Question for all you "Americans"

I was watching something that took place way back in 1997 in USA. The British nanny who was accused of killing an infant. Now I watched the whole case, and by the end, the judge over-ruled the jury and gave her ( instead of life ) - just around 8 months in prison.

My question is:

Are judges still allowed to reduce murder to manslaugter? (Since this took place a few years back, I’m not so sure if it still true today. I am pretty sure it is, but anyhow)

If it is indeed true, what are your views on it?

Oh yeah heres something I found online, in case you folks arent familiar with the case.

(ps The strangest things I found were that her expressions during the trial were way out of whack.)

Dunno why he did that. I would figure killing an infant is even worse than killing a man.

BTW, what is the difference between murder and manslaughter?

Well yes like fraudia pointed out. Murder is a "planned plot" , manslaughter is not "intended" .

So no takers on this one? What are your views? Somebody must be familiar with the case. Mr fraudia dont let me down. :p

Judges have a great deal of latitude, depending on the state. Certain states have mandated sentences where the judge has no latitude depending on the nature of the crime. In other cases the judge may have no latitude such as in the case of a "three strikes" offender who has two prior violent convictions. In that case the judge has little or no latitude. In most cases the defendant can appeal the determinations of a judge, but for the most part appeals can only be done on technical issues, not matters of judgement.

Well I was in no mood to google, seeing as how I might just get some weird 'not so true' info, but your post has been helpful. Lower my standards and PM MV ,lol. Its an option, I will see. May I ask why he would know about all this ? Oh I was watching American Justice. Although that does seem to be ironic.

Its bugs me. This whole letting murderers free, or convicting innocents.

MyVoice is an attorney, so theoretically, very theoretically he should know something about the law.

This case pissed me off so much when it happened. She killed a baby and walked, how sick was that?

We might not have her in jail, but then England who screamed innocent has her on their shores. I wonder how many hypocrites over there hired her as a nanny when she went back.

Minah – I know! I saw the entire case, and I could not believe it when they just let her go. Not even a year in prison. Thats unfair! And she didnt just kill the baby, she made it suffer. It made me cry when the grandmother talked of his last few moments. :frowning:

I adore babies. The reason I am interested in the law is because I happened to watch this case. It was extremely sad, and pathetic when it came to the punishment for the murderer.

For now, I am done with school thank you very much.
