If Zardari decides to resign, new president has to be elected in 30 days

ISLAMABAD: Top legal and constitutional experts say that if President Zardari’s ailment prolongs and he ultimately chooses to resign or is unable to perform duties because of physical incapacity, elections for the vacant office will have to be held within 30 days under the Constitution and the new incumbent could continue in office for the next five years.
They say that the present assemblies can elect the new president and there is no legal or constitutional hitch whatsoever in this regard. Former Supreme Court judge Justice (R) Wajihuddin Ahmad told The News that article 41(5) of the Constitution reads: “An election to fill a vacancy in the office of President shall be held not later than thirty days from the occurrence of the vacancy:” and article 44(1) reads as “Subject to the Constitution, the President shall hold office for a term of five years from the day he enters upon his office”.
Wajih said if the top PPP leadership chooses to give rest to President Zardari or the president resigns from his office on the basis of physical incapacity, the election commission will be bound to hold elections within 30 days of vacation of office and any new nominee of the ruling alliance could be elected by the electoral college as defined in article 41(3).
Senior legal and constitutional expert Barrister Farogh Naseem while talking to The News from Karachi said that if the office of president falls vacant, the elections will be held within 30 days and there will be no legal or constitutional hitches in holding of elections from the present assemblies.
“Any one who wins the new election, if held, will continue in his office for the next five years if not removed constitutionally,” said Farogh. When asked how the present assemblies having a life of just one year could give five-year mandate to a person, he replied there is no legal or constitutional problem in this.
“See, any assembly can pass a legislation even on its last day so it can also elect a new president,” Farogh said. To another question, Farogh said that if President Zardari decides to resign he would be unable to contest any fresh election because of two-year bar to contest elections.
Justice Wajih told The News that among many other objections against the candidature of General (R) Pervez Musharraf including his being in the service of Pakistan in army uniform, re-election from the same assembly twice after completing a term, this objection was also raised as to how an outgoing assembly having life of a few months could elect a person for the next five years.
He said had an independent judiciary decided his petition, the legal and constitutional positions on the issue might have become clearer.
Justice Wajihuddin Ahmad had filed a petition in the apex court against the candidature of Musharraf. The petition was being heard by the Supreme Court when, sensing an adverse judgement against him, General Musharraf imposed emergency in the country as chief of the army staff.
Later, Justice Dogar first dismissed the petition but later took it up again and dismissed the same after ‘proper’ hearing.
The independent judiciary didn’t take up this petition after its restoration and right now, according to top legal experts, this judgement of the Dogar era allows any serving general to contest presidential elections.
