Remarks of lahore High Court Judge

Lawmakers belonging to Pakistan’s minority HIndu community walked out of Parliament to protest a top judge’s remarks that Hindus might be financing terrorist attacks in the country.

Ramesh Lal, a lawmaker from the ruling Pakistan People’s Party, raised the issue in the National Assembly on Tuesday, saying the sentiments of an estimated four million Pakistani Hindus were hurt by Lahore High Court Chief Justice Khwaja Muhammad Sharif’s uncalled for remarks.

While hearing a petition on barring the deportation of Afghan Taliban leaders on Monday, Justice Sharif rebutted arguments by a lawyer that US security firm Blackwater and Hindus were involved in terrorist attacks and remarked that “Muslims and not Hindus are involved in terror acts in Pakistan.”

He had contended that Hindus “might be the financiers” of such attacks.

Lal said if a country was suspected of sponsoring such attacks it should be named but blame should not be put on the Hindus who were as patriotic as other Pakistanis.

He drew the attention of President Asif Ali Zardari and Yousuf Raza Gilani to the worry caused to Hindus by the judge’s remarks and appealed to Supreme Court Chief Justice Iftikhar Chaudhry to take suo moto notice of the matter.

----> Usually these remarks are from the politicians, thats acceptable, but these remarks coming from Judiciary and that too from High Court of lahore…LOL…without any proof or logic…What a Dungar Judge!!! Any Judge of High Court using these words should be sent back to some decent law school.

Re: Remarks of lahore High Court Judge

A judge using the words "might", "may be"...what non sense...As a judge of high court these comments are not going to help society.

that is shameful indeed, may be this was the reason he was not allowed to supreme court to continue for few years and left to retire this year.

We will not compromise on our jurisdiction: CJP Updated at: 2105 PST, Wednesday, March 17, 2010

ISLAMABAD: Chief Justice of Pakistan Iftikhar Muhammad Chaudhry Wednesday said that the Supreme Court (SC) will not compromise on its jurisdiction and would not curtail it.

A three-member bench comprising Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, Justice Ch. Ijaz Ahmed and Justice Khalil ur Rehman Ramday took up a constitutional petition filed under Article 184 of the Constitution by Justice Syed Manzoor Hussain Gillani.

The SC adjourned hearing for two-week of a case related to appointment of Chief Justice of Azad Jammu and Kashmir Supreme Court on the request of Attorney General for Pakistan.

Attorney General for Pakistan Anwar Mansoor Khan apprised the bench that Chairman AJK Council/Prime Minister of Pakistan, had been engaged in different national issues and could not look into this matter.

He also referred to a restraining order passed by a full bench of AJK SC headed by Chief Justice Riaz Akhtar Chaudhry barring AJK Council and its Chairman (Prime Minister of Pakistan) from issuing any fresh advice or reviewing or re-opening the advice already submitted in October 2006.

Chief Justice said that they would go through the matter under constitutional provisions.

“We will not compromise on our jurisdiction and would not curtail it,” he added.

Justice Khalil ur Rehman told AG to look into other means for resolution of issue during this period.

“We have nothing to do with it. We have to examine our Prime Minister’s action and we have already issued a direction in this regard. We have to proceed under Article 184 of the Constitution” Chief Justice said while replying to objections raised by a member of AJK Bar regarding apex Court’s jurisdiction.

Chief Justice said “your case was not before us, if it came up then we would look into it”.

The main petition was moved by Justice Syed Manzoor Hussain Gillani of the AJK Supreme Court seeking declaration against the Prime Minister of Pakistan/Chairman of the AJK Council to approve summary for appointment of AJK CJ.

On Monday, the same bench had directed Attorney General for Pakistan Anwar Mansoor Khan to approach Prime Minister of Pakistan, also Chairman of Azad Jammu and Kashmir and request him to decide the pending representation of Justice Syed Manzoor Hussain Gilani over his appointment as AJK Chief Justice.

Justice Sardar Mohamad Nawaz, Jammu and Kashmir Council for Human Rights, Tabassam Sadiq advocate and 16 others had also moved pleas in the pending matter.Geo
