I have heard some incidents (real life) about these property thieves, and kabza (sp?) groups...so sad and scary... :(

Let me educate you little more. Main Qabza groups are big property developers. Pakistani law says that if you have a 100 kanal land, you are eligible to take, say 10 kanals surrounding that and it is easy to increase holdings this way. For instance, Bahria town's 10 marla plot value is 30 lakh and the owner of Bahria town pays 1~2 lakh to poor owners of lands surrounding his land on DANDA ZOR. Take it or leave it policy under GUN rule. Plus all bureaucrats in hand. I have myself seen luxury houses he gifted free to judges, high grade officials, etc.

Same policy is used by mid size property dealers.

Judicial system is corrupt and doesn't work.

Pakistan is not the place for poor unlike Canada, US, UK, etc where Govt supports its people. Yet another scam here Benazir income support fund. No industry, no manufacturing and telling people to take money which grows on TREES.

now the thing is , we have also been told that having a will is not enough , since the islamic law of inheritance overrides any will formed , hence they will still be able to claim some property since we dont have a brother. I have also been told this several times , however i am still not sure of the validity of this point.

But the good thing is all of this property is my fathers , none of it is from inheritance , however its worth mentioning that my mother and father and mamu and mumani are all first cousins to each other ( interfamily marriages )

so i feel all the more insecure. Plus my dad wants to secure my mom as well , say if god forbid anything happens to him he wants my mom to feel secure and so has kept the main property in her name. ( clearly mamu will be able to claim from that property )

so i was very keen to find out if anyone else has encountered this situation or know how to keep oneself prepared to face this situation .. My dad and I both agree that we should try to avoid going to court for as long as possible and try to settle it all down peacefully … but it looks like it aint happening .. :hinna:

Keen to find out more about what you mean with the fast way … yeah i havnt grown up in Pakistan but I sure want to learn every possible way to deal with those freaks … even their teenage son is threatening us !!!

and i didnt get it .. like the house market price might be 1 crore and will the owner get only 35% of the cash and the rest goes to the property developer ? Please explain , I think i just got confused there .. :no:

and another thing , is it any consolation that most of this property is in islamabad and comes under CDA? I know pinidi isnt the strongest and the safest when it comes to land mafia .. but i thought islamabad was a bit safer…

Like someone said "laalchi loomriyaan" will take it all..!

What I meant is that if your property value is 1 crore and someone has Qabza on it, then there are property dealers in market who will pay you 35 lakh cash and take an undertaking from you that you have sold property to them. Now, you won't have any right on property as u already got 35% money in cash of the property even which isn't in your custody. It will be their job to vacate it, get possession and do legal paper work to secure as they bought it in 35 lakh from you (just like you sold a thing below market).

You are right, Islamabad was secure but such Qabza cases are also in high number there too. You see a political person can get plot worth millions of rupees in Islamabad with a single signature allotment. No rules here for common man! Bureaucracy is too strong!

Don't go to court. You will spend a lot of money and keep visiting court for years.

Friends , I have a question :

Since relatives can demand inheritance from my father's property , does that mean i can do the same when it comes to their properties ? as in phada daal doon that i too demand inheritance ?

CB - If I were you, I would seek some proper legal opinion on the matter. There is plenty of very good lawyers, the best ones are frickin' vultures and will rip the stomach out of living relatives, you will have to spend some money but will get your money's worth. Do not try to handle these matters on your own. Dealing with the inheritance laws - or any laws can be a bytch in Pakistan. Hire a good lawyer to handle your case.

dealing with property and inheritance in pakistan as been a nightmare experience for me. esp that too because i am a woman.

It's sad and shocking to hear what your mamu has done. I don't know how such people can live with themselves knowing they have cheated their own family, they don't even fear the Almighty swt.

yeah , definitely he is going to hell and so is his wife ... I am trying my best to support my mom , dad and specially my nana jee .. he is elderly and very very disheartened ( my dad and nana jee went to islamabad to mamu's house for reconciliation and mamu and mumani threw both of them out of their house )

I did try to speak to one or two lawyers in Pakistan , problem is my freaking accent, they know immediately i am from abroad and then the rip off starts ... so now am thinking perhaps we should wait until dad and mom move to islamabad in a next two to three years and then try to build some networking in friends and the community and deal with them then.

oh well God help us ! my mom says the same thing Mustana .. she says they will suffer for their bad deeds in this world and the hereafter ...
