Yes I get that point and the point I am making is that rule of law is for all. It doesn't matter if it is a terrorist or a military combatant or a civilian who has become a combatant. Regardless of their official classification rule of law should always be maintained. Pakistan has enough lawlessness that we don't need to add to it. Additionally as Ali said Islamic jurisprudence also has rules regarding war and taking prisoners. Every society regulates warfare save for the terrorists. Because they are sub-human. The Indians however did not hang them or kill them. They complied with international law. That is what the Pakistani army needs to do. We do not need to follow the US in its desire to circumvent International Law and basic human rights.

If people complain about GITMO and rendition they can not in good faith give the same lawless rights to the Pakistani military. And American forces are restricted by International law, their own code of conduct and the US constitution. Of course it is debatable how effective these laws are with the CIA detention centres and the torture that occurs in Bagram. But they do have laws they are supposed to obey and follow.

The insurgency started in 2005. It was brought on by the killing of Bugti which everybody in Pakistan knows Musharraf ordered. That is why there is an arrest warrant for him with Interpol. Regardless of that the military has followed the same tactics you have suggested when it comes to the Baloch insurgents. They kidnap them, "brain wash" them and then well most die due to their brutal hands.
