Gibbs banned for two Tests

Herschelle Gibbs, the South African batsman, will miss the remainder of the series against Pakistan after being banned for two Tests by the ICC. Gibbs was charged under Level 3.3 of the ICC’s Code of Conduct for making abusive comments about a section of the crowd, and his punishment was meted out at a hearing conducted by the match referee Chris Broad. He will also appear before a Cricket South Africa disciplinary committee on Tuesday .

The ICC code prohibits using “…any language or gestures that offends, insults, humiliates, intimidates, threatens, disparages or vilifies another person on the basis of that person’s race, religion, colour, descent or national or ethic origin”. Gibbs’s comments, believed to violate the code, were picked up by the stump microphone on the fourth day of the first Test at Centurion.

Ordinarily, a Level 3 offence carries a ban of between two and four Test matches or between four and eight ODIs.

South Africa’s Herschelle Gibbs has been banned for two Test matches for making racist comments during the first Test against Pakistan.
The ban, imposed by match referee Chris Broad, was half the maximum penalty for an offence of this sort.
His words were picked up by the stump microphone and broadcast on television during day four in Centurion.
Cricket South Africa said the comments were made after fielder Paul Harris was abused by members of the crowd.
“Herschelle says these remarks were for the ears only of his team-mates in his proximity,” said chief executive Gerald Majola.
“He has apologised if he has caused offence to anyone.”
Gibbs, who hit 94 in the first innings of the seven-wicket win at Centurion Park, near Pretoria, will miss the rest of the series against Pakistan. CSA has also organised its own disciplinary hearing, set to take place on Tuesday and headed by former judge Mervyn King.
Rule 3.3 of the International Cricket Council code of conduct prohibits using " … any language or gestures that offends, insults, humiliates, intimidates, threatens, disparages or vilifies another person on the basis of that person’s race, religion, colour, descent or national or ethic origin."
The last leading player to be given a ban for a racist outburst was Australia’s Darren Lehmann, who was suspended for five one-day matches in the run-up to the last World Cup after an incident against Sri Lanka.
Several unruly spectators were ejected from the ground on Sunday’s fourth day in Centurion.
Captain Graeme Smith said he could not condone Gibbs’ action but he made strong comments about the circumstances which led to the incident.
"There was quite a lot of racial abuse from the Pakistan fans towards our players and I think that provoked a lot of what happened," he said.

This is the second time Gibbs has been banned from the international game. He was suspended for six months in 2000 for accepting a bribe to play poorly in a match against India, although he subsequently went back on the agreement.

Although what Gibbs said was repulsive and he deserved to be punished, one cannot condone the alleged unruly behaviour of a section of the Pakistani crowd. Those so-called fans were quite rightly ejected from the ground. Hope we do not see a repeat of these distasteful incidents during the remainder of the series.

Seems like 2 different versions. One stating that Harris was abused and other stating Gibbs. Frankly speaking I don't believe what Smith said. Did anyone hear about Ntini hit by a Pakistani flag on his head?

These S Afrikaners are rascists with loose tempers, to make things worse they resort to verbal abuse.

Maybe next time when they are provoked they can either pick up a bat and have a swing at the unruly crowd or they can refuse to take the field and become hero's.

Gibbs was being abusive and has ben punished with no time to spare, kudos to Cricket South Africa.

Smith is just making up stuff to justify Gibbs' behavior. If there was an issue with spectators, why weren't they exposed or expelled sooner? Also, before you start thanking ICC and Broad, remember they chose the lighter sentence. If any Asian player had done something similar, he would have gotten the maximum punishment without any doubt. It would serve Inzi well if he were to complain against that creature Nel as soon as possible to muzzle him, as Nel will keep getting worse by the day.

The punishment serves him right. It shows that you can't get away with blatantly bad behaviour all the time because some referees at least will act in a fair way.

I am with M. Arthur, professionalism is with limits, I can give you few examples from the America, NFL, NHL and MLB (forget NBA) there are many mic' on those field's but rarely you hear abusive language, I agree such a comment should not be passed by a professional cricketer coz one represents his country and as a sportsman you should never wear your heart on your sleeve.
Gibbs got the right treatment but ICC should take great measures to ensure their money is put to right technology.

The South African board (CSA) has said Herschelle Gibbs will appeal against the two-Test ban imposed on him by the ICC for alleged comments made by him during the first Test between South Africa and Pakistan. The decision has led to the CSA’s hearing of the issue being postponed till the ICC appeal process is completed.

The CSA’s hearing, chaired by Judge Mervyn King, is to determine whether the alleged remarks were in breach of the Rules and Code of Conduct of Cricket South Africa. If found guilty, Gibbs would have breached the board’s clauses on abuse “on the basis of race, religion, colour, descent, national or ethnic origin” and on “unbecoming conduct which brings the board or the game into disrepute”.

“As the ICC findings and suspension have a bearing on CSA’s disciplinary matter, I have postponed the hearing until after Herschelle Gibbs’s appeal proceedings have been completed by the ICC”, King said.

Gibbs comments came shortly before lunch on the fourth day of the Test. According to the ICC Rules, all fines and punishments are suspended till a decision is taken on the appeal. Gibbs had 24 hours to appeal against the ban handed down by Chris Broad, the match referee.

Gerald Majola, the chief executive of the South African board, said that the CSA’s charges against Gibbs were laid before those of the ICC. “As Judge King has pointed out, the ICC procedures have a bearing on our own hearing and so no further statements will be forthcoming from CSA on this matter until after the ICC and our own disciplinary procedures have been completed,” he said.

Captains normally set the precedence of attitude in a team. Smith is who he is and I can't believe Amla type people have a smooth time in the team.
Any how his support (in a way) shows why GIBBS and the others SOBs of Saffies behave like they do. a.k.a Mr. Nul.... or nel....

A side note - how would we fare with big mouth Younis at the helm....would others in our team get the same loose strings approach as smith seems to be giving his team...

South Africa batsman Herschelle Gibbs is appealing against his two-Test ban for making racist comments during the first Test against Pakistan.

A Cricket South Africa hearing into the matter, to be headed by ex-Judge Mervyn King on Tuesday, has been postponed.
The comments were allegedly made after Protea fielder Paul Harris was verbally abused by members of the crowd.
A statement released by King said Gibbs would be assisted in his appeal by the South African Cricketers’ Association.
It continued: “As the ICC findings and suspension have a bearing on CSA’s disciplinary matter, I have postponed the hearing until after Herschelle Gibbs’ appeal proceedings have been completed by the ICC”, King said.
The ban would have automatically ruled Gibbs out of the second and third Tests against Pakistan. But he is now likely to remain available for selection until his appeal is heard.
