amend the Constitution on the subject. He said the federal cabinet had approved proposed dual national legislation but the Parliament did not pass it yet.

Without having any sympathy for Rehman Malik, let me say Supreme court has opened Pandora box by charging him using article 63 (i.e member should be "sadiq" and "aameen"). This is a really dangerous precedence.

I think, assembly didnt pass the bill, because PMLN and few PPP guys were opposing the bill.

This "qualification" is actually written in the constitution? Who decides this and under what criteria? Was this language added to constitution under the "Sadiq" and "Amin" Zia ul Haq?

No pandora's box. Current judges are partial and their verdicts are selective. Their problem is PPP government and Zardari. Once they get rid of them, and install that Ameerul Momineen Nawaz, everything will be hunkydory.

Rahman Malik is having a tough time because of this case. ECP has also announced to take action against erring politicians...

SC asked him to reveal names of other parliamentarians with dual nationals and RM says I have no knowledge about them. I mean seriously? :halo:

PPP allies like ANP and Q-league were opposed to the dual nationality bill.PPP had no choice but to abandon the bill.
Another twist is that ANP believes that the bill was brought forward because of pressure from MQM.

Attorney general advises the CEC to act within the constitution, and even the supreme court doesnt have the authority to issue instructions to the CEC.

So is the CEC the new supreme court?
And from what I remember, dual nationality is barred in the constitution for all MNAs and MPAs, and consequently, senators, and PMs and Presidents also fall in the same category. So what on earth is this attorney general talking about? If the Supreme court says dual nationals are barred from the assembly and senate, how is that against the constitution?

Same should be applied to the Bureaucrats , judges and Army personals.
