Qayyum accepts Ahsan’s open debate challenge on judges’ restoration (merged)

Interesting… I just hope that they will act civilized during the debate and it will act as an initial step in the restoration of judiciary.

ISLAMABAD: Attorney General Malik Muhammad Qayyum Saturday accepted the open debate challenge of Supreme Court Bar Association’s president Ch. Aitzaz Ahsan for a public debate on the topic of restoration of deposed judges of supreme and high courts.

It is up to Aitizaz Ahsan to determine the place and time of such debate he said and added he would reach there.

Attorney General said that Aitizaz Ahsan could also nominate the participants and judges of his choice to observe the debate.

It is just a Noora Kushtee , you will never see a debate. In my life I have seen these kind of challenges and acceptances but no debate ever happened. They would keep this debate going only on the media just to be in the news.

They really acted like civilized persons. But unfortunately, Aitzaz Ahsan was not looking very convinced with his own words. Qayum Malik was so arrogant and looked like a tyrant in the cloths of an Attorney.

I must say that after listening to Aitzaz Ahsan's points it looks like Musharraf has damaged constitution of Pakistan so badly that one cannot find an example in the whole history of Pakistan.

If I was allowed I could have written the word constitution with a prefix "Pro" instead of "con", which Musharraf has made it instead.

Moreover Attorney general was trying to cover one sin with the other sin.....which shows a real show of power.

It seems Malik sahib was so scared to confront Aitezaz in an open constitutional debate that:

A - He arrived 20 minutes late for the show
B - Developed a sore throat

Notice how Qayyum avoids answering Q on legal issues directly, preferring instead to play with legal words in order to confuse everyone :smiley:

qayyum took aitzaz to the sword.
aitzaz was doing nothing but lieing throughtout the whole show and going off topic when he has no answer to qayums question, while qayum countered each and every question of aitzaz

While Aitzaz only talking politically, it was Malik Qayyum who talked according to constitution. Qayyum also said that it was Supreme Courts decision every time that validated PCO and takeover. Also, according to our Constitution and Supreme Court verdicts; Martial Law and their adminstrators and Martial law tribunals are all valid, provided IMMUNITY and PROTECTION:

The Constitution (Amendment) Order, 1980, (P.O.No.1 of 1980) section 2 (with effect from May 26, 1980) inserted clauses (3A), (3B) and (3C) which read:

(3A) Notwithstanding any judgment of any Court, including any judgment in respect of
the powers of Courts relating to judicial review, a High Court SHALL NOT, under this Article:-

(a) make an order relating to the validity or effect of,any Martial Law Regulation made by the Chief Martial Law Administrator or any Martial Law Order made by the Chief Martial Law Administrator or a Martial Law Administrator or of anything done, or intended to be done or taken, thereunder;

(b) make an order relating to the validity or effect of any judgment or sentence passed by a Military Court or Tribunal;

(c) grant an injunction, make any order or entertain any proceedings in respect of any matter to which the jurisdiction of a Military Court or Tribunal extends and of which cognizance has been taken by a Military Court or Tribunal; or

(d) issue any process against the Chief Martial Law Administrator or a Martial Law Administrator or any person acting under the authority of either.

3C) The Proclamation of the fifth day of July 1977, all President's Orders, Orders of the Chief Martial Law Administrator, Martial Law Regulations and Martial Law Orders made on or after the fifth day of July 1977, are hereby declared, notwithstanding any judgment of any Court, to have been validly made."

Article 179. Substituted by the Constitution (First Amendment) Act, 1974 (33 of 1974) section 9 (with effect from May 4, 1974) for:

"(3) An order shall not be made under clause (1) on application made by or in relation to a member of the Armed Forces of Pakistan in respect of his terms and conditions of service, in respect of any matter arising out of his service or in respect of any action taken in relation to him as a member of the Armed Forces of Pakistan."

Lawyers Are Betraying Aitzaz, Attending PCO Courts

ISLAMABAD, Pakistan—Aitzaz Ahsan has once again tried to fool the whole nation by stating that only six lawyers are appearing in Court proceedings before PCO Judges.

He made these remarks in a live discussion between Justice (Rtd) Abdul Qayyum Malik Attorney General of Pakistan and Aitzaz Ahsan in Hamid Mir's program Capital Talk today, Mar. 19, 2008.
I fail to understand why Aitzaz Ahsan keeps on lying and lying.

Is he a lawyer or a liar?

People would be surprised to know that there is hardly any senior advocate and office bearer of Pakistan Bar Council, High Court bars and bar associations who HAS NOT attended the Court proceedings in front of the PCO judges after November 3, 2007.

I am forwarding here a list of Supreme Court lawyers who appeared before the Supreme Court on March 6, 2008, which includes big names of the lawyers agitation movement. This is a prove that Aitzaz Ahsan is misleading the Pakistani public opinion by saying the lawyers are boycotting the courts.

The timing of any such debate couldn't have been better. Qayyum sahab's own kursi is like a three-legged stool right now and he can fall any day (or preferably will tender his resignation). In case he didn't notice, there is a new sherriff (i.e. PM) in town.

Malik Qayyum has no sharam whatsoever. He claimed that he was not aware of any presidential order decreeing deposed CJP's house arrest. Why was there barbed fence outside his house and why so many police patrolling the area all these months? The poor guy was n't even allowed to use the veranda and lawns of his own house. What has Mush been upto thenover the past 4 months or so? Qayyum was shamelessly lying thru his teeth.

Well Aitzaz Ahsan is the man who appointed convicted murderers and party crooks as judges, and the one who defended extra-judicial killings by the PPP govt. So don't expect him to truthful, when it comes to pursuing his personal agenda.

An impatient Aitzaz Ahsan was warning the new govt and parliament today, that the clock was ticking, and if they did not restore the judges within 30 day, a long march would be launched.
